Atlas Environmental Inc is submitting the enclosed package on behalf of Crow Holdings, Mr.
Matt Cochrane for approval of a Nationwide Permit 39 verification for unavoidable impacts to
Waters of the United States. Atlas Environmental completed a Waters delineation on August
26, 2021 and September 8, 2021. There are five streams totaling 2,706 linear feet and six
wetlands totaling 0.058 acre. CH 100 is a perennial stream (259 linear feet, 0.016 acre), CH
200 is intermittent (260 linear feet, 0.017 acre), CH 300 is intermittent for a short distance in
the upper reach before transitioning to perennial (1,614 linear feet, 0.159 acre), and CH 400 is
perennial (195 linear feet, 0.010 acre). Forney Creek is a named perennial stream that partially
runs into the review are in the Western parcel (378 linear feet, 0.103 acre). WL 1000 (0.007
acre) is hydrologically connected to a stream that flows outside of the review area to the South.
WL 2000 (0.032 acre) abuts CH 200 to the North and CH 100 to the South. WL 2100 (0.002
acre) abuts CH 200 as it flows into the stream. WL 3000 (0.008 acre) abuts CH 300 towards
the lower reach of the stream. WL 4000 (0.007 acre) abuts CH 400 as it flows into the stream.
The enclosed permit application request is for impact S1 184 linear feet (0.0195 acre) of
perennial stream impact to facilitate construction of a road crossing to access other industrial
warehouse buildings, truck courts, employee parking for building three. The rip rap apron at
the outlet of the culvert will be embedded into the stream bed and is not considered an impact.
Impact S2 is for 20 linear feet of temporary impact at the inlet of the culvert to allow for a
pump around during construction. This temporary disturbance will include installation of a
coffer dam and temporary by-pass of flow. The coffer dam will be removed after culvert
installation is complete. The one permanent stream impact is defined as impact S1 which is
located on the perennial stream CH 300 above WL 3000. Impact S2 is necessary for temporary
impacts during construction.
All tributaries within the review area drain to Forney Creek which is Classifed as Class C. The
Corps approved the delineation and issued a preliminary jurisdictional determination on
December 9, 2021. A copy of the Jurisdictional Determination is included in this package.

2,706 linear feet of stream has been avoided which is over 93% of the streams. No wetland
impacts are proposed so all wetlands were avoided. The fill slopes at the one road crossing are
the steepest allowed for local approval. These slopes will be reinforced to remain stable.
Headwalls will be used at the end of the culvert.
Atlas is coordinating with Fish and Wildlife Service regarding Section 7 consultation. Suitable
habitat exists on site for Rhus michauxii, Hexastylis naniflora, and Helianthus schweinitzii. No
species were observed on site for Rhus michauxii or Hexastylis naniflora, however occurrences
of a similar species to Hexastylis naniflora were observed (Hexastylis arifolia). During the field
observations on August 26, 2021 and September 8, 2021, Atlas Environmental staff identified
six populations of Helianthus schweinitzii (Schweinitz's sunflower). Two plants will need to be
relocated to one of the other populations along the gas line right of way to avoid impacts at the
end of the state -maintained road. Known populations have been photographed and mapped
using a professional grade GPS. Enclosed is a copy of the Biological Opinion that has been
submitted to Rebekah Reid in the FWS Asheville office.
Enclosed is a copy of the NC Historic Preservation Office (HPO) Section 106 comment letter.
TRC was contracted to conduct a detailed survey within the Corps project area. Enclosed is a
copy of TRC's report that has been submitted to the SHPO office.

I, the current landowner, lessee, contract holder to purchase, right to purchase holder, or easement
holder of the property/properties identified below, hereby authorize Atlas Environmental Inc to act on my
behalf as my agent during the processing of permits to impact Wetlands and Waters of the US that are
regulated by the Clean Water Act and the Rivers and Harbors Act. Federal and State agents are
authorized to be on said property when accompanied by Atlas Environmental Inc staff for the purpose of

1. The Corps of Engineers believes that there may be jurisdictional aquatic resources in the

permit, and the permit applicant has not requested an AJD for the activity, the permit
applicant is hereby made aware that: (1) the permit applicant has elected to seek a permit
authorization based on a PJD, which does not make an official determination of
jurisdictional aquatic resources; (2) the applicant has the option to request an AJD before
accepting the terms and conditions of the permit authorization, and that basing a permit
authorization on an AJD could possibly result in less compensatory mitigation being
required or different special conditions; (3) the applicant has the right to request an
individual permit rather than accepting the terms and conditions of the NWP or other
general permit authorization; (4) the applicant can accept a permit authorization and
thereby agree to comply with all the terms and conditions of that permit, including
whatever mitigation requirements the Corps has determined to be necessary; (5)
undertaking any activity in reliance upon the subjectpermit authorization without
requesting an AJD constitutes the applicant's acceptance of the use of the PJD; (6)
accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking
any activity in reliance on any form of Corps permit authorization based on a PJD
constitutes agreement that all aquatic resources in the review area affected in any way by
that activity will be treated as jurisdictional, and waives any challenge to such jurisdiction
in any administrative orjudicial compliance or enforcement action, or in any administrative
appeal or in any Federal court; and (7) whether the applicant elects to use either an AJD or
a PJD, the JD will be processed as soon as practicable. Further, an AJD, a proffered
individual permit (and all terms and conditions contained therein), or individual permit
denial can be administratively appealed pursuant to 33 C.F.R. Part 331. If, during an
administrative appeal, it becomes appropriate to make an official determination whether
geographic jurisdiction exists over aquatic resources in the review area, or to provide an
official delineation of jurisdictional aquatic resources in the review area, the Corps will
provide an AJD to accomplish that result, as soon as is practicable. This PJD finds that
there "maybe"waters of the U.S. and/or that there "maybe" navigable waters of the U.S.
on the subject review area, and identifies all aquatic features in the review area that could
be affected by the proposed activity, based on the following information:
