The northern ±18.5 acre parcel consists of undeveloped woodlands with very sparse trees. The southern ±5.71 acre parcel is currently under construction as a boat/self storage facility.
The project site has been partially cleared historically, and has been mowed/maintained to keep vegetation heights very low. The general land use in the vicinity of the project consists of a
mixture of residential and commercial/retail uses.

The purpose of the proposed project is to construct a mixed -use business park and boat/self-storage facility to meet the growing demand for these types of facilities in eastern Pender
County.

The proposed project consists of construction of 12 flex -space commercial/retail buildings, a boat/self-storage facility, access roads, parking and associated infrastructure (water, sewer,
stormwater management, electrical, etc).

The USACE issued a Final JD for the northern parcel (PIN: 4215-33-0904-000) on 4/22/2016 (AID: SAW-2015-01338), which has been provided as an Appendix.
WithersRavenel conducted a wetland delineation for the southern parcel (PIN: 4215-23-1857-0000) in July 2017 and determined that the parcel consisted entirely of uplands as
documented in the WithersRavenel report dated 8/10/2017, which has been provided as an Appendix.

E. Impact Justification and Mitigation
1. Avoidance and Minimization
la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project:*
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters' could be
minimized.
Wetland impacts have been minimized to those necessary to construct internal roads to access the developable uplands within the project and meet the
Pender County requirements for two points of access for emergency services and construction of the western SCM outfall (existing). There are no
proposed impacts associated with construction of the proposed office buildings or parking.
Wetland impacts have been minimized by crossing Wetland C (Impacts W1 & W2) perpendicularly. A culvert beneath the road will maintain hydrologic
connectivity between the wetland on each side of the road. These impacts are existing.
The access road within the business park has been designed for minimize impacts to Wetland B (Impacts W2 & W3) by encroaching only into the outer
edge of the wetland. A retaining wall has been designed to stabilize road fill to minimize wetland impacts from traditional backslopes that would have
encroached farther into the wetlands.
Wetland impacts for the western SCM outfall have been minimized to 0.003 acres (Impacts W5 & W6) for construction of the riprap dissipator and high
flow bypass to prevent erosion within the wetlands. These impacts are existing.
The site design has minimized wetland impacts to the greatest extent practicable and has minimized permanent wetland impacts to less than 0.10 acres.

Silt fencing will be installed around all disturbed areas to prevent sediment from escaping into undisturbed wetlands, and access during construction will
be within uplands.

has been provided as an attachment.

The boat/self-storage facility on the southern parcel (PIN: 4215-23-1857-0000) is currently under construction. Construction of the business park on the
northern parcel (PIN: 4215-33-0904-0000) has not begun.
The construction of the boat/self-storage facility within the southern parcel (PIN: 4215-23-1857-0000) resulted in unauthorized 0.003 acres of wetland
impacts (Impact W5 — 0.001 ac & W6-0.002 ac) within Wetland C for construction of the outfall for the western SCM which were not permitted prior to
construction. These impacts resulted from an error in the installation of the silt fencing that was supposed to run along the upland edge of the wetlands
to avoid encroachment into the wetlands.
The road connection between the storage facility and business park within the northern parcel (PIN: 4215-33-0904-0000) was not intended to be
constructed until the necessary permits had been received and was supposed to be stubbed short of Wetland C. The contractor partially constructed the
crossing through Wetland C (Impact W1 — 0.058 ac & Impact W2 — 0.07 ac) to access the outfall of the western stormwater pond outfall, as well as
stockpile materials, which resulted in 0.128 acres of unauthorized wetland impact.
This application will bring the project into compliance and permit all unauthorized wetland impacts for the entire project.
After the original application was submitted on 4/2/2020, the USAGE conducted a site visit and determined that the property was in violation of the CWA
due to ditching within the wetlands completed by the property owner in an effort to improve drainage on the site. A site meeting was conducted with
Emily Greer (USACE), Robb Mairs (NCDWR), Holley Snider (NCDWR), Troy Beasley (WR) and Andrew Furr (property owner) on 5/22/2020 to review
the violation and discuss the necessary steps to resolve the violation. It was during this meeting that the unauthorized impacts for the SCM outfall
(Impacts W5 & W6) were discovered. At the meeting, the property owner was instructed to survey all the constructed ditches and limits of the
unauthorized wetland impacts, and then backfill the ditches with native soils and stabilize the disturbed areas. In an email dated 2/14/2021,
WithersRavenel notified the USACE and NCDWR that the property owner had backfilled the ditches and seeded with rye grass and provided a copy of
the Wetland -Ditch Impact Survey, Photo Documentation of the restored ditches and updated wetland impact maps that showed the existing and
proposed impacts to be permitted to bring the site into compliance. Tom Charles (USACE) and Holley Snider (NCDWR) conducted a site meeting to
review the restored ditches on 8/2/2021, where they determined that the ditches had been sufficiently restored and the violation had been resolved. Tom
Charles (USACE) confirmed that the violation was considered resolved in an email dated 8/20/21, which has been provided as an attachment. Since the
violation has been resolved, permitting of the unauthorized wetland impacts and proposed wetland impacts could move forward, and have been
addressed in this application.

