Avoidance and Minimization

Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
The project is proposing three wetland area impacts, two of which will be permanent and one temporary In
addition, there are two offsite buffer impact areas Impact 1A and1B are proposed permanent impacts necessary
forThll 1A is a fill slope necessary for a multi- purpose field, 1B is fill associated with a BMP, its slopes and outlet
protection We are requesting the use of `a NWP 18 for impact 1B The site 'Is limited with `area'; all acreage is
being utilized for necessay its, attendant features, buildings, roads and required parking ,Impacts 2 -5 are all offsite
impact areas Impact 2 is proposed permanent impact necessary for an outlet dissipater An existing 24" RCP ►s
being,removed and replaced with a 48" RCP, this pipe and dissipater will be receiving treated drainage from the
site Impacts 3 & 4 are proposed1emporary impacts to Zone 2 buffer necessary for bore pits Wetlands and
streams within this area have been avoided by utilizing the jack & ,bore method In addition, npanan•buffers,have
been avoided for the entire length of the,proposed sewer easement from Chfford Road and up to the western -most
bore pit Impacts 5A and 5B are proposed temporary impacts for the offsite sanitary sewer, this section connects
the school'site to the sanitary sewer easement on the east side of Clifford Road Impact 5A is within the permanent
maintenance corridor,for the sanitary'sewer, Impact 1B is only necessary for construction (outside,of the permanent
maintenance corridor) Both areas will be brought back to original contours and allowed to re- vegetate, area 1B will
not be cleared and maintained, therefore wooded vegetation will re- establish Impact 6A and 6B are proposed
impacts, necessary for offsite road improvements (i a intersection of Hebron Church Road and White Oak Road)
Stream impacts have been avoided in this area Impact 6A is Zone 2 fill required for a new permanent slope off the
road, impact 6B is required for'temporary erosion control Both areas will be allowed to re- vegetate post
construction A small area within 6A will include a permanent drainage easement with an outlet and outlet
protection In discussing with DWR, this buffer impacts would be considered a `perpendicular buffer)impact" that
essentially avoided stream impact, no buffer mitigation is required
The applicant is aware of the regional conditions associated with Nationwide Permits 18 & 39 With respect to
institutional development conditions'(NWP 39- Regional Conditions section 4 0) there are no permanent wetland or
stream fills proposed within the floodway/floodplain and the stream classification for this project is C, NSW (I a not
Outstanding Resource Waters, High Quality Waters, Coastal Wetlands or wetland adjacent to these waters) In
addition, no stream impacts are necessary therefore rip -rap stabilization ►snot needed
With respect to minor discharge conditions (NWP 18- Regional Conditions section 4 0) this NWP °is not being used
in conjunction with a.NWP 14

As per the project engineer the site stormwater management analysis splits the site into five separate drainage
areas The majority of the site, identified as, Area A, discharges run -off to the east through a 24 -►n culvert under
Hebron Church road The four smaller drainage areas discharge to the South, `West, and North Identified as Areas
B, C, D and E Best Management Practices (BMP) control the runoff from these five areas to detain the post
development rates for the 1 -year, 10 -year and 25 -year 24 hour design storm to pre- development rates as well as

We have reviewed the "Draft Internal Policy, Cumulative impacts and the 401 Water Quality Certification and
Isolated Wetlands Programs" document prepared by the NC Division of Water Quality on April 10, 2004, version
2 1 The draft states that, pubhcally funded developments may or may not result in cumulative impacts For
instance, the development of a regional, public park or new library is unlikely to result in cumulative impacts The
South Garner High School (H -8) project will be an institutional development Additionally, this project is located
within Town of Garner's jurisdiction, therefore the adjacent properties that have potential for development will have
the following regulations to protect downstream waters 1) Phase,ll NPDES Stormwater Permit Program; this

INTRODUCTION
An abandoned cemetery was discovered during preliminary development planning on the
Henry Buffaloe Tract, Wake County, North Carolina (Figure 1), The tract is north of
New Bethel Church Road, SR 2703, and 450 feet west of its intersection with Hebron
Church Road, SR.2704 The property is fiurther described in Wake County deed book
8302 page 2546 For purposes of identification and convenience ihe,cemetery will be
referred to as the_Buffaloe Tract Cemetery The cemetery had been discovered during
access clearing for geotechnical tests and had been partially damaged Since it was clear
that the planned development would affect the cemetery, the landowners and the
developer contacted Of Grave Concerns, Inc to record the cemetery and ,prepare
alternative treatment plans
Of Grave Concerns is a small archaeological consulting firm specializing in recording
and developing preservation plans for cemeteries The company was formally established
in 1999 John W Clauser Jr., the principal, has a BA in anthropology from Syracuse
University, an MA in anthropology from the University of Florida; Gainesville and
considerable experience; thirty- fiveyears as an historic archaeologist and twenty years
specializing in the treatment of historic cemeteries He worked for the North Carolina
Office of State Archaeology for more than twenty -seven years, performing numerous
duties including environmental review, historic sites archaeology and participated in the
inception.of the North Carolina Cemetery Survey Over two hundred cemeteries have
been located and recorded for a wide range ^of individuals and agencies including private
citizens, four sheriffs departments, county school boards and private developers, Mr.
Clauser has served,as an expert witness for cemetery cases, in an eminent domain case
once and been directly involved with a number of cemetery moves
The scope of the current project involves research in preparation fovtreatment of'a small
family cemetery within a planned development Services provided include field
investigation to locate marked and unmarked graves, determine the bounds of the
cemetery; temporarily mark the located graves with pin flags, map graves, establish
corners of the cemetery, perform background research, perform a reasonable and prudent
search for next of kin including legal advertisement as, mandated 'in North Carolina
General' Statute 65=4, and act as a representative at all public meetings and local
government procedures

