PROJECT SUMMARY: The applicant proposes to fill 3,204 sf of Section 404 wetlands and construct a single-family residence with a pool, pool house, walkway, platform and associated infrastructure. Pro'ect Settin The project is located at 42195 Shallow Point Drive in Avon, Dare County, and is in Section 2 of the Askins Creek Subdivision. Lot 29 is a 20,368 square foot (so vacant, undeveloped parcel with 389 linear feet (Ift) of unhardened shoreline. The elevation of the tract is approximately 2' above normal water level (NWL). The property is vegetated with Atlantic cedar, live oak, bayberry, cat brier, palmettos, camellias, wax myrtle, and non -coastal wetland vegetation. A Coastal Wetland fringe consisting of black needle rush (Juncus roemerianus) and salt meadow hay (Spartina patens) starts along the shoreline at approximately 45' from the property line and continues west to the property line shared by the riparian property owner to the southwest. The riparian property to the east is developed with a single family residence, and the next riparian property has a small dock. The riparian property to the southwest is developed with a single family residence and pier/walkway. There are no previous permits on file for the project site, and the location is not in a National Registered Historic District. The water classifications for Askins Creek and the connecting waterbody of Pamlico Sound are SA and HQW. The project area is closed to shellfishing. The adjacent waterbodies are designated as Coastal Waters and are in the Pasquotank River Basin. The water depth just offshore is -6 inches, with a NWL depth of -1' four feet waterward where a small dock is proposed. No submerged aquatic vegetation (SAV) was observed. Development Proposal The applicant proposes to fill 3,204 sf of Section 404 wetlands and construct a 4-bedroom, 1,800 sf, 2-story single-family residence with decking, concrete parking, a Brunswick Bed & Fill septic system with a peat bio filter repair area, a 16' x 28' swimming pool, 100 sf pool house, 30' x 4' walkway, and a 4' x 8' dock on Askins Creek. The development will result in a total impervious coverage in the 75' AEC of 2,650 sf (18.5%). The total impervious area for the 20,368 sf site will be 22.6%. No Coastal Wetlands will be impacted in the project area. Siltfencing will be installed along the limits of the project in orderto prevent impacts to adjacent 404 wetland vegetation. Anticipated Impacts The proposed dock will result in the shading of 32 sf of Estuarine Waters/Public Trust Area AECs. The proposed pool house, swimming pool, and a section of the single-family residence will result in the total filling of 3,204 sf of USACE 404-wetlands (-3,100 sf within the Coastal Shoreline AEC). The remaining portion of the house, parking, driveway, and septic system will disturb 6,000± sf of high ground landward of the Coastal Shoreline AEC. Submitted by: Yvonne Carver Date: 02/15/22 PROJECT NARRATIVE Manno CAMA Major Permit December 16, 2021 Pro'ect Description: The subject property is located at 42195 Shallow Point Drive in Avon, Dare County, North Carolina adjacent to Askins Creek and the Pamlico Sound. The property is an undeveloped lot located in the Askins Creek subdivision. The purpose of the proposed project is to construct a 4 bedroom single family residence with a pool, pool house in the 75' Area of Environmental Concern (75'AEC) and 4' x 30'walkway that connects to a 4' x 8' platform located on Askins Creek. A portion of the proposed house, pool and pool house will be constructed in Section 404 wetlands, therefore, we are proposing 3,204 square feet of wetland impacts as part of the proposed project. The 404 wetland line was verified on December 15, 2021 by Billy Standridge of the US Army Corp of Engineers. Yvonne Carver with the NC Division of Coastal Management verified there were no Coastal Wetlands within the fill area on December 7, 2021.
