SUBJECT: CD 17-018 - Supplemental Consistency Concurrence, Hampstead
Bypass (Beane Wetland Mitigation Site) in New Hanover County,
TIP No. R-3300.
Dear Mr. Kimes:
The N.C. Division of Coastal Management (DCM) received a supplemental consistency
submission from the N.C. Department of Transportation (NCDOT) dated January 12, 2022, for
the construction of the Beane Mitigation Site in New Hanover County. The NCDOT submittal
states that the mitigation site will solely be used to provide mitigation for authorized impacts
associated with the R-3300 (Hampstead Bypass) project. The submittal includes a cover letter,
vicinity map, permit drawing, construction drawings and the final mitigation plan.
North Carolina's coastal zone management program consists of, but is not limited to, the Coastal
Area Management Act, the State's Dredge and Fill Law, Chapter 7 of Title 15A of North
Carolina's Administrative Code, and the land use plan(s) of the county and/or local
municipalities in which the proposed project is located. It is the objective of DCM to manage the
State's coastal resources to ensure that proposed Federal activities would be compatible with
safeguarding and perpetuating the biological, social, economic and aesthetic values of the State's
coastal resources.
DCM circulated the supplemental consistency certification to state agencies that would have a
regulatory or resource interest in the construction of the Beane Mitigation Site. No comments
were received asserting that the proposed project would be inconsistent with North Carolina's
coastal management program. DCM reviewed the information submitted by NCDOT, and the
comments received from state agencies, pursuant to the management objectives and enforceable
policies of Subchapters 7H and 7M of Chapter 7 in Title 15A of the North Carolina
Administrative Code.

DCM concurs that the proposed project is consistent, to the maximum extent practicable, with
North Carolina's approved coastal management program. Should the proposed action be
modified further, a revised consistency determination could be necessary. This might take the
form of either a supplemental consistency determination pursuant to 15 CFR 930.46 or anew
consistency determination pursuant to 15 CFR 930.36. Likewise, if further project assessments
reveal environmentaleffectsnot previously considered, a supplemental consistency certification
may be required.