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home to identify if there were any known
occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any occurrences of federally listed
threatened or endangered species or critical habitat on the subject property or within 1.0 miles of the project, see attached NCNHP project review letter.
Additionally, a species list was generated using USFWS' Information for Planning and Consultation (IPaC), located at https://ecos.fws.gov/ipac/, on
11/07/2021. This species list identifies threatened, endangered, proposed and candidate species, as well as proposed and designated critical habitat,
that may occur within the vicinity of the project and may be affected by the project. The IPaC list has been provided as an attachment. Site reviews did
not identify any potential habitat for any federally protected species known to occur in Pender County, except for the Northern Long Eared Bat.
Potential habitat for the northern Long-eared bat (NLEB) is listed as mature forest with trees over 3" dbh, which is used for roosting during the day. The
proposed project area contains sparse trees over 3" DBH, and therefore is considered potential northern long eared bat habitat. The proposed project is
located outside of a red HUC and there is no pile driving, blasting or percussive activities proposed. Therefore, WR concludes that the project "may
affect, but is not likely to adversely affect" the northern long-eared bat and the SLOPES ALP Situation 1 is applicable to this project.

mapper classifies Virginia Creek, located approximately 4,000 If east of the proposed project, as Essential Fish Habitat. However, the project does not
drain to Virginia Creek, but actually drains west to Trumpeters Branch, which is not EFH. Therefore, the proposed project will not result in adverse
impacts to Essential Fish Habitat within Virginia Creek.

On behalf of Hilltop Management, LLC., we are requesting "after the fact" authorization from the
USACE to use NWP 39 for 0.09 acres of permanent wetland impacts for construction of two road
crossings necessary for construction of the Hilltop Business Park and Storage project. Please refer
to the Project History section of this letter for more information on the "after the fact" status of

Please note that an onsite meeting was conducted with Emily Greer (USACE), Robb Mairs
(NCDWR) and Holley Snider (NCDWR) on 5/22/2021, and therefore the pre -filing meeting
request requirements of the Clean Water Act Section 401 Certification Rule have been satisfied
for this project. A copy of the email from Emily Greer (USACE) requesting the site meeting has
been provided as an attachment.
The project is 23.32 acres and is located in the Cape Fear River basin (HUC: 030300070803) and
drains to Trumpeters Swamp. The Water Quality Classification for Trumpeters Swamp is C;SW,
and the Stream Index Number is: 17-74-49-2-1-1.
Proposed Project
The purpose of the proposed project is to construct a mixed -use business park and boat/self-
storage facility to meet the demand for these type of facilities in eastern Pender County. The
proposed project consists of construction of twelve flex -space commercial/retail buildings, a
boat/self-storage facility, access roads, parking, and associated infrastructure (water, sewer,
stormwater management, electrical, etc.).
The project will be constructed using traditional commercial construction equipment and
techniques.

