Skvarla, III Secretary DWR Project #: 2013 -0436 Edgecombe County Re: Tar - Pamlico Umbrella Mitigation Banking Instrument (UMBI) Evans Ballahack Bank Credit Release — Tasks 3, 4 Dear Mr. Ham: On August 20, 2014, the Division of Water Resources (DWR), received an As -Built Report for the Evans Ballahack Bank Parcel submitted by Greene Environmental Services, LLC (GES) for review and approval. On September 9, 2013, Katie Merritt, with DWR, requested additional information. On December 30, 2013 & March 28, 2014 DWR received adequate information in response to Ms. Merritt's request. On March 11, 2014, GES submitted a Performance Bond (# 22BSBGR5723) to cover the monitoring and maintenance required for the subject bank. The term of the bond will apply from October 31, 2013 to October 31, 2014. Therefore, GES is required to renew the performance bond prior to October 31, 2014, and is required to renew the bond annually for at least 4 more years. Future credit releases will be dependent on both the renewal of this performance bond and the annual monitoring reports. According to the UMBI signed on May 1, 2013, the following Project Milestones have been met, and the corresponding credits shall be released: Task/Milestones Credit 3) Monitoring Financial Assurance Posted & Approval of As -Built Report 10% 4) Approval of Monitoring Report # 1 (Year 1) 10% TOTAL: 20% 401 and Buffer Permitting Unit 1650 Mail Service Center, Raleigh, North Carolina 27699 -1650 Location: 512 N. Additionally, 20% of your nitrogen nutrient offset credits (0.20 x 10,342.24 lb -N = 2,068.45 lb -N) and 20% of your phosphorous nutrient offset credits (0.20 x 666.12 lb -P = 133.22 lb -P) are now available for sale. Please update your credit ledgers accordingly. Please note that nutrient offset credits generated at this site must be used for development impacts in HUC 03020103 of the Tar - Pamlico River Basin. Additionally, the riparian buffer credits must be used for impacts in the Tar - Pamlico River Basin according to guidelines in 15A NCAC 02B.0260.
