Paul Wilms, Director of the Division of Environmental Management, make the following: I. FINDINGS OF FACT: A. Ron Muse operates Maggie Gem Mine, which is located in Haywood County, North Carolina. Maggie Gem Mirib is a commercial operation for tourist trade which utilizes quarry materials mined in and around Haywood County, but not at the subject site. B. On March 2, 1988, staff from the Asheville Regional Office (ARO) inspected the subject site at the request of Ron Muse to determine what type of permit from the Environmental Management Commission (EMC) would be required for the construction and operation of a wastewater recycle system for a flume line type mining operation which Mr. Muse proposed to construct at the subject site. The ARO investigator advised Mr. Muse that a non -discharge permit would be required. C. An engineering firm retained by Mr. Muse contacted the ARO within ten (10) days after the March 2, 1988, inspection to inquire about the requirements the proposed treatment system was required to meet in order to be permitted. ARO staff advised the engineering firm of the general design of the system.. D. Within ten (10) days after the engineering firm contacted the ARO, the ARO telephoned Mr. Muse and reiterated the requirement that a permit be obtained. E. On August 5, 1988, ARO staff inspected the subject facility and observed that a wastewater treatment and recycle system for the flume line mining operation had been constructed and was being operated. -2- Kotice of Noncompliance was sent to Mr. Muse by the August 4, 1988. The Notice also advised that all activities resulting from the use of the wastewater treatment system should be immediately suspended until a Non -Discharge Permit could be obtained. G. Upon receipt of the Notice on August 10, 1988, Mr. Muse telephoned the ARO and stated that he intended to submit a permit application for the system, but that he -probably would not cease operation of the system until the permit was issued due to financial considerations. H. Follow-up inspections of the Maggie Gem Mine conducted by ARO staff on August 13, 1988, August 16, 1988, and August 22, 1988, revealed that the wastewater treatment and recycle system was in operation on each of those dates. I. Staff costs and expenses associated with detecting the violations,.defining their nature and extent and bringing the enforcement action totalled $42.78 . Based upon the above Findings of Fact, I make the following: II. CONCLUSIONS OF LAW: A. Ron Muse d/b/a Maggie Gem Mine is a "person" within the meaning of G.S. 143-215.6 pursuant to G.S. 143-212(4). B. General Statute 143-215.1(a)(2) provides that no person shall construct or operate any sewer system, treatment works, or disposal system within the State without having applied for and obtained a permit from the EMC. C. The wastewater treatment and recycle system operated by Ron Muse at Maggie Gem Mine constituted a treatment works within the meaning of G.S. 143-213(17) and a disposal system within the meaning of G.S. 143-213(10). D. Ron Muse d/b/a Maggie Gem Mine violated G.S. 143-215.1(a)(2) on one (1). occasion on or about August 5, 1988, by constructing and operating a treatment works without having applied for and obtained a permit from the EMC. E. General Statute 143-215.6(a)(1) provides that a civil penalty of not more than ten thousand dollars per violation may be assessed against a person who is required to but fails to secure a permit required by G.S. 143-215.1. F. General Statute 143-215.3(a)(9) provides that the reasonable costs of any investigation, inspection or monitoring survey may be assessed against a person who violates any regulations, standards,,or limitations adopted -3- the Environmental Management Commission or violates any ms or conditions of any permit issued pursuant to G.S. -211 1, or special order or other document issued pursuant to G.S. 143-215.2. G. The Director, Division of Environmental Management, pursuant to Rule 15 NCAC 23 .0003, has the authority to assess civil penalties. Based upon the above Findings of Fact and Conclusions of Law, I make the following: III. DECISION• Pursuant to G.S. 143-215.6 and 15 NCAC 2J.0006, in determining the amount of the penalty, I have taken into account the Findings of Fact and Conclusions of Law and considered the degree and extent of harm caused by the violation, and the cost of rectifying the damage. (Old Pressley Sapphire Mine) Non -Discharge Permit WQ0000125 Haywood County, North Carolina Dear Mr. Trantham: The Compliance Evaluation Inspection that I conducted August 7, 1990, showed the wastewater treatment and recycle system serving the Old Pressley Sapphire Mine to be operating properly with exception of a small seepage from the approximately 4000 gallon capacity flume water supply (storage) pond at the head of the system. The leakage resulted in a small discharge to the surface waters of North Carolina. I understand that this pond has since been sealed and the seepage problem corrected. Other routine operation and maintenance to the system involving cleaning of the basins and servicing of the recycle equipment appears satisfactory. Compliance with Permit No. WQ0000125 is noted. As result of our meeting in this office on 8/16/90, your request to install and use a closed, steel tank (approximate capacity 2000 gallons) as the main supply source for the flume water line has been reviewed and found acceptable. This vertical tank will be anchored to a 6 ft by 12 ft pad of reinforced concrete and fitted with proper controls for operation of the recycle equipment. Access for routine cleaning and maintenance will be provided by a 1_5-inch by 11-inch entry manhole near the bottom of the tank. The 4-inch discharge line from this tank will be connected with control valves to the existing flume water supply line. The existing storage pond will be used as backup. As this project is considered a minor engineering modification to the system, no additional approvals from this Agency will be required. Sludge renewals are based on total acres of land permitted. The Environmental Management Commission adopted revised rules on October 1, 1990 ('attached), requiring the payment of an annual fee for most permitted facilities. You will be billed separately for that fee (if applicable), after your permit is approved. Please be advised that this permit must not be allowed to expire. If the renewal request is not received within 180 days prior to the permit's expiration date as required by 15 NCAC 2H .0211, you will be assessed an automatic civil penalty. This civil penalty by North Carolina General Statute may be as much as $10,000 per day. If a permit renewal request is not received 180 days before permit expiration, a civil penalty of at least $250 will be assessed. In addition, any permit renewal request received after the permit's expiration date will be considered as a new application and will be required to pay the higher permit application fee. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall keep an inspection log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available upon request to the Division of Environmental Management or other permitting authority. 13. Any duly authorized officer, employee, or representative of the Division of Environmental Management may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records that must be kept under the terms and conditions of this permit; or may obtain samples of groundwater, surface water, or leachate. 14. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the. Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205 (c)(4)• 15. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Environmental Management in accordance with_ North Carolina General Statute 143-215.6A to 143-215.6C. 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 17. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 2 18. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (704) 251-6452 as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank; the known passage of a slug of hazardous substance through the facility; or any other unusual circumstances. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate wastewater treatment such as mechanical or electrical failures of pumps, aerators, compressors, etc. c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by- pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility. d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within 15 days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 19. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge. (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility -at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. 20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension: Upon receipt of the request, the Commission will review the adequacy of the facilities described therein, and if warranted, will extend the permit for such period of time and under such conditions and limitations as it may deem appropriate. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection log or summaryincluding at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division of Water Quality or other permitting authority, upon request. 13. Any duly authorized officer, employee, or representative of the Division of Water Quality may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 14. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 15: Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality in accordance with North Carolina General Statute 143-215.6(a) to 143-215.6(c). 16. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction. 17. A set of approved plans and specifications for the subject project must be retained by the Permittee for the life of this project. 18. Noncompliance, Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (704) 254-6208, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: 2 a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage -of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process unit failure, due to known or unknown reasons, that renders the facility incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 19. Upon classification of the facility by the Certification Commission, the Permittee shall employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of the wastewater treatment facilities. The operator must hold a certificate of the type and grade at least equivalent to or greater than the classification assigned to the wastewater treatment facilities by the Certification Commission. The Permittee must also employ a certified back-up operator of the appropriate type and grade to comply with the conditions of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at least weekly and each Class II, III, and IV facility at least daily, excluding weekends and holidays, and must properly manage and document daily operation and maintenance of the facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202. 20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. '2. This permit is effective only with respect to the nature and volume of wastes described in the application and other supporting data. 3. The facilities shall be properly maintained and operated at all times. 4. This permit is not transferable. In the event there is a desire for the facilities to change ownership, or there is a name change of, the Permittee, a formal permit request must be submitted to the Division of Water Quality (Division) accompanied by an application fee, documentation from the parties involved, and other supporting materials as may be appropriate. The approval, of the request will be considered on its merits and may or may not be approved. 5. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those actions that may be required by this Division, such as the construction of additional or replacement treatment or disposal facilities. 6. The residuals generated from these treatment facilities must be disposed in accordance with General Statute 143-215.1 and in a manner approved by the Division. 7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages to surface or groundwaters resulting from the operation of this facility. 8. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited. 10. Freeboard in the settling ponds shall not be less than two feet at any time. 11. Any monitoring deemed necessary by the Division to insure surface and ground water protection will be established and an acceptable sampling reporting schedule shall be followed. 12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to insure proper operation of the subject facilities. 13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent malfunctions and deterioration, operator errors and discharges which may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. The Permittee shall maintain an inspection ,log or summary including at least the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. This log of inspections shall be maintained by the Permittee for a period of three years from the date of the inspection and shall be made available to the Division or other permitting authority, upon request. 14. Any duly authorized officer, employee, or representative of the Division may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the recycle system at any reasonable time for the purpose of determining compliance with this permit, may inspect or copy any records that must be maintained under the terms and conditions of this permit, and may obtain samples of groundwater, surface water, or leachate. 15. The annual administering and compliance fee must be paid by the Permittee within thirty (30) days after being billed by the Division. Failure to pay the fee accordingly may cause the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205 (c)(4). 16. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division in accordance with North Carolina General Statute 143-215.6A to 143- 215.6C. 17. The issuance of this permit does not exempt the Permittee from complying with any and all statutes, rules, regulations, or ordinances which may be imposed by other government agencies (local, state, and federal) which have jurisdiction, including but not limited to applicable river buffer rules in 15A NCAC 2B.0200, erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under the Division's General Permit NCGO10000, and any requirements pertaining to wetlands under 15A NCAC 2B .0200 and 2H .0500.20. 18. Noncompliance Notification: The Permittee shall report by telephone to the Asheville Regional Office, telephone number (828) 296- 4500, as soon as possible, but in no case more than 24 hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: 2 a. Any occurrence at the wastewater treatment facility which results in the treatment of significant amounts of wastes which are abnormal in quantity or characteristic, such as the dumping of the contents of a basin or tank, the known passage of a slug of hazardous substance through the facility, or any other unusual circumstances; b. Any process, unit failure, due to known or unknown reasons, that renders the facility, incapable of adequate wastewater treatment, such as mechanical or electrical failures of pumps, aerators, compressors, etc.; c. Any failure of a pumping station, sewer line,. or treatment facility resulting in a by-pass directly to receiving waters without treatment of all or any portion of the influent to such station or facility; or d. Any time that self -monitoring information indicates that the facility is not in compliance with its permit limitations. Occurrences outside normal business hours may also be reported to the Division's Emergency Management personnel at telephone number (800) 858-0368, or (019) 733-3300. Persons reporting such occurrences by telephone .shall also file a written report in letter form within five (5) days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 21. Upon classification of the wastewater treatment and spray irrigation facilities by the Water Pollution Control System Operators Certification Commission (WPCSOCC), the Permittee shall designate and employ a certified operator to be in responsible charge (ORC) and one or more certified operator(s) to be back-up ORC(s) of the facilities in accordance with 15A NCAC 8G .0201. The ORC shall visit the facilities in accordance with 15A NCAC 8G .0204 or as specified in this permit and shall comply with all other conditions specified in these rules. 22. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its extension. This permit shall be effective from August 1, 2015 until'July 31, 2020, shall void Permit No. WQ0000125 issued August 30, 2006, and shall be subject to the following specified conditions and limitations: I. SCHEDULES No later than six months prior to the expiration of this permit, the Permittee shall request renewal of this permit on official Division forms. Upon receipt of the request, the Division will review the adequacy of the facilities described therein, and if warranted, will renew the permit for such period of time and under such conditions and limitations as it may deem appropriate. Please note Rule 15A NCAC 02T .0105(d) requires an updated site map to be submitted with the permit renewal application. [15A NCAC 02T .0105(d), 02T .0106, 02T .0109, and 02T .0115(c)j II. PERFORMANCE STANDARDS The subject non -discharge facilities shall be effectively maintained and operated at all times so there is no discharge to the surface waters, nor any contravention of groundwater or surface water standards. In the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions due to improper operation and maintenance, the Permittee shall take immediate corrective actions including Division required actions, such as the construction of additional or replacement wastewater treatment or recycle facilities. This permit shall not relieve the Permittee of their responsibility for damages to groundwater or surface water resulting from the operation of this facility. [15A NCAC 02B .0200, 02L .0100] M. OPERATION AND MAINTENANCE REQUIREMENTS 1. The facilities shall be properly maintained and operated at all times. The facilities shall be effectively maintained and operated as a non -discharge system to prevent the discharge of any wastewater resulting from the operation of this facility. The Permittee shall maintain an Operation and Maintenance