Project History
The USACE issued an AJD (SAW-2015-01338) for the northern ±18.5-acre parcel (PIN: 4215-33-
0904-0000) on 4/22/2016. A copy of the AJD has been provided as an attachment.
The southern ±5.71-acre parcel (PIN: 4215-23-1857-0000) was reviewed by WithersRavenel in
July 2017 and was determined to consist entirely of uplands as documented in the "Wetland
Assessment Report" dated 8/10/2017, which has been provided as an attachment.
The boat/self-storage facility on the southern parcel (PIN: 4215-23-1857-0000) is currently under
construction. Construction of the business park on the northern parcel (PIN: 4215-33-0904-
0000) has not begun.
The construction of the outfall for the SCM for boat/self-storage facility within the southern parcel
(PIN: 4215-23-1857-0000) resulted in unauthorized 0.003 acres of wetland impacts (Impact W5
- 0.001 ac & W6-0.002 ac) within Wetland C which were not permitted prior to construction.
These impacts resulted from an error in the installation of the silt fencing that was supposed to
run along the upland edge of the wetlands to avoid encroachment into the wetlands.
The road connection between the storage facility and business park within the northern parcel
(PIN: 4215-33-0904-0000) was not intended to be constructed until the necessary permits had
been received and was supposed to be stubbed short of Wetland C. The contractor partially
constructed the crossing through Wetland C (Impact W1 - 0.058 ac & Impact W2 - 0.07 ac) to
access the outfall of the western stormwater pond outfall, as well as stockpile materials, which
resulted in 0.128 acres of unauthorized wetland impact.
This application will bring the project into compliance and permit all unauthorized wetland impacts
for the entire project.
After the original application was submitted on 4/2/2020, the USACE conducted a site visit and
determined that the property was in violation of the CWA due to ditching within the wetlands
completed by the property owner in an effort to improve drainage on the site. A site meeting was
conducted with Emily Greer (USACE), Robb Mairs (NCDWR), Holley Snider (NCDWR), Troy
Beasley (WR) and Andrew Furr (property owner) on 5/22/2020 to review the violation and discuss
the necessary steps to resolve the violation. It was during this meeting that the unauthorized
impacts for the SCM outfall (Impacts W5 & W6) were discovered. At the meeting, the property
owner was instructed to survey all the constructed ditches and limits of the unauthorized wetland
impacts, and then backfill the ditches with native soils and stabilize the disturbed areas. In an email
dated 2/14/2021, WithersRavenel notified the USACE and NCDWR that the property owner had
backfilled the ditches and seeded with rye grass. In the email, WithersRavenel included a copy of
the Wetland -Ditch Impact Survey, Photo Documentation of the restored ditches and updated
wetland impact maps that showed the existing and proposed impacts to be permitted to bring the
site into compliance. A copy of the 2/14/2021 has been attached to this application. Tom Charles
(USACE) and Holley Snider (NCDWR) conducted a site meeting to review the restored ditches on
8/2/2021, where they determined that the ditches had been sufficiently restored and the violation
had been resolved. Tom Charles (USACE) confirmed that the violation was considered resolved in
an email dated 8/20/21, which has been provided as an attachment. Since the violation has been
resolved, permitting of the unauthorized wetland impacts and proposed wetland impacts could
move forward, and have been addressed in this application.

Proposed Impacts
The proposed impacts consist of 0.089 acres of permanent wetland impacts and 0.085 acres of
temporary wetland impacts for construction of road crossings for internal access within the project
and provide two points of access as required for emergency services and construction of the
western SCM outfall.
The impacts consist of the following:
NWP 39 - 0.089 acres of permanent wetland impact; 0.085 acres of temporary wetland impact
• Impact W1 (0.058 acres - existing) - construction of a perpendicular road crossing through
Wetland C in order to provide interconnectivity between the boat/self-storage facility and
business park. This crossing also provides a second point of access to Machine Gun Road
as required by Pender County for emergency services access. A culvert will be installed
within the road crossing to provide hydrologic connectivity between the undisturbed
portions of Wetland C remaining on each side of the road.
• Impact W2 (0.07 acres - existing) - temporary wetland impacts for construction of the road
crossing from the storage facility to the business park.
• Impact W3 (0.028 acres) - permanent wetland impact to Wetland A for construction of
the main access to the business park from Hwy 17. A retaining wall will be used to stabilize
road fill.
• Impact W4 (0.015 acres) - temporary wetland impacts for construction of the retaining
wall.
NWP 18 - 0.003 acres of permanent wetland impact
• Impact W5 (0.001 acres - existing) - permanent wetland impacts within Wetland C from
construction of SCM outfall.
• Impact W6 (0.002 acres - existing) - permanent wetland impact within Wetland C from
construction of SCM outfall.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
Wetland impacts have been minimized to those necessary to construct internal roads to access
the developable uplands within the project and meet the Pender County requirements for two
points of access for emergency services and construction of the western SCM outfall (existing).
There are no proposed impacts associated with construction of the proposed office buildings or
parking.
Wetland impacts have been minimized by crossing Wetland C (Impacts W1 & W2) perpendicularly.
A culvert beneath the road will maintain hydrologic connectivity between the wetland on each
side of the road. These impacts are existing.
The access road within the business park has been designed for minimize impacts to Wetland B
(Impacts W2 & W3) by encroaching only into the outer edge of the wetland. A retaining wall has
been designed to stabilize road fill to minimize wetland impacts from traditional backslopes that
would have encroached farther into the wetlands.

