This Deed, made this 12th day of February, 2018, by and between Deborah C. Morgan of
6048 Morgan Road, Bailey;%North Carolina 27807 and John R. Morgan of 1012 Turnberry Lane,
Clayton, North Carolina 27520, Co -Executors of the Estate of Billy D. Morgan, herein called
Grantor, and C. Ray Joyner, Administrator of the Estate of Richard D. Morgan, of PO Box 2311,
Rocky Mount, North Carolina 27802, herein called Administrator of the Estate of Richard D.
Morgan, and Morgan Properties, LLC of 5904 Morgan Road, Bailey, North Carolina 27807,
herein called Grantee.
W i t n e s s e t h :
Whereas, Billy D. Morgan died on January 11, 2017, and a caveat was filed with respect
to his will and codicil which had been probated in the office of the clerk of superior court of

Nash County, North Carolina in estate file 17 E 15, and the parties to the caveat proceeding
subsequently entered into a family settlement agreement; and
Whereas, the superior court judge entered a judgment on September 5, 2017 which
approved the family settlement agreement, struck the will and codicil, required Deborah C.
Morgan and John R. Morgan to be appointed as Co -Executors of the Estate of Billy D. Morgan,
vested title to the property described herein in the Estate of Billy D. Morgan, and authorized and
directed the Co -Executors to convey the property described herein consistent with the terms of
the family settlement agreement; and
Whereas, the family settlement agreement approved by the court requires the Co -
Executors to convey to Grantee the property described herein; and
Whereas, the superior court judge signed a supplemental judgment on September 22,
2017 and a second supplemental judgment on January 9, 2018 dealing with the title to the
property owned by Billy D. Morgan at the time of his death, copies of which supplemental
judgment and second supplemental judgment have been recorded in book 2901, page 722 and
book 2971, page 283 of the Nash County registry.
Now, therefore, Grantors do give, grant, bargain, sell, and convey unto Grantee, his heirs,
successors and assigns, in fee simple, the following described property located in Nash County,
North Carolina:

Known as: Off South NC 231Bunk Lane

Property Belonging to the Heirs of W. C. Morgan (Deceased) situated in Ferrells

portion of that certain tract or parcel of land described in deed dated January 1, 1931
from N. T. Montgomery, Trustee, to C. W. Lassiter (by error C. T. Lassiter in deed),

C. W. Lassiter died a resident of Nash County on July 20, 1970 leaving a Last Will and
Testament in which he devised his property one-half to his daughter, Jean Lassiter
Wachtel, and one-half equally to his granddaughters, Linda Stott (now Linda S. Franklin)
and Frances Stott, as will appear of record in Estate File 70-E-160 in the office of the
Clerk of Superior Court of Nash County. Jean Lassiter Wachtel died a resident of Nash
County on October 17, 1998 leaving a Last Will and Testament in which she devised her
property to her children, Catherine W. Bass, Martin Luther Wachtel, III and William
Wesley Wachtel, as will appear of record in Estate File 98-E-502 in the office of the clerk
of Superior Court of Nash County.
