(Conversion 'to Nonprofit Corporation)
Pursuant to §55.10.06 and §55A-2.02 of the General Statutes ofNorth Carolina, the
undersigned corporation hereby submits the following Articles of Amendment for the purpose of
amending its Articles of Incorporation to covert the corporation from a business corporation
incorporated pursuant to Chapter 55 of the General Statutes ofNorth Carolina to a nonprofit
corporation incorporated pursuant to Chapter 55A of the General Statutes of North Carolina:
1. : The name of the corporation is Waterway Landing Homeowners
Association, Inc. (the "Corporation").
2. Duration: The period ofduration of the Corporation shall be perpetual.
3. Definitions: As used is these Articles of Incorporation ("Articles"), the
following definitions shall apply: '
(a) Capitalized terms shall have the same meaning specified for such
terms as more particularly set forth in the Declaration heating Unit Ownership For Seaside
Landing, A Condominium, and any amendments thereto (collectively the "Declaration"), recorded
in the office of the Register of Deeds of Brunswick County, North Carolina, unless such terms
otherwise are specifically defined herein, and,
(b) References to the "North Carolina Nonprofit Corporation Act" shall
mean Chapter 55A of the General Statutes of North Carolina, and,
(c) References to the "North Carolina Condominium Act' shall mean
Chapter 47C of the General Statutes of North Carolina, and,
(d) References to the "Code" shall mean the Internal Revenue Code of
1996, as amended.
4. E100se: The Corporation is organized and will be operated consistent with
the North Carolina Condominium Act (the "Act') to undertake and perform any and all activities,
responsibilities, and obligations applicable to the Corporation set forth in the Act and the
Declaration, Bylaws, and these Articles (collectively, "Corporation Documents").

In order to achieve the foregoing purposes, the Corporation shall have the following
powers and authority:
(a) To exercise all powers and rights and perform all of the acts and
duties and obligations of the Corporation as more particularly described in the Act and the
Corporation Documents; and,
(b) To undertake any activity whatsoever that is in furtherance, directly or
indirectly, of the purposes of the Corporation set forth above; and
(c) To take any and all actions necessary and appropriate to qualify the
Corporation under Code Section 528 and to elect that the Corporation be taxed under Code Section
538, if applicable, and if such qualification and election is determined by the directors of the
Corporation to be in the best interests of the Corporation; and,
(d) To take any and all action necessary and appropriate to qualify the
Corporation under Sections 105-125(a)(8) and 105.130.113(a)(11) of the General Statutes ofNorth
Carolina, if such sections are applicable.
Provided, however, and notwithstanding any power or authority set forth above in
this Article, the Corporation shall have the power and authority to engage 9& in activities that
meet each of the following requirements:
(aa) Such activities are not broader than those activities that may be
undertaken by a nonprofit corporation pursuant to the North Carolina Nonprofit Corporation Act; and,
(bb) Such activities are not broader than those activities that may be
undertaken by the Corporation pursuant to the Declaration; � jii ,
(cc) Such activities are not broader than those activities that may be
undertaken by a condominium association pursuant to the Act.
5. Directors: The number of directors constituting the board of directors shall
be three (3), and the name and address of the persons who shall serve as directors until successors
shall be elected and qualified, are as follows:

Subsequent Boards, the number of directors, their terms of office, and the method of
their selection shall be provided for and determined as is set forth in the Bylaws of the Corporation.
6. Nonprofit Issues: The Corporation is not organized and shall not be operated
for pecuniary gain or profit. No part of the net earnings of the Corporation shall inure to the benefit
of, or be distributable to, its members, directors, officers, or any other individuals, other than (a)
reasonable compensation paid by the Corporation for services actually rendered, (b) by acquiring or
providing management, maintenance, and care of the Condominium and the Common Elements as
set forth in the Declaration, and (c) by rebating excess membership dues, fees, or assessments
pursuant to Section 55A-13-02(b)(3) of the North Carolina Nonprofit Corporation Act.
7. M°mber hips ' : The Corporation shall have members, and the qualifications
and rights of members shall be set forth in the Bylaws of the Corporation and the Declaration.
S. Dissolution: In the event of dissolution of the Corporation, any net assets
remaining after the satisfaction of the Corporation's liabilities shall be transferred and delivered
(a) to one (1) or more nonprofit corporations formed under the North Carolina Nonprofit
Corporation Act, as shall be selected by the Board of the Corporafion, that are organized generally
for purposes similar or related to those set forth in Article 4 hereof, or (b) as otherwise permitted or
permitted by law. The Corporation may be dissolved at any time, if such dissolution is undertaken
consistent with the North Carolina Nonprofit Act and the North Carolina Condominium Act, and
with the required affirmative consent of not less than eighty percent (90%) vote of all members of
the Corporation entitled to vote.
9- Reeistered Office and gent: The street and mailing address of the
registered office of the Corporation is 1780-1 Chandlers Land, Sunset Beach, Brunswick County,
North Carolina 28468; and the name of the registered agent at such address is Jane Harris.
10. Principal Office: The street and mailing address of the Corporation's
principal office is 1780-1 Chandlers Lane, Sunset Beach, Brunswick County, North Carolina 28468.
11. LimitatiDnonP-ersonalLiphilim. To the fullest extent provided bylaw, no
director of the Corporation shall be personally liable for monetary damages arising out of an action,
whether by or in the right of the Corporation or otherwise, for breach of any duty as a director.
12. Amendments to Articles of Income ration: Amendment of these Articles may
only be undertaken consistent with the applicable provisions of the North Carolina Nonprofit
Corporation Act.

13. These Articles of Amendment were adopted by the board of directors' and
contain an amendment not requiring shareholder approval. No shares were ever issued by the
Corporation. Consequently, there are no current shareholders of the corporation; therefore,
shareholder approval was not required.

of State.

On July 16, 2012, staff of the Wilmington Regional Office of the Division of Water Quality (DWQ) was notified that
Sea Trail Corporation filed for Bankruptcy and that CC & C Builders, LLC was dissolved on April 20, 2009. On July
16, 2012, file reviews for the projects listed in Attachment A located in Brunswick County were conducted to
determine compliance with their State Stormwater permits.
When there will be a change in ownership of a permitted facility, a completed "Name/Ownership Change Form" must
be submitted to DWQ. The request for transfer of ownership form can be downloaded at:
http://Dortal.ncdennom/web/waA%Wsu/stateswfforms docsft -3. Permit ownership must be transferred to the bank
that is now in possession. Once the projects are sold to third part(ies), the bank will transfer ownership to the third
part(ies). Please submit the completed name/Ownership Form along with the supporting documentation to the
Division.
Please inform this Office in writing before August 17, 2012, of the specific actions that will be undertaken and the
time frame that will be required to correct the above listed items.

It has come to the attention of the Division of Water Quality (DWQ) that you purchased a 3.8
acre tract of land at the end of Park Road in Sunset Beach, Brunswick County known as
Waterway Landing. It is the bivision's understanding that you constructed condominiums,
parking areas and a stormwater management system on this property. This property, previously
owned by Sea Trail Corporation, is covered by a Coastal State Stormwater Management Permit
SW8 980521, issued to Mr. Walters on December 10, 1998. This state stormwater permit, SW8
980521, requires that the Division be notified when there is a transfer and change of ownership
of the property and facilities. Such notification has not been received by DWQ.
The options to bring this project into compliance include:
Accept the current state stormwater permit as approved from Sea Trail Corporation. The
transfer of ownership request form is enclosed. There will be no cost associated with
this first time transfer of this permit.
a. Submit a certification of the stormwater system from an appropriate designer
certifying that the facility has been installed in accordance with this permit,
approved plans and specifications. If the stormwater system substantially
deviates from the original approved plans a permit modification will have to be
submitted to DWQ.
b. Following a compliance inspection and determination by DWQ, a second transfer
of ownership request may be submitted to transfer the permit to the Waterway
Landing Homeowners Association.
2. Do not accept the transfer of the current state stormwater permit. Instead, submit an
application with a check for $505.00 for a new state stormwater management permit.
The new permit will be required to meet new permit requirements outlined in 15A NCAC
02H .1005 effective October 1, 2008. This may require changes to your current
stormwater system for this development.