Wetland impacts for the western SCM outfall have been minimized to 0.003 acres (Impacts W5 &
W6) for construction of the riprap dissipator and high flow bypass to prevent erosion within the
wetlands. These impacts are existing.
The site design has minimized wetland impacts to the greatest extent practicable and has
minimized permanent wetland impacts to less than 0.10 acres.
Silt fencing will be installed around all disturbed areas to prevent sediment from escaping into
undisturbed wetlands, and access during construction will be within uplands.
Mitigation
The proposed permanent wetland impacts are less than 0.10 acres, and therefore mitigation is not
proposed.

Mr. Furr:
On June 7, 2017, WithersRavenel conducted a site review of the ±5.53 acre property, located on
Machine Gun Road, for the purpose of evaluating the presence of wetlands and streams within the
project. The project consists of one parcel (Parcel ID: 4215-23-1857-0000), located
approximately 1500 feet northwest of the intersection of Old Whiteville Road and US Highway 17
in Hampstead, Pender County (Lat: 34.4396631°N; Long:-77.6329106°W). The project is located
in the White Oak basin (HUC 03020302), and the site drains to the Virginia Creek (Stream Index:
18-87; Surface Water Classification: SA;HQW).
Proposed Activities
The proposed activities consist of development of the property, including all associated
infrastructure including utilities, access and stormwater management.
Site Conditions
The entire site is undeveloped, and has been historically timbered and cleared and the vegetation
is periodically mowed which has prevented reforestation. The vegetative composition was
consistent throughout the site, and consisted of a mixture of loblolly pine saplings (Pinus taeda),
immature long leaf pine saplings (Pinus palustris), bracken fern (Pteridium aquilinum), bushy blue
stem (Andropoogon glomeratus), giant cane (Arundinaria gigantea), horsetail (Equisetum arvense),
gallberry (Ilex coriacea), red bay (Persea borbonia), horse sugar (Symplocos tinctoria), creeping
blueberry (Vaccinium crassifolium), and trumpet honeysuckle (Lonicera sempervirens).
The Pender County Soil Survey classified the soils within this area as Kureb Fine Sand (KuB) and
Leon Fine Sand (LnA). Kureb soils are classified as "excessively drained" soils. Leon Fine Sand is
classified as "poorly drained". Leon Fine Sand soils are found in broad flats throughout Pender
County and contain both upland and wetland components.
Wetland/Stream Determination
Prior to conducting the site visit, WR reviewed aerial photographs, the USDA Soil Survey for
Pender County (1990), the 2013 USGS Quadrangle Map (Topsail and Holly Ridge) and Pender

County GIS data (i.e. topography, streams, etc.). WR reviewed the project for the presence of
wetlands and surface waters jurisdictional to the Corps of Engineers (Corps) and/or NC Division
of Water Resources (DWR) based on protocols set forth in the 1987 USACE Wetlands Delineation
Manual and 2010 Atlantic and Gulf Coastal Plain Regional Supplement (Version 2.0).
The site review did not identify any wetlands or surface waters within the subject property. The
soils within the review area were consistent with Leon Fine Soils as mapped. The onsite soils
exhibited greater than 70% uncoated sand grains, which indicates an absence of wetland
hydrology, and does not meet hydric soil criteria. There were no hydrologic indicators observed in
the upper 12 inches of the soil surface, and saturation was not observed within 16 inches of the
soil surface, and therefore the site did not meet wetland hydrology criteria. Additionally, the
vegetation does not meet hydrophytic critera based on the prevalence index.
Summary
In conclusion, the subject property consists entirely of uplands and coordination with the Corps of
Engineers or NC Division of Water Resources is not necessary for development of the property.

I wanted to follow up on the violation resolution for this project. The ditches were filled/restored and seeded with rye
grass in October 2020.
You had brought up at the site meeting that you thought that there may have been some wetland impacts for
construction of the storage facility and stormwater pond. It turns out that you were correct, as the rip -rap outfall for
the stormwater pond impacted 81 sf of Wetland C. Also, the silt fencing was installed incorrectly within the edge of the
wetlands in another spot, resulting in 117 sf of wetland fill. These impacts, along with the impacts from the road that
was already graded through Wetland C and some revisions to the impacts for the road design will require a revision to
the PCN.
I have attached the following information for your review:
• Hilltop Wetland -Ditch Impact Survey with notes regarding the restoration of the ditches and wetland impacts to
be permitted (after -the -fact) in the NWP 39 PCN to be submitted upon resolution of the violation.
• Photo Documentation of restoration of the ditches, taken on 10/29/2020.
• Wetland Impact Maps with the existing and proposed wetland impacts to be submitted with the future NWP 39
PCN which will bring the project into compliance.
We believe that the filling/restoration of the ditches to resolve the violation should be sufficient to move forward with
the permitting of the existing and proposed wetland impacts. Once you have reviewed the attached information, please
let us know if the existing violation is considered resolved and if we can move forward with submittal of the NWP 39
PCN to permit the existing and proposed wetland impacts to bring the project into compliance. I understand that the
original application dated 4/2/2020 was withdrawn due to the open violation and that a new application (ePCN) must be
submitted.
Holley — the original application was submitted in April 2020, which was before the requirement of the Pre -Filing
Meeting Request. Is the site meeting with Robb Mairs on 5/22/2020 sufficient to satisfy the Pre -Filing Meeting Request,
or do we need to submit a formal Pre -Filing Meeting Request and wait 30-days before submittal of the 401 WQC
application?

