Culvert UesiSn Details 1 1 1 1 2 2 3 3 4 4 5 5 5 5 6 6 6 6 7 7 8 8 8 .9 9 Proposed Two Eleven Midway Commercial Center Brunswick County, North Carolina 13 August 2007 This supporting documentation is being provided to supply more detailed information for the accompanying Department of the Army Permit Application, specifically Blocks 18, 19, 20, and 22. 1.0 Project Information 1.1 Project Description The proposed Two Eleven Midway Commercial Center (Project Site) is composed of 4 adjoining properties that total approximately 40 acres in size. The project site borders NC 211 to the south and Midway Road to the east in Brunswick County, North Carolina (Figure 1). The proposed development includes a Lowes Foods Grocery Store with additional attached and detached retail space. Sewer and water for the project site will be provided by Brunswick County. The project site is currently zoned as Commercial-Low Density (C-LD). This zoning is intended primarily for outlying areas adjacent to major thoroughfares in close proximity to residential areas. The intended commercial uses in areas with this zoning are to serve the needs of residential neighborhoods for auto-dependent commercial facilities and serve the needs of highway oriented tourist business. The proposed project is consistent with the current zoning of the site. 1.2 Project Team This project is being conducted on behalf of Midway/211, LLC under the supervision of Scott Cooke, P.E. Site development planning and stormwater management planning are being conducted by Dan Miller, P.E. (Kimley-Horn and Associates, Inc.). The jurisdictional delineation and environmental permit preparation for proposed jurisdictional impacts is being conducted by Matt Smith (Environmental Services, Inc.). 1.3 Agency Coordination Two pre-application meetings were held with the regulatory review agencies to discuss site planning constraints, potential project impacts, and methods used to avoid and minimize impacts 1 to jurisdictional areas. The first pre-application meeting was held on 1 C April 2007 with representatives of the U.S. Army Corps of Engineers (USAGE) and N.C. Division of Water Quality (DWQ) in attendance.. A second pre-application meeting was held on 27 April 2007 with representatives of DWQ to specifically discuss proposed stream impacts. This application incorporates the comments received at these pre-application meetings and expands upon the development plans presented at those meetings. 2.0 Purpose and Need Currently the only commercial development located in close proximity of the intersection of NC 211 and Midway Rd is the independently owned and operated gas station locally referred to as "Worms and Coffee" that is located on the northwest corner of the intersection of NC 211 and Midway Rd. No additional commercial retail development exists to serve the existing residential areas located within 2 miles of the intersection of NC 211 and Midway Rd. The intersection of Midway Road and NC 211 is centrally located to existing residential developments accessed from NC 211 and Midway Road. In addition, the intersection of NC 211 and Midway Road is the terminus for the new bridge to Oak Island. The intersection of NC 211 and Midway Rd is designated as a commercial development zone by Brunswick County and traffic flow studies show that this is an important hub for local traffic making this the logical location for a commercial retail development. The applicant proposes to construct an approximately 40-acre commercial center with access from NC 211 and Midway Road on the northwest corner of the intersection of NC 211 and Midway Road to provide commercial retail shopping to the existing residential developments located in close proximity to this intersection. 3.0 Alternative Analysis Headquarters of the USAGE guidance from 22 April 1986 requires that alternatives be practicable to the applicant and the purpose and need for the project must he the applicant's purpose and need. This guidance also states that project purpose is to be viewed from the applicant's perspective rather than from the bro~id, public, perspective. The essential point of the Headquarters of the USAGE policy guidance of 22 April 1986 is that under Section 404(b)(1) Guidelines, an alternative must be available to the applicant to be a practicable alternative. Pursuant to 40 CFR 230/10(a)(2) practicable alternatives are "available and capable of being done after taking into consideration cost, existing technology, and logistics in light of overall project purpose." 2 The preamble to the Guidelines states, "if an alleged alternative is unreasonably expensive to the applicant, the alternative is not practicable." Section 40 CFR 230.10(a) of the Guidelines states that "no discharge of dredged or fill material shall be permitted if there is a practicable alternative to the proposed discharge which have less adverse impact to the aquatic ecosystem, so long as the alternative does not have other significant environmental consequences." 