Brad,
I have reviewed the 401 Certification application for the above referenced project have the following
questions/comments:
1. In order to document that the project meets 15A NCAC 02H .0506(b)(1) "has avoided and minimized impacts",
please provide more details as to why "recreational fields" are a necessary portion of the project, and if
necessary, why the overall project cannot be redesigned (number of lots or lot layout) to locate these fields
outside of jurisdictional features.
2. In order to document that the project meets 15A NCAC 02H .0506(b)(1) "has avoided and minimized impacts",
please provide an evaluation why the overall project cannot be redesigned (number of lots or lot layout) to
locate the stormwater control measure outside of jurisdictional features or why other methods of stormwater
management could not be used which could avoid or reduce the impacts to jurisdictional features.
This application will be placed "on hold" until receipt of the above information. Please respond within 30 days.