I wanted to follow up on the violation resolution for this project. The ditches were filled/restored and seeded with rye
grass in October 2020.
You had brought up at the site meeting that you thought that there may have been some wetland impacts for
construction of the storage facility and stormwater pond. It turns out that you were correct, as the rip -rap outfall for
the stormwater pond impacted 81 sf of Wetland C. Also, the silt fencing was installed incorrectly within the edge of the
wetlands in another spot, resulting in 117 sf of wetland fill. These impacts, along with the impacts from the road that
was already graded through Wetland C and some revisions to the impacts for the road design will require a revision to
the PCN.

I have attached the following information for your review:
• Hilltop Wetland -Ditch Impact Survey with notes regarding the restoration of the ditches and wetland impacts to
be permitted (after -the -fact) in the NWP 39 PCN to be submitted upon resolution of the violation.
• Photo Documentation of restoration of the ditches, taken on 10/29/2020.
• Wetland Impact Maps with the existing and proposed wetland impacts to be submitted with the future NWP 39
PCN which will bring the project into compliance.
We believe that the filling/restoration of the ditches to resolve the violation should be sufficient to move forward with
the permitting of the existing and proposed wetland impacts. Once you have reviewed the attached information, please
let us know if the existing violation is considered resolved and if we can move forward with submittal of the NWP 39
PCN to permit the existing and proposed wetland impacts to bring the project into compliance. I understand that the
original application dated 4/2/2020 was withdrawn due to the open violation and that a new application (ePCN) must be
submitted.
Holley — the original application was submitted in April 2020, which was before the requirement of the Pre -Filing
Meeting Request. Is the site meeting with Robb Mairs on 5/22/2020 sufficient to satisfy the Pre -Filing Meeting Request,
or do we need to submit a formal Pre -Filing Meeting Request and wait 30-days before submittal of the 401 WQC
application?

Thank you for your inquiry. The first step is to deal with the violation. The violation must be restored to the Corps'
satisfaction before we can entertain a permit. However, to answer your question, you will have to resubmit through the
ePCN process because the permit has been withdrawn to become an enforcement action.

What does IPaC use to generate the probability of presence graphs for the migratory birds potentially
occurring in my specified location?
The probability of presence graphs associated with your migratory bird list are based on data provided by the Avian
Knowledge Network (AKN). This data is derived from a growing collection of survey, banding, and citizen science
datasets .
Probability of presence data is continuously being updated as new and better information becomes available. To
learn more about how the probability of presence graphs are produced and how to interpret them, go the
Probability of Presence Summary and then click on the "Tell me about these graphs" link.
How do I know if a bird is breeding, wintering, migrating or present year-round in my project area?
To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or
year-round), you may refer to the following resources: The Cornell Lab of Ornithology All About Birds Bird Guide, or
(if you are unsuccessful in locating the bird of interest there), the Cornell Lab of Ornithology Neotropical Birds
guide. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in
your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere"
is indicated, then the bird likely does not breed in your project area.
What are the levels of concern for migratory birds?
Migratory birds delivered through IPaC fall into the following distinct categories of concern:
1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range
anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands);
2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the
continental USA; and
3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of
the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from
certain types of development or activities (e.g. offshore energy development or longline fishing).
Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to
avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. For
more information on conservation measures you can implement to help avoid and minimize migratory bird
impacts and requirements for eagles, please see the FAQs for these topics.
Details about birds that are potentially affected by offshore projects
For additional details about the relative occurrence and abundance of both individual bird species and groups of
bird species within your project area off the Atlantic Coast, please visit the Northeast Ocean Data Portal. The Portal
also offers data and information about other taxa besides birds that may be helpful to you in your project review.
Alternately, you may download the bird model results files underlying the portal maps through the NOAA NCCOS
Integrative Statistical Modeling and Predictive Mapping of Marine Bird Distributions and Abundance on the Atlantic
Outer Continental Shelf project webpage.
Bird tracking data can also provide additional details about occurrence and habitat use throughout the year,
including migration. Models relying on survey data may not include this information. For additional information on

