Section 1. Facility Overview:
This facility is a minor facility (flow < 1 MGD) discharging 100% domestic wastewater with a design
capacity of 0.67 MGD. This WWTP consists of:
• 0.09 MGD package plant (dual trains at 0.045 MGD each) using dual:
• aeration basins
• clarifiers
• contact tanks with tablet chlorination and dechlorination (backup only)
• aerated sludge tanks
• 0.10 MGD package plant (dual trains at 0.05 MGD each) using dual:
• aeration basins
• clarifiers
• chlorine contact tanks with tablet chlorination and dechlorination (backup only)
• aerated sludge tanks
o one common equalization basin prior to both plants
o one common tertiary filter for both dual plants (2 cells) after clarification
• 0.48 MGD (three trains, each 0.16 MGD) each consisting of triple:
• equalization basins
• aeration basins
• clarifiers
• chlorine contact tanks with tablet chlorination (backup only)
• post aeration
• dechlorination
• aerated sludge tanks, and
• one filter unit per train (four cells)
with effluent from all treatment trains discharging through UV disinfection and a recording -type effluent
flow meter.
The facility has submitted an Authorization to Operate application for a reduced design capacity to 0.48
MGD. Upon receipt of the Engineer's Certificate for the 0.48 MGD design capacity, effluent limitations
and monitoring requirements will be as specified in section A. (1). Also, upon receipt of the Engineer's
Certificate the dual 0.09 MGD treatment train capacity and the dual 0.10 treatment capacity will no
longer be active treatment components; and may be repurposed or decommissioned.

• From reviewing the past permits, we found that the effluent limits for ammonia nitrogen were
changed in the 2011 permit renewal (See attached) due to the added Ammonia Toxicity
Reopener condition. The monthly average effluent limit for ammonia nitrogen was reduced to
0.5 mg/L throughout the year, and the daily maximum effluent limits were reduced to 2.9 mg/L
during the summer and 7.15 mg/L during the winter. The monthly average effluent limits for
ammonia nitrogen calculated from the wasteload allocation worksheet are 1.1 mg/L for summer
and 2.4 mg/L for winter. Since the effluents limits based on ammonia toxicity are tighter than the
limits calculated from the WLA worksheet, we determined that no change needed on the current
effluent limits, and thus no change to the final permit.

No sludge will be treated on any wastewater treatment plant site operated
by Aqua N.C., Western Division
Where practical, sludge removed from an Aqua N.C., Western
Division facility will be transported via a contract hauler to another
Aqua N.C., Western Division facility for the purpose of "seeding" a
new or under loaded plant.
Unusable (or "dead") sludge will be removed by a contract hauler and
properly disposed of in accordance with NCGS 14S-215.1. Contract
haulers used by Aqua N.C., Western Division will be required to
report the quantity of sludge transported and identify the location of
the proposed disposal site if the sludge is not taken to an existing
plant operated by Aqua N.C., Western Division. Aqua N.C., Western
Division has not entered into any agreement to accept sludge into its
facilities from plants not owned by them.
Aqua N.C., Western Division will keep records on the quantity of sludge
removed from each facility, the name of the contract hauler, and the
destination of the sludge (whether used in another plant or disposed of).
The information will be kept on file and will be made available to any
regulatory agency having jurisdiction over sludge treatment or disposal.
Aqua N.C., Western Division includes all of the facilities under the
jurisdiction of the Mooresville Regional Office.