3.1 Alternate Site Locations Four locations were initially considered for the proposed commercial development. The currently proposed location provides the necessary space, accessibility, and visibility needed. The additional sites initially considered were either unavailable for purchase or lacked the necessary size, accessibility and visibility needed. • Alternative location 1 is the current proposed location. This site provides the necessary road frontage, access, and land area to accommodate the proposed commercial retail development. This site meets the stated purpose and need. • Alternative location 2 is located on the northeast corner of the intersection of Midway Rd and NC 211. This site is too small to accommodate the proposed development and is not available to the applicant for use as a commercial development. • Alternative location 3 is located approximately 0.5 mile west of the ~.ntersection of NC 211 and Midway Rd on the north side of NC 211. This site does not provide the necessary access and frontage along Midway Rd and is constrained by a telecommunications tower located in the center of the property. This site is not available to the applicant for use as a commercial development. • Alternative location 4 is located on the south side of NC 211 at its intersection with Midway Rd. This site does not provide the necessary access and frontage along Midway Rd and is not available to applicant for use as a commercial development. 3.2 Site Alternatives 3.2.1 Alternative 1 (Preferred Alternative) This alternative proposes to construct a commercial retail center at the intersection of NC 211 and Midway Road (Figure 4). The development plan for this property depicts a Lowes Foods grocery store with six attached commercial retail stores, two stand-alone commercial retail buildings, and nine commercial outparcels. In addition, this alternative proposes to relocate an existing Brunswick Electric Membership Corporation (BEMC) substation from Outparcel 5 to the northwest corner of the site. The BEMC substation is scheduled for closure and relocation independent of the applicant's project. 3 The location of ingress and egress for the proposed development are as required by the North Carolina Department of Transportation (NCDOT). In addition, NCDOT is requiring substantial upgrades be completed to both NC 211 and Midway Road as part of the proposed development. Buildings proposed for the development are placed to avoid a powerline easement that runs across the property from north to south. The outparcels are sized and located to meet the intended uses as high visibility commercial development sites. Stormwater infrastructure is sized to meet the needs of the proposed development. This alternative meets the applicant's stated purpose and need and demonstrates avoidance and minimization of wetland and stream impacts to the greatest extent practicable. 3.2.2 Alternative 2 This alternative represents an attempt to reduce wetland impacts associated ;v~ith stormwater infrastructure. The site layout for this alternative is similar to the preferred alternative with the only change being to the Stormwater pond. The location of the Stormwater pond is the same as in the preferred alternative but its size is reduced by increasing its depth by placing additional fill across the site. A separate plan for this alternative was not prepared. This alternative reduces the wetland impact associated with the stormwater pond but resulted in the placement of an additional 6+ feet of fill across the entire site. Placing this volume of fill on the site was not considered to be a feasible alternative as locating, removing, and transporting this volume of fill would be cost prohibitive for the project and wo~ild have resulted in the finished elevation for the site being several feet higher than the adjacent roads. 3.2.3 Alternative 3 This alternative represents an attempt to reduce wetland impacts associates with stormwater infrastructure. The site layout for this alternative is similar to the preferred alternative with the only change being to the stormwater pond (Attachment 1). This alternative utilizes multiple stormwater ponds to achieve the needed stormwater capacity and reducing the area of the pond proposed to be constructed in wetlands. This alternative reduces the wetland impact associated with the stormwater pond but significantly reduces the useable area of four outparcels and substantially encroaches into the BEMC substation site. This alternative was not considered to be feasible since it reduces the size of three outparcels to less than 1 acre each, making them unusable for intended commercial purposes, and reduces the size of the BEMC substation site below the minimum required upland acreage without proposing additional wetland impacts. 4 3.2.4 Alternative 4 This alternative represents an attempt to minimize impacts to the stream channel by relocating the channel on-site as opposed to piping the stream channel as proposed in the preferred alternative to maintain an open channel for its entire length (Attachment 2). The relocated stream channel would initiate at the culvert at NC; 211 and continue along the western boundary of outparcel 9 before reconnecting into the existing channel at the northern corner of Outparcel 9. This alternative benefits by maintaining an open stream channel across the site but was not considered feasible due to concerns expressed by DWQ that relocating the stream would remove the stream from its natural valley and that the relocated stream could not adequately maintain stream flow and function. ,A further concern was the inability to establish 50-foot buffers adjacent to the relocated cham~el. 3.2.E No Action Alternative A "No Action" alternative is Here considered to he one that avoids all wetland and surface water impacts. A "No Action" decision for this project would not provide for an economically viable project for the applicant and Lowes Foods. The "No Action" alternative is not capable of achieving the basic purpose and need of the proposed project and, therefore, is not a practicable alternative. 