What if I have eagles on my list?
If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the
Eagle Act should such impacts occur.
Proper Interpretation and Use of Your Migratory Bird Report
The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority
concern. To learn more about how your list is generated, and see options for identifying what other birds may be in
your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in
my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km
grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look
carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a
red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of
presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack
of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting
point for identifying what birds of concern have the potential to be in your project area, when they might be there,
and if they might be breeding (which means nests might be present). The list helps you know what to look for to
confirm presence, and helps guide you in knowing when to implement conservation measures to avoid or minimize

Varine mammals
Marine mammals are protected under the Marine Mammal Protection Act. Some are also protected
under the Endangered Species Act1 and the Convention on International Trade in Endangered
Species of Wild Fauna and Flora.
The responsibilities for the protection, conservation, and management of marine mammals are
shared by the U.S. Fish and Wildlife Service [responsible for otters, walruses, polar bears, manatees,
and dugongs] and NOAA Fisheries [responsible for seals, sea lions, whales, dolphins, and
porpoises]. Marine mammals under the responsibility of NOAA Fisheries are not shown on this list;
for additional information on those species please visit the Marine Mammals page of the NOAA

Data limitations
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level
information on the location, type and size of these resources. The maps are prepared from the analysis of high
altitude imagery. Wetlands are identified based on vegetation, visible hydrology and geography. A margin of error
is inherent in the use of imagery; thus, detailed on -the -ground inspection of any particular site may result in
revision of the wetland boundaries or classification established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts,
the amount and quality of the collateral data and the amount of ground truth verification work conducted.
Metadata should be consulted to determine the date of the source imagery used and any mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or field work. There may be
occasional differences in polygon boundaries or classifications between the information depicted on the map and
the actual conditions on site.
Data exclusions
Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial
imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged
aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters.
Some deepwater reef communities (coral or tuberficid worm reefs) have also been excluded from the inventory.
These habitats, because of their depth, go undetected by aerial imagery.
Data precautions
Federal, state, and local regulatory agencies with jurisdiction over wetlands may define and describe wetlands in a
different manner than that used in this inventory. There is no attempt, in either the design or products of this
inventory, to define the limits of proprietary jurisdiction of any Federal, state, or local government or to establish
the geographical scope of the regulatory programs of government agencies. Persons intending to engage in
activities involving modifications within or adjacent to wetland areas should seek the advice of appropriate federal,
state, or local agencies concerning specified agency regulatory programs and proprietary jurisdictions that may
affect such activities.

The Wilmington Regional Offce received a complete State Stormwater Management Permit Application for the subject
project on June 8, 2018 with additional information received on August 14, 2018. Staff review of the plans and
specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000 effective January 1, 2017. We are forwarding Permit No. SW8 180607 dated August 28,
2018, for the construction, operation and maintenance of the stonnwater control measures (SCMs), built -upon areas, as
well as the stormwater collection system and/or vegetated conveyance system associated with the subject project.
This permit shall be effective from the date of issuance until August 28, 2026 and shall be subject to the conditions and
limitations as specified therein, and does not supersede any other agency permit that may be required. Please pay special
attention to the permit conditions regarding the operation and maintenance of the SCMs, stormwater collection system,
and/or vegetated conveyances; the limitation of built -upon area, modification of the project; the procedures for changing
ownership of and/or transferring the peunit; and the need to renew the permit. Please also pay attention to the permit
conditions that requires the recordation of deed restrictions and protective covenants, easements, and the maintenance
agreement, which must all be provided along with certification upon completion of the project. Failure to comply with
these requirements will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to request an
adjudicatory hearing by filing a written petition with the Office of Administrative llearings (OAH). The written petition
must conform to Chapter 150B of the North Carolina General Statutes and must be filed with the OAH within thirty (30)