Aqua North Carolina, Inc.
is hereby authorized to:
1. Continue to operate 0.48 MGD of the existing 0.67 MGD design capacity wastewater treatment
facility consisting of:
0.09 MGD package plant (dual trains at 0.045 MGD each) using dual:
• aeration basins
• clarifiers
• contact tanks with tablet chlorination and dechlorination (backup only)
• aerated sludge tanks
0.10 MGD package plant (dual trains at 0.05 MGD each) using dual:
• aeration basins
• clarifiers
• chlorine contact tanks with tablet chlorination and dechlorination (backup only)
• aerated sludge tanks
• one common equalization basin prior to both plants
• one common tertiary filter for both dual plants (2 cells) after clarification
0.48 MGD (three trains, each 0.16 MGD) each consisting of triple:
• equalization basins
• aeration basins
• clarifiers
• chlorine contact tanks with tablet chlorination (backup only)
• post aeration
• dechlorination
• aerated sludge tanks, and
• one filter unit per train (four cells)
with effluent from all treatment trains discharging through UV disinfection and a recording -
type effluent flow meter, located at the Country Woods WWTP (off Hemlock Drive, northwest of
Bakers) in Union County.
2. An Authorization to Operate application for a reduced design capacity to 0.48 MGD has been
submitted to the Division. Upon receipt of the Engineer's Certificate for the 0.48 MGD design
capacity, effluent limitations and monitoring requirements will be as specified in section A. (1).
Also, upon receipt of the Engineer's Certificate the dual 0.09 MGD treatment train capacity
and the dual 0.10 treatment capacity will no longer be active treatment components; and may
be repurposed or decommissioned; and
3. Should you want to expand above the 0.48 MGD design capacity, you must apply for and
obtain an Authorization to Construct from the Division. After receiving an Authorization to
Construct approval from the Division, construct, operate, and discharge at the expanded total
design treatment capacity of 0.67 MGD; and
4. Discharge from said treatment works via Outfall 001, at the location specified on the attached
map into Goose Creek [13-17-18], currently classified C, located within subbasin 03-07-12
[HUC: 0304010507] of the Yadkin -Pee Dee River Basin.

A. (3) PERMIT REOPENER CONDITION: AMMONIA TOXICITY & NUTRIENTS
[NCGS 143-215.1 (b)]
This permit may be reopened to impose further controls or restrictions upon the
discharge of ammonia and other nutrients to the receiving stream. Endangered
species in the Goose Creek watershed exhibit a high degree of sensitivity to
ammonia. Permit modification may be required in order to ensure viable aquatic
habitat with regard to instream ammonia concentrations.
Studies conducted within the Goose Creek watershed demonstrate episodic events of
elevated concentrations of nutrients (nitrogen and phosphorous) . High
concentrations of nutrients have the potential create conditions detrimental to
overall water quality and the health of aquatic life. Permit modification may be
required to include monitoring that will help ascertain the impact of the discharge
with respect to instream concentrations of nutrients and to require controls on
effluent nutrient concentrations should the discharge be found to be a significant
contributor to elevated nutrient levels within the receiving stream.
A. (4) ELECTRONIC REPORTING OF MONITORING REPORTS
[NCGS 143-215.1 (b)]
Federal regulations require electronic submittal of all discharge monitoring reports
(DMRs) and program reports and specify that, if a state does not establish a system
to receive such submittals, then permittees must submit monitoring data and
reports electronically to the Environmental Protection Agency (EPA) . The final
NPDES Electronic Reporting Rule was adopted and became effective on December
21, 2015.
NOTE: This special condition supplements or supersedes the following sections
within Part II of this permit (Standard Conditions for NPDES Permits):

• Section D. (2.) Reporting
• Section D. (6.) Records Retention
• Section E. (5.) Monitoring Reports
1. Reporting Requirements [Supersedes Section D. (2.) and Section E. (5.) (a)1
Effective December 21, 2016, the permittee shall report discharge monitoring data
electronically using the NC DWR's Electronic Discharge Monitoring Report (eDMR)
internet application.
Monitoring results obtained during the previous month(s) shall be summarized for
each month and submitted electronically using eDMR. The eDMR system allows
permitted facilities to enter monitoring data and submit DMRs electronically using
the internet. Until such time that the state's eDMR application is compliant with
EPA's Cross -Media Electronic Reporting Regulation (CROMERR), permittees will be
required to submit all discharge monitoring data to the state electronically using
eDMR and will be required to complete the eDMR submission by printing, signing,

and submitting one signed original and a copy of the computer printed eDMR to the

