The January 24, 2022 letter states that the City of Durham is provided an opportunity to present evidence and justification to demonstrate that the proposed civil penalties for the Notice of Violation (NOV) should not be assessed for the sanitary sewer overflows (SSOs) which occurred in the City's sewer collection system between December 1, 2021 and December 31, 2021. As requested, the City of Durham, Department of Water Management (DWM) is providing information about the two incidents that occurred during this timeframe to support the City's position that these events were exceptional, unintentional, temporary, and beyond the City's exercise of reasonable control despite meeting all the conditions of the City's Collection System permit including site visits, inspections, and easement maintenance. Incident # 202102248 -1610 Juniper Street— December 9, 2021 On December 9, 2021, an overflow occurred near 1610 Juniper Street with an estimated 300 gallons of wastewater discharging into Goose Creek. This overflow occurred due to a blockage in the sewer main caused by a collection of grease. The line was initially cleared by a quick response truck. Crews set up a JetVac truck and cleaned all grease and debris out of the manhole. The creek was dammed downstream with sandbags, the area was flushed using a nearby hydrant (dechlorinated water) and a 4-inch pump was set up to pump the untreated wastewater back into the collection system. After the initial cleanup was completed, crews used a JetVac truck to clean the three upstream manholes and three downstream manholes to ensure the pipes were clear per the division's Standard Operating Protocols. The department's Industrial Waste Control/FOG program staff distributed notices to the neighborhood to inform and educate the residents on the effects of grease in the collection system and the appropriate disposal options. At this time, the indicated series of reaches are on a Hot Spot program for the immediate future and will be checked by CCTV truck every two weeks until further notice. The City's Stormwater Services Division responded and conducted ammonia testing to help determine the spill's extent and advise when the site returned to normal conditions. No immediately visible adverse environmental impacts or hazards to persons or property were observed. Page 2 of 3 City of Durham crews have followed up by cleaning the lines above and below the incident location and using CCTV trucks to ensure the pipes are cleared. As required, a news release was issued within the 24-hour window. The cost to remediate this spill was $9,783.15. Incident # 202102307 —1221 Kendall Drive — December 27, 2021 On December 27, 2021, an overflow occurred near 1221 Kendall Drive releasing an estimated 960 gallons of wastewater into Little Lick Creek. This blockage was caused by a buildup of unknown debris in the line. The line was initially cleared by a quick response truck. Crews setup a JetVac truck and cleaned the debris out of the manhole. The creek was dammed downstream with sandbags, the area was flushed using a nearby hydrant (dechlorinated water) and a 4-inch pump was set up to pump the untreated wastewater back into the collection system. Crews also installed a locking lid on MH 12163 to prevent vandalism. After the initial cleanup was completed, crews used a JetVac truck to clean the three upstream manholes and three downstream manholes to ensure the pipes were cleared per the division's Standard Operation Protocols. The department's Industrial Waste Control/FOG staff have developed public communications, including ads on local television stations, regarding the impact of woven and non -woven materials on the sewer system. These communications also educate residents on the appropriate disposal of these materials via trash to prevent backups and spills. The cost to remediate this spill was $8,970.56 Ongoing City -Wide Measures to Reduce the Occurrence of SSOs The City has several programs in place to reduce and/or prevent the occurrence of SSOs. The City has implemented a CMOM plan that expands and enhances its existing programs. System Flushing and Inspection: The City routinely contracts flushing, CCTV inspection, smoke testing and manhole inspections of portions of the sewer collection system. The City is completing the inspection of the collection system systematically through City defined basins. Additionally, the City ensures the requirements of the collection system permit are met by deploying City crews to flush at least 10% of the collection system annually with a goal of exceeding the requirement by at least 2 to 5% each year. The City measures the flushing on a fiscal year basis. As of December 31, 2021, the City has cleaned 7.76% of the system. Sewer Rehabilitation Program: The City has an active Sewer Rehabilitation Program. The program includes flow monitoring (25 permanent monitors), CCTV inspection, manhole inspection, easement mowing, field inspections and investigations, point repairs, line replacement, root and grease abatement, and cured -in -place manhole and line rehabilitation. There are 4 employee positions dedicated to the City's system rehabilitation programs in the Utility Engineering Division of DWM. This workgroup handles flow monitoring and system data management and contract preparation, administration, and inspections. There are 20 employee positions in our Collections Systems Maintenance workgroup in the Water and Sewer Maintenance (WSM) Division of DWM. This group performs CCTV inspections, hydraulic cleaning activities, mowing, and manhole inspection Page 3 of 3 and repair. Crews respond to blockages and overflows. The department does contract inspections as well. In addition, crews from the main line workgroup of WSM perform point repairs, line replacements, and cured -in - place lining. The department established the Lift Station Maintenance Division in 2018 to focus oversight and maintenance of the 65 lift stations throughout the service area and the 136 ARVs in the system. This 18- member workgroup conducts the required daily/weekly inspections and associated preventive maintenance activities. The City spends more than $5,000,000 on Sewer Rehabilitation projects annually as a part of its Capital Improvements Programs. Fat, _Oils -and Grease Program (FOG): The department's FOG education and outreach effort is conducted by 3.0 FTEs (staff shared 50/50 with the