This letter is to notify you that you are in violation of Title 15A North Carolina
Administrative Code (NCAC) 2H. 1003 in accordance with. North Carolina General
Statute (G.S.) 143-214.7 for failure to apply for and secure a Stormwater Management
Permit.
On August 5, 2010, staff of the Wilmington Regional Office inspected the site and
observed impervious surfaces including paved parking, a maintenance shed, 4 multi -
residence buildings and a pond system on the subject development site known as
Waterway Landing located at the end of Park Road, Sunset Beach, Brunswick County.
Specifically DWQ observed the following:
1. The project is operating without a state stormwater permit.
2. The pond system has a vegetated filter structure installed but is being bypassed
with direct discharge to the waterway.
3. The pond system was filled with cattails.
A review of DWQ files confirmed that no State Stormwater Management Permit has
been issued to Waterway Landing, LLC for the construction, operation or maintenance
of this project. As a result of the site inspection and file review, the following violations
are noted:
Failure to Obtain a State Stormwater Manianement Permit
Title 15A NCAC 2H.1003, in accordance with G.S. 143-214.7, requires a State
Stormwater Management Permit for development activities within the 20 coastal
counties that require a Coastal Area Management Act (LAMA) Major Permit or an
Erosion and Sedimentation Control Plan. The DWQ file review confirms that a State
Stormwater Management Permit was not obtained prior to construction of impervious
surfaces at the subject site as described above.

Since the initial inspection on August 5, 2010, the following events have occurred in an
attempt to obtain a state stormwater permit:
• On August 13, 2010, A Notice of Violation was issued to Sea Trail
Corporation for failure to submit an engineer's certification and Failure to
Build According to Plan at the Waterway Project.
• On September 8, 2010, DWQ received a response to the Notice of
Violation from the legal council representing Sea Trail Corporation stating
that the subject property had been sold to Waterway Landing, LLC on
September 30, 2004 prior to any construction activity.
• On September 9, 2010, DWQ received copies of building permits issued
to Waterway Landing, LLC by the Town of Sunset Beach for Building 1
units, Building 2 units and Building 4 units.
• On October 6, 2010, Angel Hammers of the Wilmington Regional Office
phoned Mr. Darren Lucas of Lucas Development, LLC who was referred
as the general contractor for Waterway Landing. A copy of the inspection
report from August 2010 was forwarded to Mr. Lucas as requested. DWQ
requested a permit application be submitted or other documentation
regarding the built project located at Park Road, Sunset Beach.
• As of December 14, 2010, DWQ has not received the requested state
stormwater management application or any other documentation.
Required Response
This office requests that you respond to this letter in writing within 30 calendar days of
receipt of this Notice. Your response should be sent to this office at the letterhead
address and should address the following items:
1. Please clearly explain why an appropriate Stormwater Permit was not
secured.
2. Submit a complete permit application with a completed supplement form,
a signed O&M agreement, sealed calculations, and two sets of detailed
plans along with the processing fee currently set at $505.00. Please note
that a Designer's Certification is also required upon project completion.
Thank you for your immediate attention to this matter. This Office is proceeding with
an enforcement action including the assessment of civil penalties regarding
these violations and any continuing violations that may be encountered. Please
be advised, these violations and any continuing or future violations are subject to
a civil penalty assessment of up to $25,000.00 per day for each violation pursuant
to North Carolina General Statute 143-215.6A. If the violations are not fully
resolved, this office is also considering requesting injunction relief through the
courts to achieve compliance on your site.
This office requires that the violations, as detailed above, be properly resolved.