If a permittee is unable to use the eDMR system due to a demonstrated hardship or
due to the facility being physically located in an area where less than 10 percent of
the households have broadband access, then a temporary waiver from the NPDES
electronic reporting requirements may be granted and discharge monitoring data
may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms
approved by the Director. Duplicate signed copies shall be submitted to the mailing
address above. See "How to Request a Waiver from Electronic Reporting" section
below.
Regardless of the submission method, the first DMR is due on the last day of the
month following the issuance of the permit or in the case of a new facility, on the
last day of the month following the commencement of discharge.
Starting on December 21, 2020, the permittee must electronically report the
following compliance monitoring data and reports, when applicable:
• Sewer Overflow/Bypass Event Reports;
• Pretreatment Program Annual Reports; and
• Clean Water Act (CWA) Section 316(b) Annual Reports.
The permittee may seek an electronic reporting waiver from the Division (see "How to
Request a Waiver from Electronic Reporting" section below).
2. Electronic Submissions
In accordance with 40 CFR 122.41(1) (9), the permittee must identify the initial
recipient at the time of each electronic submission. The permittee should use the
EPA's website resources to identify the initial recipient for the electronic submission.
Initial recipient of electronic NPDES information from NPDES-regulated facilities
means the entity (EPA or the state authorized by EPA to implement the NPDES
program) that is the designated entity for receiving electronic NPDES data [see 40
CFR 127.2(b)].
EPA plans to establish a website that will also link to the appropriate electronic
reporting tool for each type of electronic submission and for each state. Instructions
on how to access and use the appropriate electronic reporting tool will be available
as well. Information on EPA's NPDES Electronic Reporting Rule is found at:

3. How to Request a Waiver from Electronic Reporting
The permittee may seek a temporary electronic reporting waiver from the Division.
To obtain an electronic reporting waiver, a permittee must first submit an electronic
reporting waiver request to the Division. Requests for temporary electronic reporting
waivers must be submitted in writing to the Division for written approval at least
sixty (60) days prior to the date the facility would be required under this permit to
begin submitting monitoring data and reports. The duration of a temporary waiver
shall not exceed 5 years and shall thereupon expire. At such time, monitoring data
and reports shall be submitted electronically to the Division unless the permittee re-
applies for and is granted a new temporary electronic reporting waiver by the
Division. Approved electronic reporting waivers are not transferrable. Only
permittees with an approved reporting waiver request may submit monitoring data
and reports on paper to the Division for the period that the approved reporting
waiver request is effective.

4. Signatory Requirements [Supplements Section B. (11.) (b) and Supersedes

All eDMRs submitted to the permit issuing authority shall be signed by a person
described in Part II, Section B. (11.)(a) or by a duly authorized representative of that
person as described in Part II, Section B. (11.)(b). A person, and not a position,
must be delegated signatory authority for eDMR reporting purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an
eDMR user account and login credentials to access the eDMR system. For more

Certification. Any person submitting an electronic DMR using the state's eDMR

Division personnel have reviewed and approved your application for renewal of the subject permit.
Accordingly, we are forwarding the attached NPDES discharge permit. This permit is issued pursuant
to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement
between North Carolina and the U.S. Environmental Protection Agency dated October 15, 2007 (or as
subsequently amended).
This final permit contains significant changes from the draft permit sent to you on July 16, 2008.
Following public notice of the draft permit, the Division received comments from the U.S. Fish and
Wildlife Service (USFWS) and the North Carolina Wildlife Resources Commission (NCWRC)
regarding the discharge and its potential effects on water quality in Goose Creek, especially as it pertains
to the viability of habitat for the Carolina heelsplitter (Lasmigona decorata), federally designated as a
endangered freshwater mussel, and other protected species that are known to be present in Goose Creek.
Additionally, during this same time period, the North Carolina Environmental Management Commission
had taken unto its consideration rules establishing a water quality management plan for"the Goose Creek
watershed. The Division considered the USFWS and NCWRC comments and applied the terms of the
Goose Creek rules (15A NCAC 02B .0601 - .0609) before finalizing the content of the permit to be
reissued.
While the final permit does differ from the original draft, it contains one significant change from the
updated draft permit sent to you in a February 25, 2011 e-mail (from John Hennessy, supervisor of the
Division's Compliance & Expedited Permitting Unit). In the final permit, language has been added to
Section A. (4), the Ammonia Toxicity Reopener condition, that states the permit may also be opened to
address matters involving nutrient levels in the Goose Creek watershed. Stream sampling studies have
indicated the watershed may experience elevated nutrient concentrations at times. The reopener clause
provides for a reevaluation of the permit to ensure protection of water quality standards.

Please be aware that this permit reduces the monthly average effluent limit for ammonia nitrogento.0.5
mg/L throughout the year. The daily maximum effluent limit for ammonia nitrogen has been reduced to
2.90 mg/L during the summer months (April — October) and to 7.15 mg/L during the winter months
(November — March).
Please also note that Goose Creek is listed as an impaired waterbody on the North Carolina 303(d)
Impaired Waters List. This means that the stream does not meet all water quality standards. Addressing
impaired waters is a high priority for the Division, and instream data will continue to be evaluated. If
there is noncompliance with permitted effluent limits and stream impairment can be attributed to your
facility, then mitigative measures may be required.
If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless
such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may
require modification or revocation and reissuance of the permit. This permit does not affect the legal
requirements to obtain other permits which may be required by the Division of Water Quality or permits

A. (3.) TREATMENT WORKS RECLASSIFICATION -- Class II to Class III
Upon reaching an average flow (based on a calendar year average) equal to or exceeding 0.280
MGD (80 % of permitted capacity), the Permittee shall:
1) notify the Division in writing; and
2) increase effluent monitoring frequencies to 3/Week according to Section A. (2.).
The Permittee shall thereafter maintain compliance required of a Class III facility permitted at
0.670 MGD, unless request is made and granted to modify this permit.
A. (4.) PERMIT REOPENER: AMMONIA TOXICITY & NUTRIENTS
This permit may be reopened to impose further controls or restrictions upon the discharge of ammonia
and other nutrients to the receiving stream. Endangered species in the Goose Creek watershed exhibit a
high degree of sensitivity to ammonia. Permit modification may be required in order to ensure viable
aquatic habitat with regard to instream ammonia concentrations.
Studies conducted within the Goose Creek watershed demonstrate episodic events of elevated
concentrations of nutrients (nitrogen and phosphorous). High concentrations of nutrients have the
potential create conditions detrimental to overall water quality and the health of aquatic life. Permit
modification may be required to include monitoring that will help ascertain the impact of the discharge
with respect to instream concentrations of nutrients and to require controls on effluent nutrient
concentrations should the discharge be found to be a significant contributor to elevated nutrient levels
within the receiving stream.

Thank you for talking with me and answering my questions regarding the NPDES draft permits for Country Woods,
Oxford Glen, and Ashe Plantation.
Below are the couple of comments I indicated I would send to you.
The Technical Support Document (TSD) for the Goose Creek Watershed Site -Specific Management Plan developed by the
U.S. Fish and Wildlife Service, N.C. Wildlife Resources Commission, and. N.C. Natural Heritage Program recommends an
acute water quality standard of 1.75 mg/L total ammonia as N. The draft permits have daily maximum limits for
ammonia of 2.9 mg/L (summer) and 7.15 mg/L (winter). I understand these daily maximums are derived from EPA's
recent guidance on ammonia, but we are concerned these exceed those recommended in the TSD. I am not sure exactly
how the 1.75 mg/L included in the TSD was derived and whether it is temperature dependent, but Tom Augspurger with
USFWS probably could provide those details.
We recognize there are no water quality standards for copper or nutrients as recommended in the TSD, or for endocrine
disrupting compounds (EDC), and therefore will not be included in the permits. However, each of the permits includes a
re -opener for ammonia, would it be possible to include a re -opener clause for copper, nutrients or EDC stating if water
quality standards are implemented then the permit can be re -opened and the new standards applied rather than
waiting until permit renewal?

