Amschler (Crystal.C.Amschler@usace.army.mil); Leslie, Andrea J Subject: Request for Additional Information, Brooks Cove Road, Buncombe County (DWR Project #20210403) Britten, On January 13, 2022, the Division of Water Resources (Division) received your application requesting a 401 Water Quality Certification from the Division for the subject project. The Division has determined that your application is incomplete and cannot be processed. The application is on -hold until all of the following information is received: 1. The agent authorization form provided with the PCN is signed by a former property owner. Please provide an agent authorization form signed by the project applicant. [15A NCAC 02H .0502(a)(11)] 2. The Division recommends against the use of reinforced concrete pipe (RCP) for the stream crossing as it is unlikely to hold stream substrate and provide for aquatic organism passage at the proposed slope. Can the RCP be replaced with corrugated pipe? Please note if the RCP is used for the stream crossing and fails to hold stream substrate, the Division will require the culvert be modified with a sill, or similar structure, to hold stream substrate. [15A NCAC 02H .0506(b)(3)] Pursuant to Title 15A NCAC 02H .0502(e), the applicant shall furnish all of the above requested information for the proper consideration of the application. Please provide your response by February 25, 2022. If all of the requested information is not received, the Division will be unable to approve the application and it will be denied as incomplete. The denial of this project will necessitate reapplication to the Division for approval, including a complete application package and appropriate fee.
