Mr. Riggs,
I did receive electronically and have read your response to the site visit conducted by
Joanne and I on August 21, 2009. As agreed on August 24, 2009, a solution to this non
compliance would be your letter of explanation as well as the additional mitigation for the
unauthorized mechanized land clearing in the permitted bridge corridor. During our onsite
meeting, it was my understanding that the clearing noted was not only the area repaired where
equipment was stuck but also all from stump removal in advance of the bridge construction.
Both of these factors weighed into the decision to require mitigation for the bridge corridor
area.
Once the items outlined in your August 28, 2009 correspondence have been successfully
completed the site should be back in compliance.
Thanks again for your quick response and Caddell Yates complete cooperation with this
important matter.

Sorry I missed your call. I submitted the Permit renewal on 7.1.09 via personal delivery to your office. I have the transfer
application and the new I & M agreement singed by the Association ready to submit. I can go ahead and drop off
tomorrow and we could just wait for the Engineer's certification to clear the paperwork.

As for the pond bank, I am going to straw the area tomorrow myself to ensure that is corrected. I will let you know as
soon as it is complete.

We need to get this permit renewed. I went by there the other day and noticed that the ground is bare on the top and
back side of the berm at the back of the pond. Much erosion has occurred and sediment is getting into the drainage
ditch back there. Is there anything you can do to expedite getting this area seeded or sodded? I will issue the renewal
permit as soon as that area is stabilized.
Also, have you got all the signatures and forms filled out for the transfer? Please advise ASAP.

That is probably an accurate statement. However, the association has agreed to accept as is and proceed with the

Yes, we can allow the permit transfer if all parties agree. You would need to write up an attachment to the
Name/Ownership Change Form stating that the new Owner agrees to accept the pond conditions on "as is"
basis, and have them sign it.
Also, we will require that the pond banks are repaired, seeded, and stabilized within 15 calender days from the
renewal / transfer date. I am currently working on the renewal permit and should have that ready to be sent out
within the next couple days. Therefore, please try to get the paperwork to me by Friday morning.

On May 21, 2009, Steve Pusey of the Wilmington Regional Office of the Division of Water
Quality (DWQ) performed a follow-up inspected at Lauren Place Townhomes in New Hanover
County to determine compliance with Stormwater Management Permit Number SW8 960214
issued on May 8, 1996.
DWQ file review and site inspection revealed that the site is compliant with the terms and
conditions of this permit with exceptions noted in the attached "Compliance inspection Report."
Also included in the inspection report is a summary of items required to bring the project into
final compliance and transfer the permit to the new Owner.
Please provide the requested actions and information to this Office in writing before June 19,
2009. Failure to provide the requested information, when required, may initiate enforcement
action including the assessment of civil penalties of up to $25,000 per day. If a written plan of
action is not submitted to this office by June 19, 2009, then DWQ staff will re -inspect the site
and issue a Notice of Violation if the listed deficiencies have not been addressed.
Please be advised that you are required to comply with the terms, conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
.1003 and North Carolina General Statute 143-214.7, including operation and maintenance of

Dear Mr. Pusey
We were forwarded your letter and compliance inspection report on the above
noted complex by Eastwood Developers, LLC and have been working with them
relative to compliance and permit transfer. Although a few days late in responding
to your letter and on behalf of the Lauren Place HOA, I did want to let you know the
current status and ask that DWQ work with us while getting this project completed.
At this point, we have received quotes for bringing the storm water system into
compliance and believe we will be able to authorize work to begin the week of
March 1 subject to weather conditions. As we understand the compliance
requirements, we would need to do the following:
1. Remove, clean, add as necessary and reset rip -rap while removing
sedimentation from the forebay holding areas in both ponds
2. Rework and fill eroded areas along the back side of our rear pond and sod
or seed the reworked areas.
3. Rework and/or reset rip -rap at the rear pond outlet.
4. Adjust/repair trash rack at the front pond.
5. Obtain an engineer's certificate of compliance after the work has been
completed.
Once completed and in compliance, would Eastwood Developers, LLC be
authorized to transfer the permit to Lauren Place Homeowners Association, Inc.? `Q

