Dear Mr. Keeny and Mr. Bailey:
The Division of Energy, Mineral and Land Resources (DEMLR), received a Stormwater
Management Authorization to Construct (ATC) Permit Application for the subject project on
November 18, 2021. A review of that information has determined that the application is not
complete. The following information is needed to continue the stormwater review:
Per our earlier phone conversation, the plan for this project is to transfer ownership of the
property from the current Property Owner to the Developer/Applicant (the current
Property Owner does not wish to sign the Property Owner's authorization portion of the
Application) and then issue the permit to the new Property Owner (the
Developer/Applicant). Addressing the following comments will get this submission into a
"ready to issue" state and the permit will be able to be issued once we receive proof of
the change in property ownership.
2. Part C2 — Please indicate the applicable stormwater post -construction program for this
project. It appears as though the majority of this site is subject to the Phase 2 rules,
however, there appears to be a small portion of the property (the northeastern corner of
the property near lot 1) that is located within a water supply watershed. Please reach out
to Harnett County to see if they will need to also review the post -construction stormwater
for this project (In situations like this where the majority of the site is located within the
North Carolina Department of Environmental Quality I Division of Energy, Mineral and Land Resources

State's jurisdiction, a portion of the site is located within a local jurisdiction, and the rules
are fairly similar between the two jurisdictions, the local jurisdiction may be OK with just
the State performing the review, but they may also require that they do a concurrent
review, you need to verify with them). Please provide Harnett County's response to this
inquiry with the resubmission.
3. Part D3 — Please change the Applicant from the Developer to the Property Owner (in
anticipation of the property transfer from the current Property Owner to the Applicant).
4. Part D4 — In anticipation of the property transfer from the current Property Owner to the
Applicant, the Property Owner information is not needed.
5. Part E5 — Based on the provided USGS topographic map, the on -site surface water area
shown in this part of the Application appears to be less than what is actually on -site. The
area between the banks of any blue line rivers/streams (whether they are permanent or
ephemeral) and the normal pool surface area of any lakes/ponds that show up on the
USGS topographic map are considered as on -site surface waters. Please revise as needed.
6. Part F3 — Please show the extents of the project area on the provided USGS topo maps.
7. Part F4 — Please clearly show the required vegetated setbacks/buffers from the on -site
surface waters on the site plan. Vegetated setback requirements can be found in 15A
NCAC 02H .1003(4) and .1017(10). NOTE: The ATC review is mostly an
administrative review, we do not require full plan sets at this point in the review process.
8. Part F6 — Please update this information once the property transfer has been finalized.
9. Part F9 — In anticipation of the property transfer from the current Property Owner to the
Applicant, the Property Owner agreement information is not needed.
10. Provide pdfs of all revisions, 2 hardcopies of revised plan sheets, 1 hardcopy of other
documents, and a response to comments letter briefly describing how the comments have
been addressed.

Please note that this request for additional information is in response to a preliminary review.
The requested information should be received by this Office prior to January 5, 2022, or
the application will be returned as incomplete. The return of a project will necessitate
resubmittal of all required items, including the application fee. Please reference the State
assigned project number SWA000119 on all correspondence.
If you need additional time to submit the information, please submit your request for a time
extension to the Division at the contact below. The request must indicate the date by which you
expect to submit the required information. The Division is allowed 90 days from the receipt of
a completed application to issue the permit.
The construction of any impervious surfaces, other than a construction entrance under an
approved Sedimentation Erosion Control Plan, is a violation of NCGS 143-215.1 and is subject
to enforcement action pursuant to NCGS 143-215.6A.