measures" or "SCMs") discharging to SA-HQW waters (but not within % mile) in compliance with the
provisions of Title 15A NCAC 2H .1000 effective January 1, 2017 (the "stormwater rules") and the
approved stormwater management plans; application, supplement(s), specifications, and other
supporting data (the "approved plans and specifications") as attached and/or on file with and
approved by the Division of Energy; Mineral and Land Resources (the `Division" or "DEMLR") and
considered an enforceable part of this permit
This permit shall be effective from the date of issuance until August 28, 2026 and shall be subject to
the following specified conditions and limitations:
I. DESIGN STANDARDS
1. This permit is effective only with respect to the management and volume of stormwater
described in the approved plans and specifications. The maximum amount of built -upon area
(BUA) allowed for the entire project is 436,600 square feet.
2. The drainage area(s) for the on -site stormwater system(s) will be limited to the amount(s) of
built -upon area indicated in this permit and the approved plans and specifications. The runoff
from all built -upon area within the permitted drainage area(s) of this project must be directed into
the permitted stormwater control measure(s). The stormwater control measures labeled DA1,
DA2. and DA3 have been designed using the runoff treatment method to handle the runoff from
120,550 square feet, 35,800 square feet, and 280,250 square feet of built -upon area.
respectively. The built -upon area for future development within the drainage areas labeled DA1.
DA2, and DA3 is limited to 3,000 square feet, 2,000 square feet. and 15,000 square feet.
respectively.
3. A 50-foot wide vegetative setback must be provided and maintained adjacent to all surface
waters; measured horizontally from the normal pool elevation of impounded structures, from the
top of bank of each side of streams or rivers; and from the mean high waterline of tidal waters,
perpendicular to the shoreline in accordance with the stormwater rules and the approved plans
and specifications_
The stormwater control measure(s) is(are) permitted based on the design criteria presented in
the sealed; signed and dated supplement(s) and as shown in the approved plans and
specifications. This (These) stormwater control measure(s) must be provided and maintained at
the design condition. The approved supplement(s) is(are) incorporated by reference into this
permit_

5 The peak flaw from the 10-year storm event shall not cause erosion downslope of the
stormwater outlet discharge point.
6, Decorative spray fountains will be allowed in the stormwater treatment system if documentation
is provided demonstrating that the proposed fountain will not cause resuspension of sediment
within the pond or cause erosion of the pond side slopes.
7. When using a wet pond for irrigation, it is recommended that some water be maintained in the
permanent pool; the vegetated shelf is planted with appropriate species that can handle
fluctuating conditions; and human health issues are addressed.
8. The SCM landscape planting plan shown in the approved plans shall be followed in its entirety
during construction. After the plants are established; the operation and maintenance agreement
must be followed_
9. Pretreatment devices have been provided to prevent clogging. This project uses forebays for
pretreatment.
II. SCHEDULE OF COMPLIANCE
1 The project and SCM(s) shall be constructed; operated and maintained in accordance with the
conditions of this permit and the approved plans and specifications.
The on -site stormwater system shall be entirely constructed; vegetated, and operational prior to
the construction of any development within the drainage area, per the approved plans and
specifications.
3. During construction: erosion shall be kept to a minimum and any eroded areas of the on -site
stormwater system will be repaired immediately. If the stormwater system is used as an Erosion
Control device, it must be restored to design condition prior to operation as a stormwater
treatment device, and prior to occupancy of the facility.
4. All stormwater control measures, stormwater collection systems; vegetated conveyance
systems, and/or maintenance accesses must be located in public rights -of -way, dedicated
common areas that extend to the nearest public right-of-way, and/or permanent recorded
easements that extend to the nearest public right-of-way for the purpose of inspection,
operation; maintenance; and repair.
5. The permittee shall provide and perform the operation and maintenance necessary, as listed in
the signed Operation and Maintenance Agreement. to assure that all components of the
permitted on -site stormwater system functions at the approved design condition. The approved
Operation and Maintenance Agreement is incorporated by reference into this permit and must
be followed in its entirety and maintenance must occur at the scheduled intervals.
6. The operation and maintenance agreement must be recorded with the Office of the Register of
Deeds.
7, Records of maintenance activities must be kept and made available upon request to authorized
personnel of the Division. The records will indicate the date, activity, name of person performing
the work and what actions were taken.
8. The final plats for the project must be recorded with the Office of the Register of Deeds. The
recorded plat must reference the Operation and Maintenance Agreement and must also show all
public rights -of -way, dedicated common areas. and/or permanent drainage easements; in
accordance with the approved plans.
9. The permittee is responsible for verifying that the proposed built -upon area for the entire project
does not exceed the maximum allowed by this permit.