I hope this finds you well. I am writing in regards to the Waterway Project (aka Waterway Landing) located in Sunset
Beach. I have reviewed the information submitted to this office with my lead compliance investigator. It is clear in the
documentation that the property was sold to Waterway Landing, LLC per the deed dated September 29, 2004 (recorded
as Bk2019 Pg 290).
However, what is not clear is the notification by Sea Trail to Waterway Landing, LLC that a state stormwater permit had
been issued with conditions of certification, maintenance, etc. If there was a contract or other documentation between
Sea Trail and Waterway Landing, LLC notating all conditions of the existing state stormwater permit would as of the sale
date, now be the responsibility of Waterway Landing, LLC, please forward a copy to this Office. Upon receipt and
review, the request to rescind the permit will continue.

If this link cannot be documented, the permit condition requiring the Permittee (Sea Trail Corp) to modify the permit
with a transfer of ownership becomes an issue of non-compliance with the issued permit. In this case, the permit will
need to be compliant with all conditions (including the PE certification) and a request for transfer of ownership will be
required from Sea Trail to the new Permittee.

office. Kelly Johnson told me to send you an email and request an extension for this matter to and including September
24, 2010, which she had agreed to. I will be out of the office beginning Friday, September 11, 2010 and returning to the
office on Monday, September 20, 2010. 1 have filed for a secured leave with the court during my absence.
Please find this email communication as a request that the Stormwater Permit No. SW8 980521 be rescinded. Sea Trail
Corporation sold the referenced property to Waterway Landing, LLC, CO Hebert & Company,177 Highway 42 Suite E,
Asheboro, North Carolina 27203 on September 30, 2004. A scanned copy of the three deeds showing the conveyances
is attached to this email communication. I can also provide you with a HUD-1 Settlement Statement, if that is needed.
When Sea Trail conveyed this property to Waterway Landing, LLC, this land was vacant land. Sea Trail was not
responsible for building any buildings, parking, or stormwater systems on the real property.
Please find attached a letter from Alan Lewis of East Coast Engineering regarding this issue. In his letter, Mr. Lewis
references building permits. I will forward these permits to you upon my receipt of the same.

Please be advised that Cox & Watts PLLC represents Sea Trail Corporation in the matter with the North Carolina
Department of Environment and Natural Resources' Notice of Violation to Sea Trail Corporation dated August 13, 2010
regarding NOV-2009-PC-0938 and Stormwater Permit No. SW8 980521. My client contacted me about this issue on
Friday, September 3, 2010.
Please be advised that our office phoned your office yesterday and left a message. I called back today, and it is my
understanding you were out of the office sick. I hope that you are feeling better. I spoke to Kelly Johnson with your
office. Kelly Johnson told me to send you an email and request an extension for this matter to and including September
24, 2010, which she had agreed to. I will be out of the office beginning Friday, September 11, 2010 and returning to the
office on Monday, September 20, 2010. 1 have filed for a secured leave with the court during my absence.
Please find this email communication as a request that the Stormwater Permit No. SW8 980521 be rescinded. Sea Trail
Corporation sold the referenced property to Waterway Landing, LLC, CO Hebert & Company, 177 Highway 42 Suite E,
Asheboro, North Carolina 27203 on September 30, 2004. A scanned copy of the three deeds showing the conveyances
is attached to this email communication. I can also provide you with a HUD-1 Settlement Statement, if that is needed.
When Sea Trail conveyed this property to Waterway Landing, LLC, this land was vacant land. Sea Trail was not
responsible for building any buildings, parking, or stormwater systems on the real property.
Please find attached a letter from Alan Lewis of East Coast Engineering regarding this issue. In his letter, Mr. Lewis
references building permits. I will forward these permits to you upon my receipt of the same.
I will be in the office all day on Thursday. Please contact me to discuss or let me know if you need anything further
regarding this matter. If you need to speak to someone while I am away from the office, please contact my law partner,