This letter is in response to your letters dated January 15, 2009 and January 22, 2009
concerning the above -referenced stormwater facility.
While the development entity Eastwood. Developers, LLC has ceased to exist long ago,
we are attempting to complete this transfer of the permit to the "new" owner, the Lauren
Place HOA.
My understanding with the Association Manager, Richard Collins, is that the HOA is
currently receiving bids for the scope of work described in the recent DWQ inspection,
and they will proceed with the needed .repairs to bring the pond into compliance. He told
me he will be updating you in writing by February 1 15*, as requested in your letter to halm.
Otherwise, he and I have reached an understanding of the remaining (known) items
needed to transfer the pond's permit to than Lauren Place HOA. These items include the
eaogincees cork fication of the pond (which will be perfoimcd after the known
maintenance is completed) and the necessary paperwork required.

On September 12, 2007, the Wilmington Regional Office (WIRO) received an incomplete Stormwater
Management Permit Name/Ownership Change form for Lauren Place Townhomes Stormwater Permit #
SW8 960214. Please be aware that a stormwater permit cannot be transferrer] to a new Owner until_ the
following conditions are met:
1. An expired permit cannot be transferred. This permit expired on May 8, 2006. As the holder of
this permit, Eastwood Developers, LLC or Mark L. Maynard was required to renew this permit
within 180 days prior to the permit expiration date. In addition, operation of a stormwater
treatment facility without a valid permit is a violation of NC General Statute 143-215-1 and will
result in appropriate enforcement action including the assessment of civil penalties. WIRO
recommends that you renew this permit immediately. Therefore, a permit renewal application
form has been enclosed for your convenience.
2. The stormwater system must be in compliance with all the conditions of the permit. This
includes, but is*not limited to, the submittal of a designer's certificate to WIRO that ensures the
system is built in accordance with the approved plans and that the system is operating properly.
In addition, a site inspection must be conducted by WIRO to determine whether the system is in
compliance, and a report will be sent to the current permit holder. We expect this inspection to
take place within the next week.
Once the permit is renewed and the system is found to be in compliance with the permit conditions, the
permit can be transferred. Please note that it is the responsibility of the current permit holder to submit
the Name/Ownership Change form to WIRO and to ensure that both parties sign the form.
In summary, the following checked information is needed to continue the stormwater review:

determined that the permit expired on 5/08/06. The Permitee, Eastwood Developers, LLC, was
responsible for maintaining the facility and applying for the Permit Name/Ownership change when the
property was sold. The Condominium Association should apply for a new permit. If the association is
unwilling to accept the Stormwater facility in its present condition, then you will need to contact the

to Eastwood Developers, L. L. C. for a High Density pond to serve Lauren Place Townhomes on
5/8/1996. This permit expired on 5/8/2006. Section .1003(h) of 15 A NCAC 2H .1000 (the stormwater
rules) requires that applications for permit renewals shall be submitted 180 days prior to the expiration
of a permit and must be accompanied by a processing fee, which is currently set at $420.00. If this is
still an active project please complete and submit the enclosed renewal application in a timely manner.
If this project has not been constructed and a permit is no longer needed, please submit a request to
have the permit rescinded. If you have sold the project, or are no longer the permittee, please provide
the name, mailing address and phone number of the person or entity that is now responsible for this
permit. Enclosed is a form for change of ownership, which should be completed and submitted If the
property has changed hands.
Your permit requires that upon completion of construction and prior to operation of the permitted
treatment units a certification of completion be submitted to the Division from an appropriate designer

On May 8, 1996, the Wilmington Regional Office issued a permit to you for Lauren
Place I ownhomes. Per the requirements of the permit, a copy of the
Engineer/Designers certificate for the stormwater pond must be forwarded to our office
upon completion of the site. A review of our files indicates that we have not received a
copy of the certificate yet. This is the third notice you have been sent regarding this
matter. The first was sent in January of 1998 and the second was sent September 21,
2000. If we do not receive a copy of the designers certificate by July 30, 2p004 a Notice
of Violation will be sent to you.