4.0 Existing Environmental Conditions 4.1 Topography and Soils The site is located in the Coastal Plain Physiographic province of North Carolina. Topography across the site is notably flat with a differential of less than 6 feet across the site. The highest elevations occur in the northeast and southwest portions of the site and the lowest elevations occur in the northwest portion of the site where the stream channel exits the site. Topography across the site ranges from 38 to 44 feet above mean sea level, The property is mapped as Griffon fine Sandy loam (Gt), Pantego mucky loam (Pn), Foreston loamy fine sand (Fo), Lynchburg fine sandy loam (Ly), and Norfolk loamy fine sand, 2-6% slopes (NoB) based on the soil survey of Brunswick County North Carolina (Figure 2). Griffon fine sandy loam and Pantego mucky loam are hydric soil mapping units. The remaining soil mapping units are non-hydric soils that may contain inclusions of hydric soils. The hydric inclusions associated with these mapping units are Rains and Muckalee, respectively and most likely occur in depressions and along poorly defined drainageways. No other non-hydric soil mapping units are mapped for the site. 5 4.2 Land Use The site has been intensively utilized for agriculture from as early as the 1930's. During the time that the site was under usage for agriculture, numerous land alterations took place including the installation of manmade drainage ditches and the alteration and relocation of natural drainage features. Agriculture along the western side of the stream channel was abandoned in the 1980's and this area was allowed to revert to a natural condition. The remaining portions of the site were transitioned from agriculture to silviculture in the 1990's and were most recently harvested in 2006. Currently the site is not being managed for silviculture or agricultural uses. 4.3 Cultural Resources The site has undergone intensive agricultural and silviculture management since at least the 1930's and has a low probability for cultural resource sites. A letter has been submitted to the State Historical Preservation Office (SHPO) requesting comments on the proposed project. A response has not yet been received. 4.4 Water Resources The proposed development is located within stab-basin 030759 of the Lumber River Drainage Basin (DWQ 1999) and is part of USGS hydrologic unit 03040207 (USGS 1977). Three wetland areas and a stream channel are present on the site. These areas drain to the north to River Swamp. 4.5 Jurisdictional Areas A jurisdictional delineation of the proposed development was completed and approved by the U.S. Army Corps of Engineers (USAGE) in 2005 (AID # 200500833, 20050016, 200600394). Three wetland areas and one stream channel are present within the site boundaries that total 1.71 acres and 1459 linear feet, respectively (Figure ~ ). Wetland A is an excavated depression with an earthen berm located near the southern boundary of the site. This wetland is connected to other wetlands by the roadside ditch along NC 211 that connects into the stream channel. Much of this wetland is composed of asemi-permanently flooded open-water area with dense wax myrtle, water oak (Quercus nigra), and sweetgum (Liguidambar styraciflua) around the periphery. 6 Wetland B and Wetland C are located within the relict floodplain of the stream channel. These wetlands are adjacent to the stream channel but separated from the stream bank by an earthen berm that is the result of periodic excavation to maintain the stream channel. Hydrology in these wetlands includes saturated soils. Vegetation within these wetlands is composed primarily of wax myrtle (Myrica cerifera), dog fennel (Eupatorium capillifolium), and Carolina willow (Salix caroliniana). A single stream channel is located on the site. The stream channel enters the property via a culvert under NC 211 and flows across the property before exiting the property to the north and continuing to its eventual confluence with River Swamp. This channel is not depicted on the Lockwoods Folly USGS topographic map (Figure 1) or on the NRCS soils mapping for Brunswick County (Figure 2). The channel has been extensively altered from natural conditions during years of site usage for agriculture. Evidence of past alteration includes relocation of the channel within the floodplain as well as a loss in sinuosity and in-stream habitat complexity due to straightening and deepening of the channel. An earthen berm was observed along the eastern bank of the channel effectively separating the floodplain wetlands present along the streambank from the overbank flooding events. 4.6 Plant Communities The vegetation on the site has been heavily altered by historical agricultural use and later silvicultural activities. The majority of the property is vegetated in fast growing herbaceous and shrubby species with few mature trees. The dominant vegetation on the property includes wax myrtle, silverling (Baccharis halimifolia), willow oak (Quercus phellos), water oak, soft rush (Juncus effuses), dog fennel, and blackberry (Ru1~us argutus). Trees are sparsely scattered across the site and include loblolly pine (Pines taeda), sweetgum, and red maple (Ater rubrum). 