10. Upon completion of the project, the permittee shall determine whether or not the project is in
compliance with the permitted plans and take the necessary following actions:
a. If the permittee determines that the project is in compliance with the permitted plans, then
within 45 days of completion, the permittee shall submit to the Division one hard copy and
one electronic copy of the following:
i. The completed and signed Designer's Certification provided in Attachment A
noting any deviations from the approved plans and specifications. Deviations
may require approval from the Division;
ii. A copy of the recorded maintenance agreement;
iii. A copy of the recorded plat delineating the public rights -of -way; dedicated
common areas and/or permanent recorded easements, when applicable.
b. If the permittee determines that the project is not in compliance with the permitted plans,
the permittee shall submit an application to modify the permit within 30 days of completion
of the project or provide a plan of action; with a timeline, to bring the site into compliance.
11. No person or entity, including the permittee, shall alter any component shown in the approved
plans and specifications. Prior to the construction of any modification to the approved plans, the
permittee shall submit to the Director; and shall have received approval for modified plans;
specifications, and calculations including, but not limited to. those listed below:
a. Any modification to the approved plans and specifications. regardless of size including the
stormwater control measures, built -upon area; details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the drainage area.
c. Further development; subdivision, acquisition; lease or sale of any; ail or part of the project
area as reported in the approved plans and specifications_
d. Altering, modifying; removing; relocating. redirecting; regrading or resizing of any
component of the approved stormwater control measure, stormwater collection system
and/or vegetative conveyance system shown on the approved plan.
e. The construction of any allocated future BUA.
f_ The construction of any permeable pavement for BUA credit that was not included in the
approved plans and specifications.
g. The construction of any #57 stone area; public trails, or landscaping material to be
considered a permeable surface that were not included in the approved plans and
specifications.
h. Other modifications as determined by the Director.
12. The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit. Within the time frame specified in the notice, the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements. The permittee shall provide copies of modified plans and certification in writing to
the Director that the changes have been made.
13. Prior to transfer of the permit; a file review and site inspection will be conducted by Division
personnel to ensure the permit conditions have been met and that the project and the on -site
stormwater system complies with the permit conditions. Any items not in compliance must be
repaired; replaced restored, or resolved prior to the transfer. Records of maintenance activities
performed to date may be requested.
III. GENERAL CONDITIONS
1. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21.
The issuance of this permit does not preclude the permittee from complying with and obtaining
any other permits or approvals that are required far this development to take place, as required
by any statutes, rules, regulations, or ordinances, which may be imposed by any other Local.
State or Federal government agency having jurisdiction. Any activities undertaken at this site
that cause a water quality violation or undertaken prior to receipt of the necessary permits or
approvals to do so are considered violations of NCGS 143-215.1, and subject to enforcement
procedures pursuant to NCGS 143-215.6.

3 If the facilities fail to perform satisfactorily; the permittee shall take immediate corrective actions
This includes actions required by this Division and the stormwater rules such as the construction
of additional or replacement on -site stormwater systems. These additional or replacement
measures shall receive a permit from the Division prior to construction.
4. This permit is not transferable to any person or entity except after notice to and approval by the
Director. The permittee shall submit a completed and signed State Stormwater Request Form
for Permit Transfer or Permit Information Update. accompanied by the supporting
documentation as listed on the form. to the Division at least 60 days prior to any one or more of
the following events:
a. Any ownership change including:
i. The sale or conveyance of the project area in whole or in part. except in the case of
an individual lot sale that is made subject to the recorded deed restrictions and
protective covenants;
ii. Dissolution of the partnership. corporate; or LLC entity. subject to NCGS 55-14-05 or
NCGS 57D-6-07;
b_ Bankruptcy:
c. Foreclosure. subject to the requirements of Session Law 2013-121:
d. A name change of the current permittee:
e. A name change of the project,
f. A mailing address change of the permittee;
5. The permittee is responsible for compliance with all terms and conditions of this permit until the
Division approves the transfer request_ Neither the sale of the project, in whole or in part, nor
the conveyance of common area to a third party constitutes an approved transfer of the permit.
6. The permittee grants Division Staff permission to enter the property during normal business
hours to inspect all components of the permitted project.
7. The permit issued shall continue in force and effect until the permittee files a request with the
Division for a permit modification, transfer, renewal, or rescission; however, these actions do not
stay any permit conditions.
8. Approved plans, application documents, supplements, calculations, operation and maintenance
agreement; and specifications for this project are incorporated by reference and are enforceable
parts of the permit. A copy of this permit, application, supplements, operation and maintenance
agreement, and approved plans and specifications shall be maintained on file by the permittee.
9. Unless specified elsewhere, permanent seeding requirements for the on -site stormwater system
must follow the guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual.
10. The issuance of this permit does not prohibit the Director from reopening and modifying the
permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the
laws, rules; and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143-215.1 et.al.
11 A permit renewal request must be submitted at least 180 days prior to the expiration date of this
permit. The renewal request must include the appropriate application; documentation and the
