Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application:* The project site consists of approximately 52.88 acres located at 1317 West Gannon Avenue (NC Highway 97) in Zebulon, North Carolina within Wake County. The project site is bound by residential development and mixed hardwood -pine forest to the north, south, and east, and by Water Plant Road and residential development to the west. The site is comprised of agricultural fields and mixed hardwood -pine forests. In addition, six wetland and seven stream features were identified within the site. A delineation of the site was completed by Timmons Group on March 2, 2020. A confirmation site visit was conducted with Samantha Dailey and Jean Gibby of the USACE and by Joshua Brigham of the DWR on September 24, 2020 confirming the boundaries utilized for avoidance and minimization during project planning. This project was previously permitted with NWPs 12 and 14 received on February 2, 2021 and the corresponding DWR WQC received on February 12, 2021. A combined Approved and Preliminary Jurisdictional Determination letter was received from the USACE on February 2, 2021. The NC DWR Riparian Buffer Authorization was issued on February 12, 2021. Details regarding the originally approved impacts can be found in Section D below. Previously -issued permits and the corresponding approved plans are included in Appendix B and C, respectively, of the attached deliverables package. Work has since initiated at the site with impacts associated with the sanitary sewer line anticipated to be complete by March 18, 2022 This permit application is meant to serve as an addendum to the original application. Due to Town of Zebulon and NC DOT requirements, the proposed road widening design of West Gannon Avenue (NC Highway 97) where it bisects the site (see Appendix C, Sheet CWI2.2) had to be revised due to Town of Zebulon Unified Development Ordinance requirements. The revised roadway improvement design is now proposing a total of 0.212-acres of permanent wetland impacts, 40-I.f. (0.014-acres) of permanent stream impacts, 3,421-sq.ft. of permanent Zone 1 buffer impacts, and 1,989-sq.ft. of permanent Zone 2 buffer impacts. Mitigation credits were purchased form a private mitigation bank prior to impacts. The signed Mitigation Responsibility Transfer Form is included in Appendix D. Due to the increase in impact areas at the road crossing, additional wetland mitigation credits will be purchased. Stream mitigation and buffer mitigation are not proposed at this time (see Section D below). 4b. The purpose of this PCN submittal is to serve as an addendum to the original permit application to reflect changes in site design, specifically the proposed widening of West Gannon Avenue along the property's frontage due to Town of Zebulon development ordinances and NCDOT requirements. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used: * The proposed Jasper Place development is a single -phased residential development project that is located along West Gannon Avenue (NC Highway 97) in Zebulon, North Carolina within Wake County. The project site will include 97 single-family residential lots and other associated amenities, including stormwater control measures and utility improvements. The proposed road widening addressed in this PCN application includes the addition of a center turn lane along the property's frontage, pedestrian walkways along both sides of West Gannon Avenue, and extension of the existing culverts where West Gannon Avenue crosses a stream to accommodate the widened roadway. All work will be conducted in accordance with local, state, and federal regulators. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth movers. SCMs are required and will be used. 5. Jurisdictional Determinations 5a. (0.045-ac.) of permanent Zone 2 riparian buffer impacts associated with grading and road fill necessary to accommodate the addition of a center turn lane while maintaining safety and stability of West Gannon Avenue where improvements are required. E. Impact Justification and Mitigation 1. Avoidance and Minimization 1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including utilization of the wetland/stream delineation to adjust to the layout of the site design to avoid and minimize impacts. The remaining impacts proposed are necessary in order for the project's goals to be realized. Impacts associated with the revised roadway improvement design have been minimized by utilizing 3:1 slopes where West Gannon Avenue crosses jurisdictional features. Impacts were further reduced by placing culverts at the existing stream crossing at as close to a 90-degree angle as possible. Further, box culverts are proposed to allow for minimal streambed disturbance during and following culvert extension. The culvert was designed to be installed at a very low slope in order to avoid the placement of riprap within the streambed. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this project. All project construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. Comments The proposed project previously required the purchase of 0.233 riparian wetland mitigation credits. Included in the credits purchased were 0.079-acres of permanent wetland impacts mitigated at a 2:1 ratio associated with the road crossing along West Gannon Avenue and 0.075-acres of temporary, permanent conversion to herbaceous wetland impacts mitigated at a 1:1 ratio associated with sanitary sewer line installation. Mitigation credits for the previously -approved impacts were purchased prior to the start of work (see Appendix D). Following changes in roadway design along the frontage of the property, the stream crossing along West Gannon Avenue is proposing an additional 0.133-acres of permanent wetland impact associated with the roadway improvements, to be mitigated at a 2:1 ratio, requiring the purchase of an additional 0.266 wetland credits. These credits are proposed to be purchased from a private mitigation bank. The corresponding SOA is included in Appendix D. The previously -approved project proposed 31-I.f. (0.011-ac.) of temporary stream impacts associated with subgrade sewer line installation and did not require mitigation. Following road improvement design changes, the project is proposing an additional 0.014-acres of permanent stream impacts, below the 0.02-acres mitigation threshold required by NWP 14. Therefore, stream mitigation is not proposed to be purchased following site plan revisions. Total proposed Zone 1 and Zone 2 riparian buffer impacts associated with the road crossing have increased from 781-sq.ft. (0.017-acres) to 5,410-sq.ft. (0.120-acres). According to the Table of Uses in 15A NCAC 02B .0714, the proposed impacts associated with the road improvements are Allowable Upon Authorization. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? A USFWS IPaC Report and NC Natural Heritage Program (NHP) Database Report were utilized for review of potential protected species in the vicinity of the project site. Species identified by IPaC as potentially occurring in the vicinity of the site include the red -cockaded woodpecker, Neuse River waterdog, Carolina madtom, Atlantic pigtoe, dwarf wedgemussel, Tar River spinymussel, yellow lance, monarch butterfly, and Michaux's sumac. Additionally, the NCNHP report identified occurrences of federally listed species with the project limits or a 1-mile radius, including the Neuse River waterdog, dwarf wedgemussel, and Atlantic pigtoe. Occurrences of the aforementioned protected species were not observed during the site inspections. Due to the absence of forested areas of an appropriate age and size, it is the opinion of Timmons Group that the proposed project will have no effect on the red -cockaded woodpecker. In addition, Timmons Group assessed the possibility for occurrences of the northern long-eared bat (NLEB) and bald eagle. While the site contains suitable roosting habitat, Wake County is not identified by IPaC as a county where NLEB typically occurs. Furthermore, no occurrences of the bald eagle, their nests, or suitable foraging ground were observed during the site visit. Due to the silty streambed substrate observed in the streams throughout the site, minimization of impacts through proposed extension of the existing box culverts where West Gannon Avenue crosses a perennial stream, and the lack of species observation during onsite inspections, it is the opinion of Timmons Group that the proposed project may affect, but is unlikely to adversely affect the Neuse River waterdog, Carolina madtom, Atlantic pigtoe, Tar River spinymussel, yellow lance and dwarf wedgemussel. Further, proper sediment and erosion control measures will be utilized where required and will be regularly inspected and repaired as needed to reduce indirect impacts to these species. While the dwarf wedgemussel is a generalist in the habitats it prefers, no occurrences of the species were observed during onsite investigations. Further, only temporary stream impacts are proposed and the majority of onsite streams will remain unimpacted. Therefore, it is the opinion of Timmons Group that the proposed project may affect, but is unlikely to adversely affect the dwarf wedgemussel. Further, proper sediment and erosion control measures will be utilized where required and will be regularly inspected and repaired as needed to reduce indirect impacts to the dwarf wedgemussel. While potentially suitable foraging and breeding habitat for the monarch butterfly are present onsite, the species' habitat is ubiquitous throughout the area and any potentially displaced individuals are likely to be only minorly affected. Therefore, it is the opinion of Timmons Group that the proposed project will have no effect on the monarch butterfly. While suitable habitat for Michaux's sumac is potentially present along maintained rights -of -way (ROWs), due to the lack of species occurrences of Michaux's sumac during onsite investigations, thick herbaceous layer observed within unforested areas (including ROWS), frequent mowing of the existing ROW, and thickly -wooded areas across the remainder of the site, it is the opinion of Timmons Group that the proposed project will have no effect on Michaux's sumac. 6. Of the ten listings, nine are Survey Only (SO) while one, Bridge #910201 (WA6386) has been deemed eligible for listing (DOE) on the National Register of Historic Places (NRHP). This DOE historic resource is located approximately 0.41-mile northwest of the site while the nearest SO site is approximately 0.09-mile north of the site. Due to the distance from historic resources and consistency of proposed use with current surrounding uses, the proposed project should have no effect on historic resources. 8. A FEMA-designated floodway is located along the stream. The proposed utility crossing and road widening will result in minimal impacts to areas within the 100-year floodplain, with the proposed utility line impacts consisting only of temporary disturbance for installation. A CLMOR flood study and coordination with FEMA is currently in progress to determine impacts to the floodway and flood zones following completion of the proposed road widening. Copies of the approved 404 and 401 permits are required to complete FEMA coordination. 8c.