I have previously called each of you this afternoon to alert of this coming email. As I discussed on the phone, the DWQ is
preparing to issue NPDES permit renewals for the referenced WWTPs below located in the Goose Creek watershed:

I apologize if this email is outside the normal process, but I had a couple of "do something even if it's wrong" parents.
Seriously, I am new to my present position (Supervisor for the unit charged with processing these permits) and as part of
getting up to speed I am trying to identify areas of workload backlog to process and complete. The permit renewals for
these facilities fall into that category.
At present, the attached permits have been reviewed, submitted for public comment, and the comments received and
processed. Ordinarily, we would proceed to finalizing and completing a final permit. However, as you all also aware,
Goose Creek is not an ordinary watershed and as such a number of issues have arisen over the past few years that
potentially affect our final permit. I offer this up not as excuse as to why the issuance of these permits has been
delayed, but rather as an explanation as to where we presently are in the process. It seemed to me that given the
amount of time since these projects were last commented on, and trying to process them in the most efficient manner,
sending an email with draft permit attached was best. For your convenience, I have attached copies of the draft permits
for review. So you know what the Division's plan of action entails, it is our expectation that these permits will be
approved by March 315t. I apologize if that seems like a quick turnaround time. However, these permits have been
sitting for a significant amount of time and we are trying to get them processed and approved.
After you have had a chance to review the attached draft permits, please feel free to respond to either Bob Sledge at

EPA is publishing draft national recommended ambient water quality criteria for the protection of
aquatic life for ammonia. These criteria are based on EPA's Guidelines for Deriving Numerical
National Water Quality Criteria for the Protection of Aquatic Organisms and Their Uses (1985), EPA
822/R-85-100. EPA is publishing these draft criteria in order to receive scientific input from the
public.
What are aquatic life water quality criteria?
Aquatic life water quality criteria are numeric values that protect aquatic life from the harmful
effects of pollutants in surface water. Under section 304(a) of the Clean Water Act (CWA), water
quality criteria are based solely on data and scientific judgments about the relationship between
pollutant concentrations and environmental and human health effects; economic or social impacts do
not influence criteria recommendations.
EPA's national recommended water quality criteria provide guidance to states, territories and
authorized tribes in adopting water quality criteria that meet the requirements of the CWA. They are
not regulations themselves and do not impose legally binding requirements on EPA, states,
territories, authorized tribes or the public.
How were these water quality criteria for ammonia derived?
EPA derived these aquatic life water quality criteria for ammonia based on the Agency's 1985 Aquatic
Life Criteria Guidelines. These guidelines provide consistent, scientifically -based procedures for
deriving ambient water quality criteria for the protection of aquatic organisms and their uses.
Toxicity data and other information on the effects of ammonia were obtained from reliable sources
and subjected to both internal and external peer review. The draft criteria update incorporates all
toxicity data available since the last criteria update including new data on larval and juvenile
freshwater mussels to reflect the latest science.
What are the draft aquatic life water quality criteria for ammonia?
Freshwater: Freshwater aquatic organisms and their uses should not be affected unacceptably if —
1. The one -hour average concentration of total ammonia nitrogen (in mg N/L) does not exceed,
more than once every three years on the average, the CMC (acute criterion), which is dependent on
the aquatic organisms present.
2A. The thirty -day average concentration of total ammonia nitrogen (in mg N/L) does not exceed,
more than once every three years on the average, the CCC (chronic criterion), which is dependent
on the aquatic organisms present.
2B. In addition, the highest four -day average within the 30-day period should not exceed 2.5 times
the CCC.
The acute and chronic criteria concentrations are expressed as functions of temperature and pH,
such that values differ across sites, and differ over time within a site. See draft criteria document
(pp. 34-38) for actual equations describing this function. As temperature decreases, invertebrates,
but not fish, become less sensitive to ammonia, and below a particular temperature threshold, fish
become the most sensitive genera.

