Project Setting
The subject property is located at 23508 Hwy 264 East, Pantego, NC 27860 adjacent to
Broad Creek in an area where the creek has been channelized as part of the Beaufort County
drainage district. The property consists of developed and undeveloped uplands as well as 404-
wetlands in areas near the shoreline; no official delineation has been completed. Existing upland
development includes a single family residence and man-made ponds. A previous CAMA Major
Permit #64-16 was issued in June of 2016 authorizing 1,250ft2 of 404-wetland fill to create
access to a portion of high ground disconnected from the main body of the property and upland
excavation to create a partial basin to construct a boathouse adjacent to Broad Creek. The only
development completed from that Major Permit was the wetland fill created access to the upland
area adjacent top Broad Creek. This Major Permit has since expired.
Broad Creek in the project location is designated is classified as SC, NSW by the
Environmental Resources Commission and is subject to the DWR Tar/Pam buffer rules. Broad
Creek is designated as an inland waterbody by the Wildlife Resources Commission. No coastal
wetland or submerged aquatic vegetation was observed in the vicinity of the project.
Project Description
The applicant has submitted a new proposal for a boat ramp, pier with boathouse, and
maintenance excavation in Broad Creek in the area immediately downstream of the previously
permitted boathouse and excavation. This given reason for the change in proposal is to better
accommodate ADA access and to move the boat house out of the main Flow of Broad Creek.
The proposal includes maintenance excavation in an area just adjacent to the main
channel of Broad Creek measuring 52' x 32'(avg) to a final depth of -4ft at NWL removing an
average of 2' of material within the dredge footprint. The spoil from excavation will be placed at
an approved upland area measuring 80' x 80' on the property outside of the CAMA AEC. A 32'
long x 12' wide boat ramp that would require the filling of 300ft2 of 404-wetlands adjacent to
Broad Creek for construction; the terminal end of the proposed ramp will be within the
maintenance excavation footprint. Within the maintenance excavation footprint a boathouse
measuring 25'6" wide x 39'6" is proposed that will be connected to land with a 6' x 70' pier.
The boathouse will house a lift for a 26' boat and a 5' walkway around 3-sides of the lift to
provide wheelchair access. The applicant also has proposed 58' of bulkhead located at NWL
along a peninsula of land that is adjacent to the proposed boathouse.
Anticipated Impacts
The project as proposed will result in the maintenance excavation of approximately
1,664ft2 of Broad Creek shallow bottom, the filling of 300ft2 of 404-wetlands, hardening of 58'
of shoreline, and shading of 1,427ft2 of shallow bottom that will be Iargely within the
maintenance excavation footprint. Short-term noise and turbidity are expected during
construction.

Dear Sirs,
We have decided not to renew our expired Major CAMA permit number 64-16, issued on June
27, 2016 for the excavation of the canal bank and construction of a boathouse. Based on our
observations over the last few years we have lived here, we have come to realize that having
the boathouse in the canal would lead to several problems. First, the current from the canal is
very strong, not only in hurricanes, but after heavy rains too. It drains a large area up through
Terra Ceia. Unfortunately, there is a lot of debris just from the litter that gets into the canal.
The debris, coupled with the force of the current will lead to problems and damage to the
boathouse structure. Then there is also the issue that the bank is not stable and therefore
many trees have fallen in after storms and hurricanes. These trees are not accessible for us to
personally clear, and that puts us at the mercy of the drainage district sending cleanup crews to
keep the waterway open. The land that borders the canal gets extremely slick from the mud
that the occasional flooding leaves. This is difficult for anyone to walk on, but my wife has
disabilities and it is unsafe for her. The canal also receives a lot of erosion due to the strong
flow that goes through it. We are concerned that the boathouse in this location would catch a
lot of debris and also the erosion would cause the pilings to undermine. All these issues along
with problems encountered due to my wife's handicap in reaching the original location of the
proposed boathouse made us redesign the location of the proposed boathouse.
We are submitting a permit application to put a boathouse and a ramp in an existing man-made
basin area off the canal. We feel this is a perfect area for this project since it is out of the main
flow of the canal. Some trees will have to be cut and stumps ground to facilitate the
maintenance and cleaning of the silt in this basin. Any leaning trees that pose a hazard to
vessels or structures will be removed. Maintenance excavation in the canal would be
undertaken by an excavator operating from the existing spoil bank and adjacent uplands
placing the material in a small dump truck or dump trailer. A 32' x 52' area will be impacted
during the maintenance excavation removing an average of 2' of material for a maximum final
depth of minus 4' below the normal water level and resulting in 130 cubic yards of spoil
material. Installation of the boat ramp will impact 300 square feet of 404 wetlands. Wetla

The reason we would like to have a ramp is for convenience of launching on our own property.
The nearest boat ramp is a 5 mile trip by boat. Due to my wife's disabilities I often launch our
boat single handed from the public ramp in Belhaven and make the trip to our property. From
there, my wife drives me back to Belhaven to retrieve the truck and trailer. There have been
times when storms put trees across the canal trapping our boat at our property until the
drainage district cleared and snagged the canal. If we had a boat ramp we could retrieve our
boat from the canal until the canal is cleared. We also would use the ramp to be able to launch
some smaller boats from our property. We are also applying for a pier 6' wide, and 70' long.
This would be constructed using handicap concrete slats. This would also be a good location to
run power cable and water lines to the boathouse. This pier would serve both as a launch pier
for the boat ramp as well as provide access to the 256" x 39' 6" boathouse. A 5' wide catwalk
will encircle the boathouse on three sides. 58' of vinyl bulkhead will be installed to prevent
erosion next to the boathouse. Included in the 58' of vinyl bulkhead will be 16' of bulkhead up
the side of the canal bank with a 5' return into the bank.
As mentioned above, my wife has many spinal issues. She has had 8 spinal surgeries and
anticipates more. With this project, we are looking forward, and would like to make sure that
everything makes this usable for a person in a wheelchair. The new project design/location has
more direct pedestrian access from our home across gently sloped uplands down to the existing
basin.
Per the latest guidance from the Division of Water Resources, I have submitted the electronic
meeting request of 2021 for the boat ramp and maintenance excavation in regards to obtaining
the 401 Water Quality Certification and have included the email documentation in this
application package. I certify that all information contained in this application package is true,
accurate, and complete to the best of my knowledge and belief. I hereby request that the
certifying authority review and take action on this CWA 401 certification request within the
applicable reasonable period time.

Propose to undertake maintenance excavation in a man made basin
off the channelized portion Pantego Creek, just below HWY 264 near
the Town of Pantego in Beaufort County, North Carolina. The
purpose of the excavation work is to improve depths in the basin to
support a proposed boathouse and a small boat ramp) Once the 30
day pre -filing period has expired I will submit the required Major
CAMA permit application.
This property was subject of Major LAMA permit no. 64-16 that
included the proposed boathouse. The boathouse was never built.
This proposal will relocate the boathouse out of the flow in the
channelized stream into an existing man made basin. The former
DWR Project number was 16-0471 issued May 27,2016.
