Good afternoon Sue, It has been a few weeks since our last correspondence so I wanted to follow up with a project status update as well as provide you with responses to the two concerns (regarding soil stability and vegetation success) you raised during our January 20th Meeting. Project Update - As of today, CEC is still awaiting comments from USACE's Steve Kichefski from our permit application submittal. - Additionally, the public notice was issued on 12/13/21 and the public comment period concluded 1/19/22. CEC is awaiting public responses (if any) from Steve. - An onsite meeting was held on January 27th with CEC staff, USACE's Steve Kichefski, and Hedrick's VP and Lake Norman Quarry (LNQ) Expansion Project Manager Jason Conner to discuss Conservation Easement options. Per onsite discussions, Hedrick has agreed to establish a Conservation Easement (CE) within the project area. The CE will stop short of the bridge crossing and begin again just after the bridge to establish a maintenance corridor. Hedrick is in the initial consultation phase of working with the Catawba Land Conservancy (CLC) to be the third party holder. It was agreed upon that the CLC would be third -party monitors after the 7-year monitoring period has concluded. 1/20 — Meeting Comments Follow Up — RE: Soil Stability and Vegetation Success: (1) Soil fertility & the physical component — In an effort to minimize erosion potential and stabilize the site, Hedrick will implement terracing of slopes in the areas designated as A & B (please see plan attachment). In those areas of terracing, the terrace material will be sampled for soil fertility. If fertility samples are low or amendments are needed, amendments will be added per the NC State University Soil Fertility Lab's recommendations or the terraces will be over excavated and backfilled with onsite fertile topsoil. These terraces will be stabilized at the end of every working day during the construction period. Fertility amendments will only occur during years 1 and 2 of monitoring. (2) Vegetation success — Soils (including legacy soils) will be monitored long-term to ensure success and that no washout to vegetation has occurred. Due to the fact that the project area is within an active mine site that is constantly being stripped of topsoil, Hedrick will begin stockpiling topsoil outside of the flood zone for use during the project's i construction phase. This topsoil will also be tested for fertility through the NC State University Soil Fertility Lab to monitor and promote vegetation success for restoration purposes. Morning Sarah, As I found out and we discussed yesterday the other real estate protection templates were not actually on RIBITS and I was not able to get you copies because the templates have not been updated in many years and are not up to current standards. I am checking with other District offices to determine what real estate protection standard has been utilized in recent years for this type of project for consistency, but the easiest to move forward with at this time (and District preferred method) is the CE. I'll let you know when I find out more information, however think it best to continue the path mentioned during yesterday's call to determine whether a CE is acceptable from both the state mining permit and project owner standpoint. If there are unavoidable roadblocks to utilizing the CE, we can evaluate further. Hopefully, I'll have more info by then, but wanted to let you know this update, since it is different than what I mentioned on yesterdays call. Sue- Let me know if you are aware of any recent or current similar projects (from a mitigation standpoint) since you probably see IP's from across the state, versus my experience in the western third of the state. We have found some Site Protection references, but do not see a link to the templates you mentioned... Here is one we found - Via the 2003 - RESTRICTIVE COVENANT GUIDANCE (army.mil) 3 "Permittee shall execute and cause to be recorded in the County Register of Deeds restrictive covenants acceptable to the Corps of Engineers for the purpose of maintaining the conservation areas, as shown on the recorded plat* (identify by title, date, and recording data), in their natural state in perpetuity, prior to the sale or conveyance of any lots or other property within the subdivision. The permittee shall enforce the terms of the restrictive covenants and, prior to conveyance of the property, shall take no action on the property described in the covenants inconsistent with the terms thereof. The permittee shall provide a copy of the recorded restrictive covenants to the Corps of Engineers within 15 days of recording."
