Dear Mr. Roden-Reynolds,
On behalf of Bluewater Civil Design, ECS Southeast, LLP (ECS) is submitting this Preconstruction
Notification for authorization under Nationwide Permit (NWP) 18 to construct a commercial
development at 853 North Green Street in Morganton, Burke County, North Carolina. The purpose
of the project is to develop a Quick Serve Restaurant with associated parking areas and access
drives along North Green Street. This particular site was selected because it is a well-located
property along an existing arterial road with a high market value for restaurants.
Background
The subject property is identified by the Burke County Geographic Information System (GIS) as
Parcel Identification Number (PIN) 1793592009 and is owned by Morganton Outparcel Fee
Owner, LLC. The subject property is approximately 8.82 acres in size and currently consists of
undeveloped wooded land.
ECS was provided with a Preliminary Jurisdictional Determination (JD) letter from Mr. William
Elliott, with the U.S. Army Corps of Engineers (USACE) dated June 14, 2017. The letter states
that there appear to be waters, including wetlands on the above described project area/property,
that may be subject to Section 404 of the Clean Water Act (CWA)(33 USC § 1344) and/or Section
10 of the Rivers and Harbors Act (RHA) (33 USC § 403). The waters, including wetlands have
been delineated, and the delineation has been verified by the Corps to be sufficiently accurate
and reliable. A copy of the attached PJD letter is included as an attachment.
Site Reconnaissance
ECS personnel conducted the field investigation on November 12, 2019. During the
reconnaissance, ECS observed the PSA for evidence of WOUS, including ponds, streams, and
wetlands. Based on the findings during the field visit, ECS observed 0.995 acres of wetlands and
970 linear feet of stream on site.
Impacts and Mitigation
Based on the current site layout, the proposedimpacts include 81.6LF ofpermanent impact to
jurisdictional streamsand 0.07acre of permanent impact to jurisdictional wetlands.Due to the
proposed impacts not exceeding 0.10 acrefor wetlands and 0.02 acre for stream, no mitigation
is proposed for this project.
Conclusion
On behalf of Bluewater Civil Design, ECS respectfully requests the use of NWP 18to authorize
the permanent fill impacts of 85.5LF of jurisdictional streamand 0.07acres of jurisdictional
wetlands. The attached permit application and associated attachments provide details pertaining
to the proposed project impacts.