This letter is to notify you that you are in violation of Title 15A North Carolina Administrative
Code (NCAC) 2H .1000 for failure to follow permit conditions of Stormwater Management Permit
SW8 980521, Sea Trail Waterway Project.
On June 29, 2009, David Cox of the Wilmington Regional Office inspected the site to determine
the status of compliance with Stormwater Permit SW8 980521. It was discovered that this
permit had expired on December 10, 2008 and that the required Engineer's Certificate was
never submitted to this Office. A Notice of Violation was issued on July 13, 2009 to Mr. Dean
Walters, CEO of Sea Trail Corporation for Failure to Renew a State Stormwater Permit and
Failure to Submit an Engineers Certification.
Due to NC Session Law 2009406 signed by the Governor on August 5, 2009, the effective
period of this stormwater permit has been extended 3 years from its current expiration date.
The extended expiration date is December 10, 2011, and therefore, the stated Failure to Renew
a State Stormwater permit is no longer a violation.
However, the violation of not submitting a certification of the stormwater system remains valid.
The response received by this Office on July 24, 2009 from Sea Trail Corporation did not
address this violation and stated only that the project had been sold. This is not a valid
response. Even though the property has been sold, the permit was not transferred. Please
keep in mind that a permit cannot be transferred until all the' permit conditions have been met.
Upon receipt of a citizen complaint, a follow up inspection was conducted by Angela Hammers
of the Wilmington Regional Office to determine the current status of compliance with
Stormwater Management Permit SW8 980521. During the file review, it was found that no
additional information had been submitted to this Office in regards to the items outlined in the
Notice of Violation dated July 13, 2009.

Therefore, this project has been found in continual violation of Stormwater Permit Number SW8
980521, issued pursuant to the requirements of 15A NCAC 2H.1000. The violations found are:
1. Failure to submit an engineers' certification. A file review revealed that this office
has not received an Engineers Certificate of the stormwater system.
Permit condition states that upon completion of construction, prior to issuance of a Certificate of
Occupancy, and prior to operation of this permitted facility, a certification must be received from
an appropriate designer for the system installed certifying that the permitted facility has been
installed in accordance with this permit, the approved plans and specifications, and other
supporting documentation. Any deviations from the approved plans and specifications must be
noted on the Certification.
2. Failure to build according to the approved plan. The orifice pipe outlet structure is
not built according to the approved plans, which shows a 2" orifice pipe directing flow
into the vegetated filter. It was observed that this orifice pipe directs flow toward the
marsh, bypassing the vegetated filter. This system needs to be revised according to
the plans.
Permit condition requires that the facilities be constructed as shown on the approved plans.
Required Response
This Office requests that you respond to this letter in writing within 30 calendar days of receipt
of this Notice. Your response should be sent to this office at the letterhead address. Your
response should address the following items:
Provide a written "Plan of Action" which outlines the actions you will take to
correct the-violation(s) and a time frame for completion of those actions.
2. Submit a PE Certification of the stormwater system to this Office.
3. Repair the orifice pipe outlet structure to not bypass the vegetated filter, and
installed per the approved plan.
4. Submit maintenance records, past or present, to verify the depth of the forebays
and vegetation maintenance of the basins.
5. Perform all maintenance required by the Extended Wetland Maintenance
Requirement Agreement to include keeping all components of the extended
detention wetland system in good working order.
6. Per NC Session Law 2009-406, the expiration date of this permit is December
10, 2011. Permit condition requires submittal of a renewal package 6 months
prior to the expiration date which is June 10, 2011. Failure to submit the renewal
package by this date will result in violation of the permit.
Thank you for your immediate attention to this matter. This Office is considering an
enforcement action including the assessment of civil penalties regarding these violations
and any continuing violations that may be encountered. Your above -mentioned response to
this correspondence will be considered in this process. Please be advised, these
violations and any continuing or future violations are subject to a civil penalty
assessment of up to $25,000.00 per day for each violation pursuant to North Carolina
General Statute 143-215.6A.

