In accordance with your application received September 3, 1991, we are forwarding herewith
Permit No. WQ0005557, dated January 31, 1992, to Mini-Apolis Grand Prix Corporation for the
operation of an existing wastewater recycle system.
This permit shall be effective from the date of issuance until December 31, 1996, and shall be
subject to the conditions and limitations as specified therein. Please pay particular attention to the
monitoring requirements in this permit. Failure to establish an adequate system for collecting and
maintaining the required operational information will result in future compliance problems. Issuance of
this permit does not relieve the Mini-Apolis Grand Prix Corporation of the responsibility of an
enforcement action for construction of a wastewater treatment facility without a valid permit.
If any parts, requirements, or limitations contained in this permit are unacceptable to you, you have
the right to request an adjudicatory hearing upon written request within 30 days following receipt of this
permit. This request must be in the form of a written petition, conforming to Chapter 150B of North
Carolina General Statutes, and filed with the Office of Administrative Hearings, P.O. Drawer 27447,
Raleigh, NC 27611-7447. Unless such demands are made this permit shall be final and binding.

RECYCLE SYSTEM PERMIT
In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina
as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO
Mini-Apolis Grand Prix Corporation
Haywood County
FOR THE
operation of a 15,000 GPD wastewater recycle system consisting of a 0.5 Hp recycle pump with 2 inch
discharge piping to a 40 foot x 12 inch flume and two 64 cubic foot settling tanks to serve the Mini-Apolis
Grand Prix Corporation's Mini-Apolis Gem Mine with no discharge of wastes to the surface waters,
pursuant to the application received September 3, 1991 and in conformity with the project plan,
specifications, and other supporting data subsequently filed and approved by the Department of
Environment, Health and Natural Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until December 31, 1996, and shall be
subject to the following specified conditions and limitations:
1. This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans, specifications, and other supporting data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Environmental Management accompanied by an application
fee, documentation from the parties involved, and other supporting materials as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those as
may be required by this Division, such as the construction of additional or replacement
wastewater treatment or disposal facilities.
6. The sludge generated from these treatment facilities must be disposed of in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Environmental Management.

7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
8. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
9. Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Any monitoring deemed necessary by the Division of Environmental Management to insure
surface and ground water protection will be established and an acceptable sampling
reporting schedule shall be followed.
11. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
12. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall keep an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken
by the Permittee. The log shall also indicate the date and approximate amount of make-up
water added and the amount, approximate volume, and the disposal method of any
sediment removed from the settling basins. This log of inspections and maintenance shall
be maintained by the Permittee for a period of five years from the date of the inspection and
shall be made available upon request to the Division of Environmental Management or other
permitting authority.
13. Any duly authorized officer, employee, or representative of the Division of Environmental
Management may, upon presentation of credentials, enter and inspect any property,
premises or place on or related to the recycle system at any reasonable time for the purpose
of determining compliance with this permit; may inspect or copy any records that must -be
kept under the terms and conditions of this permit; or may obtain samples of groundwater,
surface water, or leachate.
14. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division.
(c)(4). Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15 NCAC 2H .0205
15. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Environmental Management in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
16. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
17. A set of approved facility sketches for the subject project must be retained by the Permittee
for the life of this project.
18. Noncompliance Notification:
The Permittee shall report by telephone to the Asheville Regional Office, telephone no.
(704)251-6208, as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:

a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such
as the dumping of the contents of a basin or tank; the known passage of a slug of
hazardous substance through the facility; or any other unusual circumstances.
b. Any process unit failure, due to known or unknown reasons, that render the facility
incapable of adequate wastewater treatment such as mechanical or electrical failures
of pumps, aerators, compressors, etc.
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-
pass directly to receiving waters without treatment of all or any portion of the
influent to such station or facility.
d. Any time that self -monitoring information indicates that the facility is not in
compliance with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within 15 days following first knowledge of the occurrence. This report must outline
the actions taken or proposed to be taken to ensure that the problem does not recur.
19. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge of the
wastewater treatment facilities. The operator must hold a certificate of the type and grade at
least equivalent to the classification assigned to the wastewater treatment facilities by the
Certification Commission. Once the facility is classified, the Permittee must submit a letter
to the Certification Commission which designates the operator in responsible charge.
20. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.
21. Freeboard in the settling tanks shall not be less than two feet at any time.
22. Adequate records shall be maintained by the Permittee tracking the operation and
maintenance of the recycle system. These records shall include, but are not necessarily
limited to the following information:
a) date and time make-up water added,
b) approximate volume of make-up water added,
c) date solids removed,
d) approximate volume of solids removed,
e) disposition of removed solids,
f) date and type of maintenance or replacement of any system components, and
g) the name of person conducting above activities.
23. Three copies of all operation and disposal records (as specified in condition 22) and any
other data as may be required shall be submitted on or before January 31st of the following
year to the following address:

On January 31, 1992 the Division of Environmental Management issued you
the subject permit. One of the conditions of the subject permit read as
follows:
Upon completion of construction and prior to operation of this permitted
facility, a certification must be received from a professional engineer
certifying that the permitted facility has been installed in accordance
with the requirements of this permit and the approved plans and
specifications. Mail certification to the Permits and Engineering Unit,.
P.O. Box 29535, Raleigh, N.C., 27626-0535.
To date, our records show that no certification has been received for the
subject permit. If the permitted facility has been constructed and placed into
operation please submit the required certification immediately. Operation of
the treatment system prior to submission of the required certification is in
violation of your permit and is subject to enforcement action. If you have any

