I'm writing you regarding 150 Travis Pointe Dr. (Copy of the notice included as an attachment to this email)
Thank you for speaking with me Monday morning, I'm including photos as promised during our conversation.
We believed that the paver pathways we had incorporated to traverse the yard were quite permeable --- They
allow for normal absorption and runoff in the lakeside area. Heck we were adamant that ALL the paths on the
property were permeable, regardless of whether they were in the buffer zone or not. NO CONCRETE was used
in the installation of the cobblestone-like paths, they are sand-set with a bed of fine gravel to ensure a porous
material from ALL directions.
I have also attached photos of the structures noted in the aerial photos. The "lounge" (structure 1)was in
existence when we purchased the property, although it was thoroughly renovated. The "Kayak Rack"
(structure/roof 2) was intended to provide both convenience & aesthetically-pleasing appearance rather than the
chaos of all those vessels strewn around the water's edge.
What looks like a "natural area" (your words) on your aerial/Google Earth photos is the canopy of a stand of
ancient poplar trees that died of natural causes. (much to our disappointment -- we remain heartbroken) Their
absence is by neither desire or design, My wife's uncle planted them 50+ years ago and we still mourn their
passing! This property was originally built on by my wife's uncle's family, it was sold to a third party in the
1980's, and was brought back INTO the family in 2016.
Per your suggestion, we will take measures to add more natural landscaping, we're working on a design to
enhance the appearance of our property. As promised, I am TRYING to attach photos &video to assist you
with your assessment.

On October 26, 2021, an application was submitted for review regarding shoreline
stabilization at the subject site. During the review process it was observed by staff that impacts
had occurred in the Catawba Riparian Buffer without approval. Impervious area and structures in
the buffer requires approval from the Division of Water Resources. The impacts observed within
Zone 1 (30 ft. landward from full pond elevation) of the Catawba Riparian Buffer per 15A NCAC
02B .0614. are not allowed. Based on the observations at the site, this correspondence is being
issued as a Notice of Violation for the unauthorized impacts to the buffer and shoreline.
Required Corrective Action:
1) The impervious material and structures must be removed from Zone 1 and the area
restored to the pre-existing condition. Please see photo(s) below.
2) The requested shoreline stabilization application will be placed on hold, until this
issued is resolved.
3) It is anticipated that this matter can be resolved and the shoreline approval issued by
December 30, 2021.
If you have an explanation or any information/documentation related to the noted violation
that you wish to present,please respond in writing within fifteen(15)days of receipt of this Notice.
Your response should address a time line and a plan of action to achieve compliance. Please note
that pursuant to G.S. 143-215.6A these violations and any future violations are subject to civil

penalty assessments of up to S25,000.00 per day for each violation. Failure to comply by the stated
date may bring further enforcement actions.