Acute Criteria: At pH=8, where freshwater mussels are present, the criterion concentration ranges
from 1.90 mg N/L at 30° C to 9.81 mg N/L at 0° C. At pH=8, where freshwater mussels are absent
the criterion concentration ranges from 3.29 mg N/L at 30° C to 9.99 mg N/L at 0° C.
Chronic Criteria: At pH=8, where freshwater mussels are present, irrespective of whether fish ELS
are present or absent, the criterion ranges from 0.186 mg N/L at 30° C to 0.817 mg N/L at 0° C.
When freshwater mussels are absent, the values range from 1.33 mg N/L at 30° C to 2.32 mg N/L at
0° C at times when fish ELS are present, and from 1.33 mg N/L at 30° C to 5.87 mg N/L at 0° C at
times when fish ELS are absent.

Note: These criteria values are appropriate at the standard normalized pH and temperature; the
criteria values are a function of the variability of pH and temperature.
The water quality criteria for ammonia saltwater are not being updated at this time.

15A NCAC 02B .0601 SITE SPECIFIC WATER QUALITY MANAGEMENT PLAN FOR THE GOOSE
CREEK WATERSHED (YADKIN PEE-DEE RIVER BASIN): PURPOSE
The Goose Creek watershed in the Yadkin Pee -Dee River Basin provides habitat for an aquatic animal species that
is listed as federally endangered by the U.S. Fish and Wildlife Service under the provisions of the Endangered
Species Act, 16 U.S.C. 1531-1544. Maintenance and recovery of the water quality conditions required to sustain
and recover the federally -listed endangered species thereby protects the biological integrity of the waters. The
Goose Creek watershed, which includes Goose Creek (Index # 13-17-18), Stevens Creek (Index # 13-17-18-1),
Paddle Branch (Index # 13-17-18-2), Duck Creek (Index # 13-17-18-3) and all tributaries, shall be protected by the
site -specific management strategy described in Rules .0601 through .0609 of this Section.
The purpose of the actions required by this site -specific management strategy is for the maintenance and recovery of
the water quality conditions required to sustain and recover the federally endangered Carolina heelsplitter
(Lasmigona decorata) species. Management of the streamside zones to stabilize streambanks and prevent
sedimentation are critical measures to restore water quality to sustain and enable recovery of the federally
endangered Carolina heelsplitter. Site -specific management strategies shall be implemented to:
(1) control stormwater for projects disturbing one acre or more of land as described in Rule .0602,
(2) control wastewater discharges as described in Rule .0603,
(3) control toxicity to streams supporting the Carolina heelsplitter as described in Rule .0604, and
(4) maintain riparian buffers as described in Rules .0605 through .0609.

TOXICITY INCLUDING AMMONIA
No activity that results in direct or indirect discharge is allowed if it causes toxicity to the Carolina heelsplitter
(Lasmigona decorata) endangered mussel. For any direct or indirect discharge that may cause ammonia toxicity to
the Carolina heelsplitter freshwater mussel, action shall be taken to reduce ammonia (NH3-N) inputs to achieve 0.5
milligrams per liter or less of total ammonia based on chronic toxicity defined in 15A NCAC 02B .0202. This level
of total ammonia is based on ambient water temperature equal to or greater than 25 degrees Celsius.