Plan, which at a minimum shall include operational functions, maintenance schedules, safety measures and a spill response plan. [ 15A NCAC 02T .1007] 2. Upon the Water Pollution Control System Operators Certification Commission's (WPCSOCC) classification of the subject non -discharge facilities, in accordance with 15A NCAC 08G .0200 the Permittee shall designate and employ a certified operator in responsible charge (ORC) and one or more certified operator(s) as back-up ORC(s). The ORC or their back-up shall visit the facilities in accordance with 15A NCAC 08G .0200, and shall. comply with all .other conditions specified in the previously cited rules. [i 5A NCAC 02T .0117] 3. Public access to the wastewater treatment facilities and closed -loop recycle system shall be prohibited. [15ANCAC 02T .1000(a)(1)] 4. The residuals generated from the wastewater treatment facilities shall be disposed or utilized in accordance with 15A NCAC 02T .1100. The Permittee shall maintain a residual management plan pursuant to 15A NCAC 02T .1008. [15A NCAC .02T .1008, 02T .1100] 5. Diversion or bypassing of untreated or partially treated wastewater from the treatment facilities is prohibited., [15A NCAC 02T .0108(b)(1)] IV. MONITORING AND REPORTING REQUIREMENTS 1. Any Division -required monitoring (including groundwater, plant tissue, soil and surface water analyses) necessary to ensure groundwater and surface water'protection shall be established, and an 'acceptable sampling reporting schedule shall be followed. [15A NCAC 02T .0108(c)] 2. A record shall be maintained of all residuals removed from this facility. This record shall be maintained at the facility for a period of no less than. five years, and shall be made available to the Division upon request. At a minimum, this record shall include: a. Name of the.residuals hauler; b. Non -Discharge permit number authorizing the residuals disposal, or a letter from a municipality . agreeing to accept the residuals; c. Date the residuals were hauled; and d. Volume of residuals removed. [15A NCAC 02T .0108(b)(1)] 3. Noncompliance Notification: The Permittee. shall report by telephone to the Asheville Regional Office, telephone number (828) 296-4500, as soon as possible, but in no case. more than ,24 hours, or on the. next working day following -the occurrence or first knowledge. of the occurrence of any of the. following: a. Any process unit failure (e.g., mechanical, electrical, etc.), due to known or unknown reasons, rendering the facility incapable of adequate wastewater treatment. c. Any facility failure resulting in a by-pass directly to receiving surface waters. d.__Ai y—lime self-monitoring--indicates_the—facility_has_gone_out_oLcompliance with_.its_permit limitations. Any emergency requiring immediate reporting (e.g., discharges to surface waters, imminent failure of a storage structure, etc.) outside normal business hours shall be reported to the Division's'Emergency Response personnel at telephone number (800) 662-7956, (800) 858-0368, or (919) 733-3300. Persons reporting such occurrences by telephone shall also file a written report in letter form within five days following first knowledge of the occurrence. This report shall outline the actions taken or proposed to be taken to ensure the problem does not recur. [15A NCAC 02T .0105(1), 02T .0108(b)(1)] V. INSPECTIONS 1. The Permittee shall provide adequate inspection and maintenance to ensure proper operation of the wastewater treatment and recycle facilities. [15A NCAC 02T .0108(b)] 2. The Penmittee or their designee shall inspect the wastewater treatment and recycle facilities to prevent malfunctions, facility deterioration and operator errors resulting in discharges, which may cause the release of wastes to the environment, a threat to human health or a public nuisance. The Permittee shall maintain an inspection log that includes, at a minimum, the date and time of inspection, observations made, and any maintenance, repairs, or corrective actions taken. The Permittee shall maintain this inspection log for a period of five years from the date of the inspection, and this log shall be made available to the Division upon request. [15A NCAC 02T .0108(b)] 3. Any duly authorized Division representative may, upon presentation of credentials, enter and inspect any property, premises or place on or related to the wastewater treatment and recycle facilities penmitted herein at any reasonable time for the purpose of determining compliance with this permit; may inspect or copy any records required to be maintained under the terms and conditions of this permit, and may collect groundwater, surface water or leachate samples. [G.S. 143-21.5.3(a)(2)] VI. GENERAL CONDITIONS 1. Failure to comply with the conditions and limtations contained herein may subject the Penmittee to an enforcement action by the Division in accordance with North Carolina General Statutes 143- 215.6A to 143-215.6C. This permit shall become voidable if the permtted facilities are not constructed in accordance with the conditions of this pen -nit, the Division approved plans and specifications, and other supporting documentation. [15A NCAC 02T .0110] 3. This permit is effective only with respect to the nature and volume of wastes described in the permit application; Division approved plans and specifications, and other supporting documentation. No variances to applicable rules governing the construction or operation of the permitted facilities are granted, unless specifically requested and approved in this pernut pursuant to 15A NCAC 02T .0105(n). The issuance of this pern it does not exempt the Permttee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other jurisdictional government agencies (e.g., local, state, and federal). Of particular concern to the Division are applicable river buffer rules in 15A NCAC 02B .0200; erosion and sedimentation control requirements in 15A NCAC Chapter 4 and under General Permit NCG010000; any requirements pertaining to wetlands under 15A NCAC 02B .0200 and 02H .0500; and documentation of compliance with Article 21 Part 6 of Chapter 143 of the General Statutes.