4.7 Rare and Endangered Species Species with the federal classification of Endangered (E), Threatened (T), or Threatened due to similarity of appearance are protected under the Endangered Species Act (ESA) of 1973, as amended (16 USC 1531 et seq.). The 10 May 2007 U.S. Fish and Wildlife Service County Species List contains 14 species with federal designations of E or T which have ranges considered by the U.S. Fish and Wildlife Service to extend into Brunswick County: shortnose sturgeon (Acipenser breviros~trum), American alligator (Alligator mississippiensis), loggerhead sea turtle (Caretta caretta), piping plover (Charadrius melodus), green sea turtle (Chelonia rrrydas), leatherback sea turtle (Dermochelys coriacea), eastern cougar (Fells concolor couguar), Kemp's ridley sea turtle (Lepidochelys kempii), wood stork (Mycteria americana), red-cockaded woodpecker (Picoides borealis), manatee (Trichechus manatus), seabeach amaranth 7 (Amaranthus pumilus), rough-leaved loosestrife (Lysimachia asperulaefolia), and Cooley's meadowrue (Thalictrum cooleyi). The bald eagle (Haliaeetus leucocephalus) was removed from the ESA on 28 June 2007 but remains protected by the Bald and Golden Eagle Protection Act (16 USC 668a-d) which extends protections to the bald eagle that are similar to those previously afforded it under the ESA. The property does not provide suitable habitat for any federally listed species or the bald eagle. 5.0 Environmental Effects 5.1 Impacts to Jurisdictional Areas The development plan includes 0.59 acre of unavoidable impacts to jurisdictional wetlands and 409 linear feet of impact to jurisdictional streams. The development of outparcel 6 includes 0.11 acre of impacts (Figure 5), stormwater management structures include 0.38 acre of impacts (Figure 6), and the central commercial retail center has 0.10 acre of associated impacts (Figure 7). Stream impacts are limited to 409 linear feet associated with the development of outparcel 9 (Figure 8). The stream impact will involve filling 409 linear feet of stream channel and replacing this length of channel with a 404-linear foot box culvert. Details for the design of the box culvert are included in Figure 8 and Attachment 3. 5.2 Avoidance/Minimization of Impacts to Jurisdictional Areas Pre-application meetings were held with the USACE and DWQ to discuss feasible options for the proposed development that meet the applicant's purpose and need. The proposed development plan has been designed to avoid arld minimize impacts to jurisdictional areas to the greatest extent practicable. "I~he structures and parking areas associated with the development are concentrated in the upland areas of the property to reduce impacts to jurisdictional wetlands and streams. Multiple measures were employed to minimize the impacts to jurisdictional areas associated with stormwater construction. The usage of three smaller sized ponds linked by equalization pipes reduces encroachment into wetland areas and also eliminates the need for additional stream impacts without reducing the size of outparcels. In addition, using constructed wetlands in place of traditional ponds will provide for a greater degree of stormwater treatment and will result in cleaner effluent being released into the stream thus preventing water quality degradation. 8 Avoiding impacts to the stream channel by relocating the driveway and reconfiguring outparcels 7 and 8 is not feasible since the driveway location is mandated by NCDOT. Additional measures were taken to minimize impacts to the stream channel. Relocating the channel on-site was evaluated but determined to not be feasible due to concerns in regards to maintaining stream flow. The stormwater system was configured to utilize two ponds on opposite sides of the channel linked by an equalization pipe to reduce the length of channel that needed to be placed in a culvert. 6.0 Mitigative Measures Compensatory mitigation is being proposed for the 0.59 acre of wetland impacts and the 409 linear feet of stream impacts associated with the proposed development. The applicant proposes to pay into the N.C. Ecosystem Enhancement Program (EEP) for the impacts at a ratio agreed upon by the regulatory agencies in combination with preserving the remaining 1.13 acres of wetlands and 10201inear feet of stream channel not affected by the proposed development on the site (Figure 9). 7.0 Conclusion Midway/211, LLC proposes to construct a commercial retail center on an approximately 40-acre site located at the intersection of NC 211 and Midway Road. The development plan for this property depicts a Lowes Foods grocery store with six attached commercial retail stores, two stand-alone commercial retail buildings, nine commercial outparcels. In addition, this project will involve the relocation of an existing Brunswick Electric Membership Corporation (BEMC) substation to the northwest corner of the site. The development plan for this project meets the need in the local community for convenient and cost effective access to a supermarket and other commercial retail shopping.
