Return of Authorization to Construct Application
Etowah Sewer Company WWTP (NC0071323), Henderson County
ATC Application Number: 071323A01
The Division of Water Resources is unable to accept the enclosed Authorization to Construct (ATC) application package for
review for the following reason(s), in accordance with 15A NCAC 02T .0107(b) and 15A NCAC 02H .0107(b):
1. The applicant (Central States Water Resources, Inc.) listed in the ATC application form (Form ATC-12-14) is not the
owner (Etowah Sewer Company) of the Etowah Sewer Company WWTP (NC0071323). Central States Water
Resources, Inc. is currently in the process of acquiring the facility, however, it was estimated that it would take
about three to four months before the acquisition can be completed. A request of NPDES permit modification for
the ownership change shall be submitted after the completion of the acquisition. The issued modified permit shall
be submitted as part of the ATC application before an ATC permit can be reviewed and issued.
Please note that the item(s) listed above must be included and/or completed prior to resubmitting the Authorization
to Construct application package for approval. Your application is being returned as incomplete in accordance with
15A NCAC 02T .0107(b) and 15A NCAC 02H .0107(b). The success of the Authorization to Construct approval process
depends upon the receipt of complete and accurate applications. Please make the appropriate corrections and
resubmit the application, and the review process will then begin upon receipt of the completed and/or corrected
application.
Please be advised that construction and/or operation of treatment works without a valid permit is a violation of North
Carolina General Statute 143-215.1 and may subject the Applicant to appropriate enforcement actions in accordance
with North Carolina General Statute 143-215.6. Civil penalties of up to $25,000 per day per violation may be assessed
for failure to secure a permit required by North Carolina General Statute 143-215.1.