Country Woods Wastewater Treatment Plant (WWTP), Goose Creek, Union County,
NPDES Permit No. NC0065684
Biologists with the North Carolina Wildlife Resources Commission have reviewed the public
notice concerning re -issuance of the referenced NPDES permit. Our comments are provided in
accordance with provisions of the Clean Water Act of 1977 (as amended), Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d), North Carolina General Statutes (G.S. 113-131 et
seq.), and North Carolina Administrative Code 15A NCAC 10I.0102.
Aqua North Carolina, Inc. has applied for a renewal of its NPDES permit to discharge treated
wastewater into Goose Creek. The Public Notice indicates BOD5, ammonia, fecal coliform and total
residual chlorine are water quality limited.
There are records for the federal and state endangered Carolina heelsplitter (Lasmigona decorata)
and the federal species of concern and state endangered Carolina creekshell (Villosa vaughaniana) and
Atlantic pigtoe (Fusconaia masoni) in Goose Creek. Portions of Goose Creek are federally designated
critical habitat for the Carolina heelsplitter. In addition, Goose Creek is on the 303(d) list of impaired
waters.
Due to the presence of the Carolina heelsplitter, a Site Specific Water Quality Management Plan
is being developed for Goose Creek and Duck Creek under provisions of the North Carolina Procedures
for Assignment of Water Quality Standards (15A NCAC 2B .0100) section .0110 Considerations for
Federally -listed Threatened or Endangered Species. The U.S. Fish and Wildlife Service, N.C. Wildlife
Resources Commission, and N.C. Natural Heritage Program developed a Technical Support Document
for this Site -Specific Management Plan. The Technical Support Document details the water quality
concerns and provides recommendations for addressing these concerns to protect aquatic resources,
particularly listed species, in the Goose Creek watershed. More specifically, water quality standards for
ammonia, copper, nitrate -nitrite and phosphorus and revisiting point source permit loads are of particular
concern.

Therefore, we recommend the following conditions be incorporated into the permit to reduce
impacts to aquatic and terrestrial wildlife resources and in particular to listed species.
1. If the WWTP uses chlorine disinfection, the disinfection system should be replaced with an
ultraviolet light or ozone system. In addition, there should be a permit condition that excludes
any use of chlorine and possession of chlorine at the WWTP even for emergency wastewater
discharge treatment or fecal coliform limit compliance. However, if chlorine is permitted for
emergency wastewater discharge treatment, then when chlorine is used, the facility should report
these instances and appropriate sampling regimes taken of the wastewater discharge to document
full compliance of the facility with the permit limits for total residual chlorine and de -chlorination
chemicals. Chlorine is acutely toxic to aquatic organisms and can form secondary compounds
that are detrimental to aquatic life. Valenti (2006) concluded the impact of long term exposure to
low doses of chlorine may impact juvenile mussels and reduce the chance of them being recruited
to the reproducing population.
2. An acute water quality standard of 1.75 mg/1 total ammonia as N and chronic standard of 0.50
mg/1 (based on the 90th percentile pH of 8 for Goose Creek).
3. An acute water quality standard of 3.6 ug/1 copper and chronic standard of 2.2 ug/1.
4. Nutrient targets of 0.4 mg/1 for nitrate -nitrite and a 0.1 mg/1 for total phosphorus. While nitrate
and phosphorus are not as important from a toxicity standpoint as ammonia, these are related to
excessive nutrient loading, nuisance algal blooms and dissolved oxygen depletion.
5. Portions of Goose Creek do not have flow for significant periods, particularly during recent and
ongoing droughts, and the dilution potential at these times is non-existent. Therefore, the low
flow statistics used to establish the extent of expected dilution should be revised during permit
issuance. Permit limits should reflect this lack of dilution during all low flow conditions. If
necessary, limits should be effective at the "end of pipe" to protect aquatic species and habitats
for listed species.
6. Evaluate alternatives to a surface wastewater discharge while retaining the water in the Goose
Creek system (e.g., land application). Although connecting to sanitary sewer service is an
alternative, this would remove the water from the system and reduced base flows in Goose Creek
are having a significant adverse affect on the Carolina heelsplitter and its host species.
7. Recent studies have shown that endocrine disrupting chemicals (EDC) in treated wastewater can
inhibit reproduction and cause feminization of mussels and fish. We recommend studies be
conducted to document the levels of EDCs in this wastewater discharge through NPDES permit
and N.C. Division of Water Quality ambient studies. Should either monitoring or studies
document the presence of EDCs at levels that can affect aquatic species, treatment train measures
should be implemented without delay to reduce or eliminate EDCs from wastewater prior to
discharge. Dr. W. Gregory Cope with the Department of Environmental and Molecular
Toxicology at N.C. State University has been studying the effects of these compounds in
wastewater discharges on aquatic species and may be contacted to discuss past studies and study