In the event, as described in the response letter from you received by DWQ on July 24, 2010,
there is a desire for the facilities to change ownership, a formal permit request must be

Recently, this office conducted an internal review of the annual reports filed for all business corporations
in North Carolina. Unfortunately, the review indicates that the above referenced business corporation is
not in compliance with the North Carolina Business Corporation Act and is delinquent in delivering one
(1) annual report(s).
The Secretary of State is authorized by N.C.G.S. 55-14-21 to administratively dissolve a business
corporation if one or more grounds for dissolution exist. Please note that while the dissolution process has
not yet been concluded, this Notice is the first step of the dissolution process. In order to prevent

Dear Mr. Herbert:
Sea Trail conveyed to Waterway Landing, LLC, a tract of land on the
Intracoastal Waterway for the development of a condominium project on
September 29, 2004. It was our understanding at that time that the above
stormwater permit for the project was likewise transferred to Waterway Landing,
LLC. It has recently come to our attention that this permit is still in the name of
Sea Trail Corporation.
We have received Notice of Violation from the NC Department of
Environment and Natural Resources for failure to renew this stormwater permit
which expired on December 10, 2008. I am enclosing a copy of this Notice and
the Compliance Inspection Report for your immediate attention as NCDENR
requires a response within a specified time. Failure to comply with the terms of
this Notice can result in monetary civil penalties.
Enclosed herewith are the following documents that need to be completed
and filed with the NCDENR without delay:

This letter is to notify you that you are in violation of Title 15A North Carolina Administrative
Code (NCAC) 2H .1003 in accordance with North Carolina General Statute (G.S.) 143-214.7 for
failure to apply for and secure a renewal of Stormwater Management Permit SW8 980521,
which expired on December 10, 2008.
On June 29, 2009, David Cox of the Wilmington Regional Office performed an inspection to
determine the status of compliance with Stormwater Management Permit SW8 980521. Permit
Number SW8 980521 was issued to you on December 10, 1998 for the Sea Trail Waterway
Project, located at Indigo Circle, Sunset Beach, Brunswick County, North Carolina. On
December 10, 2008 this permit expired and it is a permit condition that it be renewed.
During the file review it was also determined that the required Engineers Certificate was never
submitted to this office.
As a result of the site inspection and DWQ file review, the following violations are noted:
I. Failure to Renew State Stormwater Permit
Title 15A NCAC 2H .1003 (h) (2) requires that applications for permit renewals to be submitted
180 days prior to the expiration of the permit. On August 4, 2008 an application for a permit
renewal was required to be submitted to DWQ. As of the date of this letter, DWQ has not
received an application to renew Stormwater Permit SW8 980521.
II. Failure to Apply For and _Secure a Stormwater Management Permit
Title 15A NCAC 2H .1003, in accordance with G.S. 143-214.7, requires a State Stormwater
Management Permit for development activities within the 20 coastal counties that require a
Coastal Area Management Act (CAMA) Major Permit or an Erosion and Sedimentation Control
Plan. The inspection and DWQ file review confirms that a valid, active State Stormwater

III. Failure to submit the Engineers Certification
Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications, and
other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.
Required Response
This Office requires that you respond to this letter in writing within 30 calendar days of
receipt of this Notice. Your response should be sent to this office at the letterhead
address. Your response should address the following items:
Submit the enclosed renewal application with new signed O&M agreement
and Designer's Certification along with the processing fee, currently set at
$505
2. Provide a written "Plan of Action" which outlines the actions you will take to
correct the violation(s) noted under the 'Comments' in the attached inspection
report and a time frame for completion of those actions.
Thank you for your immediate attention to this matter. This Office is considering an
enforcement action including the assessment of civil penalties regarding these violations
and any continuing violations that may be encountered. Your above -mentioned
response to this correspondence will be considered in this process. Please be advised,
these violations and any continuing or future violations are subject to a civil
penalty assessment of up to $25,000.00 per day for each violation pursuant to
North Carolina General Statute 143-215.6A.