Industrial Waste Control Program). In addition to working closely with the Durham County Health Department, staff routinely inspect over 800 food service establishments (FSEs) annually to ensure appropriate cleaning and maintenance of grease interceptors. Staff participates in several community events (Earth Day, Center Fest, and Landlord Workshops) as well as neighborhood meetings to increase awareness of what is appropriate to put in the sewer system. FOG staff conducts post-SSOs follow-up education and enforcement as necessary. The City also invests more than $35,000 per year in advertising (TV commercials, social media, etc.) regarding the proper disposal of FOG. Summary: Based upon the documented information provided above regarding these incidents, the City believes that these SSOs were exceptional, unintentional, temporary and caused by factors beyond the City's/department's reasonable control. The City actively manages, operates and maintains its system in such a manner as to meet or exceed all the requirements of the Collection System permit. As detailed above, the City systematically inspects, flushes, and rehabilitates its wastewater collection system. The department actively works to educate the community regarding what should and should not be discharged into the City's sewer collection system. Anytime the City finds a grease issue in anj area we report the findings to him. Tyrone proceeds to pass out paperwork and speak with the problem residents or business. We then monitor the area with our hotspot program to report findings. Collections Department quick response operator Willie Elliott Jr. received a call about a Manhole overflowing on the outfa at 1:30 m on 12/09/2021. U12on arrival crews noticed sewer overflowing out of Manhole 30172 at a rate of 5cigm. Crews were able to remediate the overflow at 2:30pm by flushing with quick response flush truck for a total of 300 gallons. After removing blockage crews set up a let -vac truck at overflow Manhole and vacuumed out all grease and debris in Manhole. Crews set u2 a pump downstream on Goose Creek tributary A and dammed off the creek with sandbags. We Dumped all untreated wastewater into Manhole 14957. Crews used defuser on hydrant 01128 to push all untreated wastewater to Pump. We called outfall crew to take skid steer and skim all wastewater and debris off the -ground removinq any signs of wastewater on ground. Crews then seeded and straw area to return it back to normal condition. We called storm water ti test creek on 12/13/2021 at 7am to check for any ammonia in creek. At 930am they reported no ammonia in creek. Crews will flush and CCTV 7 total assets to make sure problem area is located. These lines will also be put on a hotspot program where we will monitor monthly by flushing to make sure no SSO occurs in area. Approximately 300 gallons of untreated wastewater flowed into an unnamed tributary of Goose Creek. The overflow was caused by blockage of grease in the sewer line. Staff were notified of the overflow at 1:30 p.m. on December 9, and the overflow was stopped at 2:30 p.m. Crews dammed the creek downstream, pumped the untreated wastewater back into the sewer system, and flushed the sewer line around the manhole to remove any remaining buildup of grease in the line. As a reminder, only water, human waste, and toilet paper are permitted to be discharged into the sewer system. All other materials —including fats, oils, and grease (FOG) that should not be allowed into the sink —contribute to sanitary sewer overflows. After flushing crews pulled out 25ft of twisted sisal roe entangled in non woven. Suspected cause or source of debris. We suspect the rope was nut in by possible vandalism and non woven came from residents. Are manholes in the area secure and intact? Comments: Crews received a call for a sewer odor in the area at 7:21 pm on 12/27/21. Upon arrival crews found Manhole 12163 overflowing at a rate of 5gpm. Crews used flushed truck to flush line to remove blockage. Crews removed blockage at 10:35 m and found rope and non woven materials to be the issue. Total gallons were 960 gallons. Water Sewer Maintenance has a program on the Durhamnc.gov website that explains the issues with non woven and the troubles they cause. Also it is attached to our fog12rogram. Crews used a quick response mini flusher to removed blockage from asset id 12163. After flushing crews removed blockage and found the issue was 25ft of twisted sisal rope entangled with non woven materials. After removal crews test several areas of the creek to find ammonia levels at 0 in order to set up pump to bypass all untreated wastewater back in1 the Sewer System. After testing creek crews set up a bypass pump at 3622 Wake Forest Hwy and used Manhole 17833 to discharge all the untreated wastewater. Crews set up diffusers at two severate hydrants on Horseshoe Rd. to help pu: untreated wastewater to pump. Pump location used sandbags to dam creek so no wastewater_ could get by. Crews calle Dwr State at 3:15am on12/28/21 and spoke with George Jones and reported spill. After setup crews used trashcans to remove all debris and a percentage of dirt on ground to make sure no untreated waste water or debris was left on ground We removed 5 industrial size trash bins from site filled with dirt and tainted grass. After complete removal crews used straw and grass seed to fix area to put it back at its natural state. Crews will clean 7 total assets in area to ensure no debris left in sewer main. We will do 3 assets above and 3 assets below. Also these lines will be put on Collections department hots of program. We monitor these lines monthly to ensure no follow up SSO in area. On 12/29/21 Storm Water Quality was called at 6am so they can check all Dolnts on contact in creek with ammonia. Approximately 960 gallons of untreated wastewater flowed into little Lick Creek Watershed. The overflow was caused by debris in the sewer line. Staff were notified of the overflow at 7:23 p.m. on December 27, and the blockage was cleared at 10:35 p.m. Crews flushed and removed the blockage, dammed the creek, and pumped the untreated wastewater back into the sewer system. As a reminder, only water, human waste, and toilet paper are permitted to be discharged into the sewer system. All other materials —including fats, oils, and grease (FOG) that should not be allowed into the sink —contribute to sanitary sewer overflows.