5. Directions to site: Travel east on S.R. 1004 (lawyers Road) approximately 1.2 miles from the
Union -Mecklenburg County line. Turn right onto Redwood Drive and travel approximately
0.65 mile. Turn left onto Hemlock Drive and travel 0.1 mile. The wastewater treatment
plant is located on the left side of Hemlock Drive.

facility is not located within the 100-year flood plain.

c. Describe receiving stream features and pertinent downstream uses: Goose Creek in
this area is usually a small, slow moving stream. There are several other discharges
in the Goose Creek Watershed. Goose Creek has been listed on the 303(d) list as a
biologically impaired waterbody. Also, Goose Creek is considered environmentally
sensitive due to the presence of a federally endangered species, the Carolina
heelsplitter. Downstream uses are typical for class C waters.
PART II - DESCRIPTION OF DISCHARGE AND TREATMENT WORKS

issued in the previous two years: There have been no ATCs issued to this facility in
the past two years.
e. Please provide a description of existing or substantially constructed wastewater
treatment facilities: The existing facilities consist of flow equalization, a dual -
train 0.09 MGD WWTP, a dual -train 0.100 MGD WWTP, and a three -train 0.480
MGD WWTP. All trains have aeration, clarifier, tablet chlorination, post
aeration, tertiary filters, dechlorination and aerated sludge tanks, flow meter, and a
stand by power generator.
f. Please provide a description of proposed wastewater treatment facilities: There are
no proposed WWT facilities at this time.
g. Possible toxic impacts to surface waters: Chlorine is added to the waste stream,
however, dechlorination is provided.
h. Pretreatment Program (POTWs only): N/A

2. Residuals handling and utilization/disposal scheme: The permittee has contracted with
BIOTECH, Inc. for the removal and ultimate disposal of residuals produced at this
facility. Waste sludge is removed and transported to a Charlotte -Mecklenburg Utility
Department WWT system for final disposal.
3. Treatment plant classification: Class III (based on a Division re -rating in 2001, which was
subsequently challenged by the permittee. This case was eventually dropped due to
inactivity.

PART III - OTHER PERTINENT INFORMATION
1. Is this facility being constructed with Construction Grant Funds or are any public monies
involved? Public monies were not used in the construction of this facility.

3. Important SOC or Compliance Schedule dates: This facility is neither under an SOC nor
is one being considered at this time.
4. Alternative Analysis Evaluation: There is currently no known alternative to a discharge
at this time.
PART IV - EVALUATION AND RECOMMENDATIONS
Aqua North Carolina is applying to renew the subject permit to discharge treated
domestic wastewater. There have been no changes to the WWTP and or the permit since the
permit was last renewed. The wastewater treatment plants appeared to be in good operational
condition during the site investigation. No detrimental effect on the stream was observed by the
discharge.

0.670 MGD extended aeration WWTP consising of seven (7) parallel treatment trains, as
follows: A dual -train 0.090 MGD WWTP, a dual -train 0.100 MGD WWTP, and a three -train
0.480 MGD WWTP. Each train consists of equalization basin, aeration basin, clarifier,
tablet chlorination and dechlorination, post aeration, aerated sludge tanks and tertiary
filters. A UV disinfection system has been installed as the primary means of disinfection
(ATC issued 12/03/04). Facilities are designed to meet the following Monthly
Average/Daily Maximum NPDES Permit effluent limitations (mg/1): BOD (winter)
18.0/27.0, BOD (summer) 10.0/15.0, TSS 30.0/45.0, NH3 as N (winter) 2.0/10.0, NH3 as

Aqua North Carolina has a contractual agreement with BIOTECH, NC (8531 Old Dowd Road, Charlotte,
NC 28214) for the removal and disposal of sludge generated at Aqua North Carolina's Country Woods