The Division of Water Quality issued a Coastal Stormwater Management Permit, Number SW8980521
to Sea Trail Corporation for High Density Stormwater Project on December 10, 1998. This permit
expires on December 10, 2008. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater rules)
requires that applications for permit renewals shall be submitted 180 days prior to the expiration of a
permit and must be accompanied by a processing fee, which is currently set at $505.00. If this is still an
active project please complete and submit the enclosed renewal application in a timely manner. If this
project has not been constructed and a permit is no longer needed, please submit a request to have the
permit rescinded. If you have sold the project, or are no longer the permittee, please provide the name,
mailing address and phone number of the person or entity that is now responsible for this permit.
Enclosed is a form for change of ownership, which should be completed and submitted if the property
has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer
for the system installed. This is to certify that the permitted facility has been installed in accordance with
the permit, the approved plans, specifications and supporting documentation. Please include a copy of
the certification with your permit renewal request and processing fee. Enclosed is a copy of a sample
certification. Also enclosed is a new Operation and Maintenance agreement that should be completed
and submitted along with your renewal application.
You should be aware that failure to provide the Designer's Certification and the operation of a
stormwater treatment facility without a valid permit, are violations of NC General Statute 143-215.1 and

$10,000 per day.

On November 13, 2003, the Wilmington Regional Office received a copy of a Notice of
Receipt of an Erosion & Sedimentation Control Plan for the subject project. The North
Carolina Administrative Code requires any project that must receive either
Sedimentation and Erosion Control Plan approval and/or a CAMA Major permit to apply
for and receive a Stormwater Management Permit by the Division of Water Quality.
Any construction on the subject site, prior to receipt of the required permit, will constitute
a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement action by
this Office.
If this is a modification that will affect the stormwater permit, please submit a modified
Stormwater Permit Application Package including 2 sets of plans, completed
application form, fee, and supporting docun+entation, or a written response regarding
the status of this project and the expected submittal date must be received in this Office
no later than February 27, 2004. Failure to respond to this request may result in the
initiation of enforcement action, and construction may experience a subsequent delay.
The NPDES 010000 Federal Stormwater Permit that accompanies the .Erosion Control
Plan approval letter must NOT be considered the Coastal Stormwater Management
Permit, which will be signed by the Water Quality Supervisor. Please reference the

This office has received a soil erosion and sedimentation control plan for the project listed below which was
submitted as required by the North Carolina Sedimentation Pollution Control Act (NCGS 113A-57(4)).
Please be advised that this Act requires that all persons disturbing an area of one or more acres of land must
obtain approval of a soil erosion control plan prior to the commencement of said land -disturbing activity (NCGS 113A-
54(d)(4)). The Act further states that this plan must be filed a minimum of 30 days prior to the activity and the
approving authority must approve or disapprove the submitted plan within 30 days of receipt. Failure of the approving
authority to approve or disapprove the submitted plan within the 30 day period will be deemed approval of the plan
if the submitted plan is complete. Commencement or continuation of a land -disturbing activity under the jurisdiction
of this Act prior to the approval of an erosion & sediment control plan is a violation of the Act.
A copy of any erosion and sediment control plan which could involve the utilization of ditches for the purpose
of dewatering or lowering the water table is forwarded by this office to the Division of Water Quality (DWQ). It is
suggested that you contact the Division of Water Quality at [phone] if the ditches shown on your plan will
lower the .water table.
We have performed a preliminary review of your submitted plan and have determined that additional information
will be necessary before a final review can be completed. Enclosed is a checklist of items that must be submitted
before we can complete the review process. Failure to provide the additional information may result in disapproval
of your plan.
The approval of an erosion and sediment control plan is conditioned on the applicant's compliance with Federal
and State water quality laws, regulations and rules.
