No (conditionally closed) 8 PROJECT SUMMARY: The applicant proposes to install a new fixed platform and floating dock to an existing private access pier in Everett Creek. Richard Murray Page 2 9. PROJECT DESCRIPTION: The project site is located at 206 Point Drive, adjacent to Everett Creek, within Pages Creek, in New Hanover County. To locate the property from the Wilmington Regional Office (WiRO) turn right onto Market Street (NC Highway17) and travel north approximately 3 miles until you reach the entrance to Bayshore Estates Subdivision, which will be located on the right. Turn right and travel east on Bayshore Drive for approximately 0.75 miles until Bayshore Drive turns to the left Continue to head northeast onto Bayshore Drive approximately 1.0 mile until you reach Point Drive Turn left onto Point Drive and the property of interest will be immediately located on the right. The existing highground development includes a single - family residence, which borders Everett Creek, within Pages Creek. Upland vegetation consists of ornamental shrubbery, lawn grass and hardwood species such as Live Oak and otherwoody species such as Pine trees. The lot is approximately 0.66 acres in size and averages approximately 6' above normal high water (NHW) The approximately 1 01' of shoreline frontage is stabilized by vegetation consisting primarily of Smooth Cordgrass (Spartina alterniflora) in an area ranging approximately 120' to 150' in width The applicant currently maintains a private access pier and fixed uncovered platform, which was authorized through CAMA General Permit No. 61563 -D on 03/27/2013 This permit did not authorize a formalized slip at this facility due to the limited water depth of approximately -0 7' at mean low water (MLW) Extending in an easterly direction from the highground towards Everett Creek is an existing access pier, measuring approximately 110' in length by 6' in width, which is elevated over the existing wetlands The pier then terminates onto a fixed platform, measuring approximately 12' in length by 12' in width oriented towards the west creating an "L- shaped" configuration The existing facility is located directly across the creek from the existing Oyster Point Subdivision community marina, authorized under State Permit No. 41 -86 This permit included the marina docking facility along with the excavation of Everett Creek to the confluence of Pages Creek The community marina appears to accommodate approximately 20 vessels (See Sheets 1 through 5 of 5, Photograph and Project Narrative). The Wilmington /New Hanover County Land Use Plan 2006 Update classifies adjacent waters and high ground area of project site as Conservation. The waters of Everett Creek/Pages Creek are classified SA by the Division of Water Resources. They are designated as a Primary Nursery Area (PNA) by the N C. Division of Marine Fisheries and they are CONDITIONALLY CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new fixed platform and floating dock to an existing private access pier in Everett Creek. An access step would lead down onto a lower platform or cat -walk platform, measuring approximately 27' in length by 6' in width, which would wrap around the northern and western side of the upper platform An access ramp from the western side of the existing platform would lead onto a new floating dock, measuring approximately 20' in length by 6' in width, which would run perpendicular to the channel and located dust on the western side of the existing fixed platform. The application states that the floating dock would be designed to remain fixed at 18" above the substrate at low tide (hybrid dock). The application also states the water depth at this location would be approximately -07@ MLW. The proposed structures would accommodate one (1) vessel and also self propelled vessels such as kayaks /canoes at this location The application states the facility would be adjacent to the edge of the authorized channel under State Permit No. 41 -86, aforementioned (See Sheets 1 through 5 of 5 and Project Narrative). ANTICIPATED IMPACTS: The floating dock and fixed platform would incorporate approximately 282 sq ft of Estuarine Waters and Public Trust Area, which would allow the facility to provide docking space for up to one (1) vessel The application states that the floating dock would be designed to remain fixed at 18" above the substrate at low tide (hybrid dock). The waterward end of the proposed floating dock at the location of where the stern of the boat would be located, the existing water depth is approximately —0.7'@ MLW. The proposed structures would extend approximately 46' into a waterbody, which measures approximately 300' across. This distance would conform to both the % width distance rule and the established pier head alignment. Based on the application, the proposed structures would not encroach into the adjacent 15 foot riparian corridor setback requirement or the established channel of Everett Creek Minor increases in turbidity should be expected during the construction Submitted by: Robb L.