FIELD METHODS
Standard historic archaeological ,research methods were used to investigate the cemetery,
Site files at the North Carolina Office of State Archaeology and the Cemetery Survey
located in the State of North Carolina Archives were checked to determine whether the
cemetery had been previously recorded'. Period city directories were inspected There was
no record of the cemetery in that location The USGS Garner Quadrangle Map and
historic maps of the area were studied for indications of a cemetery in the area Therefore
appropriate forms were completed and submitted to the North Carolina Office of State
Archaeology
An archaeological survey with limited subsurface testing was conducted to determine the
area covered by the cemetery and locate,as many graves as possible While the field
methods utilized do not guarantee locating all the graves present, they represent a
reasonable and prudent effort and meet present professional standards for cemetery
surveys. The only method 100% successful is complete excavation, which is not
necessary at this time
The cemetery,area was visually inspected for surface indications of burials. head and,foot,
markers, visible depressiowin the soil' and grave mounds for example Located graves
were marked at the head and, foot by pin flags. Grave locations were mapped to scale and
the resulting map was inspected to determine a pattern Blank spaces in the pattern were
then re- inspected and probed using a 5/8 inch steel probe to locate a grave pit. If a grave
was located in this manner, it was marked with pin flags and added to the map (Figure 2)
Only burials that were positively identified were mapped It is probable that more graves
exist than were found since the cemetery was previously disturbed by an access road It is
suggested that there may be as many as 16 graves within the cemetery area. The
perimeter of the cemetery was probed ten feet beyond the last graves located to assure
that the bounds were established and that all graves were located If there was any
question about the presence of a burial, the location was recorded as a possible burial_
Again, excavation is the only method to definitively determine a questionable burial
location Nine graves, two marked and nine unmarked were located and mapped in a 600
square foot area ?

SIGNIFICANCE EVALUATION
The historic significance of the cemetery was next considered Criteria for the
consideration of inclusion of properties in the National Register of Historic Places, and
previously published researchyby the author were used to determine significance. The
Buffaloe Tract Cemetery is a variation of the Southern Folk Cemetery as described in
Clauser 1994, It is a small extended family cemetery placed close to a home site and used
for a brief period The size of the cemetery twenty graves is not unusual. The cemetery is
while not unique is a superior example of the cemetery type
There are'four general significance criteria used to, determine eligibility for inclusion in
the National. Register of Historic Places Properties may be considered for inclusion if
they are
A) associated with events that have made a significant
contribution to the broad patterns of our °history,
B) associated with the lives of persons significant in our past,
C) embody the distinctive characteristics of a type, period or
method of'construction, or that represent the work of a
master, or that posses high artistic values, or that represent
a significant,and distinguishable entity whose components
lack individual distinction,
D) or, have yielded or may be likely to yield information
important to history or prehistory
Cemeteries and gravesites are-ndt generally considered for inclusion in the
National-Register "The primary reason for this restriction is that objective
evaluation of cemeteries is easily affected by personal sentiments with which
descendents of the,interred view graves and cemeteries" (Claudia Brown,
Supervisor Survey and Planning Branch, North Carolina Department of
Cultural Resources- 1994)
The cemetery is not eligible for inclusion in the National Register under Criteria A as it is
not associated with events that have made a significant contribution to the broad patterns
of our history There is no suggestion that it is associated with the lives of persons
significant in our past, therefore, Criteria B does not,apply. It does not represent the work,
of a master or posses high artistic values, but it does embody the distinctive
characteristics of a type,1 e. the Southern Folk Cemetery This embodiment, however
does not reach the level necessary for inclusion in theNational, register of Historic Places

Buffaloe Tract Cemetery,is an example of the Southern Folk Cemetery
Preservation'in place might provide an example of a rapidly vanishing type of
historic site, but there are, far better examples of the type within the county,
The cemetery has been damaged to the extent that there is no historic
significance
The decision to move a cemetery is not taken lightly, but is approached with a great deal
of caution There is a natural reluctance to disturb burial places, no matter what, the
reason. Several development options involving the cemetery were considered The first
option was preservation in place This had the advantage of no moving cost and the
preservation of an historic feature in situ There were several reasons this option is not
recommended, The landowner would not have full and complete use�of the property. The
cemetery has already fallerfinto disrepair and was already damaged. There is the °problem
of maintenance and security Unfortunately, cemeteries are very susceptible to vandalism
and there are no public funds available for preservation There is no legal requirement for
the, andowner to make repairs, or even maintain the cemetery.. The cultural landscape is
changing from a predominately rural nature to an intensely developed one, Planned
structure locations and overall design considerations argued against the option Full and
complete use of the property would be eliminated Cemeteries attract vandals, presenting
'the problem of,maintenance and security
The second option was moving the cemetery to another area of the property Security and
maintenance and' all'the,other issues involved in the first option still come into play
Another problem would' be the added expense of moving the graves without recouping
full use of the property There would be no guarantee of continued care for the graves.
The cemetery would have been removed from its context without full benefit to the
owner.
The final option to be considered was moving the cemetery off site. The burials will be
moved to an off site cemetery underthe provisions of North Carolina General statute 65 -

issues and places the graves in an area that will not rapidly deteriorate.into an overgrown
and forgotten group of burials, as it provides- perpetual care
In summary, the historic significance of the cemetery has,been considered the desirability
of perpetual care and the needs of the landowner Several options for treating the
cemetery have been evaluated preservation in place, moving to another area of the
property and moving off site to an established cemetery It is our recommendation, that
the Buffaloe Tract Cemetery be moved to a new off -site location
