Jeremy,
I was looking over the additional information you provided on February 14, 2022. Everything looks good except for a few
small issues:
Please correct the following:
- Prior Comment 5 – In addressing this comment, the percent BUA for the site has exceeded 24% BUA (2,214,904
sf / 9,177,054 sf = 24.1%). Please either reduce the proposed BUA to stay below the low-density percent BUA or
reconfigure the project to be a high-density project. Please revise the Application as needed.
- Please provide 2x original, signed, hard copies of the Application Form (only photocopied versions of the revised
Application were provided in the latest submission, we require the originals per 15A NCAC 02H .1043(3)).
Please provide the following:
- 2x original, signed, hard copies and 1x electronic copy of the revised Application Form.
- 1x (2x for plans) hard copy and 1x electronic copy of any other updated items needed to address these
comments.

NOTE: Hard copies should not be sent to a Regional Office. Doing so will delay the review process and the
submission package may be lost while being sent from the Regional Office to me in the Central Office.
Electronic copies should be uploaded at the following location:
https://edocs.deq.nc.gov/Forms/SW-Supplemental-Upload
Since these are really minor things, once I get the hard copies, anything else that may have changed from addressing
these issues, and the documents are uploaded to Laserfiche (Provided everything is still in order), we can issue the
permit without doing another formal 30 day review.

I was looking over the additional information you provided on February 2, 2022. Everything looks good except for a few
small issues:
Please correct the following:
- Prior Comment 1 – The provided property deed indicates that the property was transferred to Duncan’s Creek
Developers, LLC and the Applicant (Property Owner) is listed on the Application as R & R Development Group of
NC, LLC. Please revise and/or clarify. Please also provide Secretary of State information for Duncan’s Creek
Developers, LLC showing that they are in good standing and able to conduct business in NC if they will become
the Applicant.
- Prior Comment 2 – Please check off the box in Part C2 of the Application to indicate the post-construction
program that this project is subject to (Phase-II).

- Prior Comment 5 – The Application indicates that the property area is 9,291,193 sf and contains 114,139 sf of
on-site surface water. Per the instructions under the total project area section, the total project area excludes
the on-site surface water area (9,291,193 sf – 114,139 sf = 9,177054 sf ≠ 9,281,211). Please revise the values in
this table (including the proposed new BUA and project density) or provide a justification for the project area
value used.
- Please provide 2x original, signed, hard copies of the Application Form (only a single photocopied version of the
revised Application was provided).
Please provide the following:
- 2x original, signed, hard copies and 1x electronic copy of the revised Application Form.
- 1x hard copy and 1x electronic copy of the Secretary of State information for Duncan’s Creek Developers, LLC (if
applicable).

Thank you for the clarifications. We will get these addressed and returned to you ASAP. One question I had in regards
to right to submit and property owners authorization. We have the attached Owner’s Consent Form that has been
signed/notarized. Will this satisfy your comments for items 1/2 of your comments? The property owner agreed to give

us the owners consent as attached, but has been difficult to get additional applications signed. We feel this covers the
authority to submit/construct on his behalf. Can you take a look and let me know your thoughts?