Dear Permittee:
Our files indicate that the subject permit issued on 1/31/92 expires on
12/31/96. We have not received a request for renewal from you as of this date.
A renewal request shall consist of a letter requesting renewal and completion of
the enclosed application, submitted in triplicate. A processing fee must be submitted
with the request. Please find attached a copy of the 15 NCAC 2H .0205(c) regulations.
The processing fee for your facility is based on the design or permitted flow,
whichever is appropriate, listed in the first four categories of facilities. Sludge
renewals are based on total acres of land permitted. If the facility covered by this
permit contains some type of treatment works, a narrative descripton of the sludge
management plan that is in effect at the facility must be submitted with the
application for renewal.
The Environmental Management Commission adopted revised rules on October 1, 1990
(attached), requiring the payment of an annual fee for most permitted facilities. You
will be billed separately for that fee (if applicable), after your permit is approved.
Please be advised that this permit must not be allowed to expire. If the renewal
request is not received within 180 days prior to the permit's expiration date as
required by 15 NCAC 2H .0211, you will be assessed an automatic civil penalty. This
civil penalty by North Carolina General Statute may be as much as $10,000 per day. If
a permit renewal request is not received 180 days before permit expiration, a civil
penalty of at least $250 will be assessed. Larger penalties may be assessed depending

on how late the request is made. In addition, any permit renewal request received
after the permit's expiration date will be considered as a. new application and will be
required to pay the higher permit application fee.

Administrative Code 2H .0205, under the authority of North Carolina
General Statutes 143-215.3(a)(1), (la) and (lb). Because this fee was
not fully paid within 30 days after being billed, this letter initiates
action to revoke the subject permit, pursuant to 1.5 NCAC 2H .0205(c)(4),
and G.S. 143-215.1(h)(3).
Effective 60 days from receipt of this notice, subject permit is
hereby revoked unless the required Annual ,administering and Compliance

No. WQ0005557 dated September 11, 1996, to the Mini-Apolis Grand Prix Park for the continued'
operation of the subject tourist gem mine.wastewater recycle system.
This permit shall be effective from the date of issuance until August 31, 2001, shall void Permit
No: WQ0005557 issued January 31, � 1992, and shall be subject to the conditions and limitations as
specified therein. Please pay particular attention to the monitoring requirements in this permit. Failure to
establish an adequate system for collecting and maintaining the required operational information will result
in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing upon written request within thirty (30) days following receipt of
this permit. This request must be in the form of a written petition, conforming to Chapter 150B of North

continued operation of a 15,000 GPD wastewater recycle system consisting of a 0.5 Hp recycle pump
with 2 inch discharge piping to a 40 foot by 12 inch flume, two 64 cubic foot settling tanks, a 96 cubic
foot storage/pump tank, and associated controls, piping, valves, and appurtenances to serve the Mini-
Apolis Grand Prix Park Tourist Gem Mine with no discharge of wastes to the surface waters, pursuant to
the application received July 16, 1996, and in conformity with the project plan, specifications, and other
supporting data subsequently filed and approved by the Department of Environment, Health and Natural
Resources and considered a part of this permit.
This permit shall be effective from the date of issuance until August 31, 2001, shall void Permit
No. WQ0005557 issued January 31, 1.992, and shall be subject to the following specified conditions and
limitations:
This permit shall become voidable unless the facilities are constructed in accordance with
the conditions of this permit, the approved plans and specifications, and other supporting
data.
2. This permit is effective only with respect to the nature and volume of wastes described in
the application and other supporting data.
3. The facilities shall be properly maintained and operated at all times.
4. This permit is not transferable. In the event there is a desire for the facilities to change
ownership, or there is a name change of the Permittee, a formal permit request must be
submitted to the Division of Water Quality accompanied by an application fee,
documentation from the parties involved, and other supporting materials .as may be
appropriate. The approval of the request will be considered on its merits and may or may
not be approved.
5. In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including those
actions that may be required by this Division, such as the construction of additional or
replacement treatment or disposal facilities.
6. The residuals generated from these treatment facilities must be disposed in accordance with
General Statute 143-215.1 and in a manner approved by the North Carolina Division of
Water Quality.
7. The issuance of this permit shall not relieve the Permittee of the responsibility for damages
to surface or groundwaters resulting from the operation of this facility.
VV8. The facilities shall be effectively maintained and operated as a non -discharge system to
prevent the discharge of any wastewater resulting from the operation of this facility.
Diversion or bypassing of untreated wastewater from the treatment facilities is prohibited.
10. Freeboard in the settling and storage tanks shall not be less than two feet at any time.
11. Any monitoring deemed necessary by the Division of Water Quality to insure surface and
ground water protection will be established and an acceptable sampling reporting schedule
shall be followed.
12. Adequate inspection, maintenance, and cleaning shall be provided by the Permittee to
insure proper operation of the subject facilities.
13. The Permittee or his designee shall inspect the wastewater recycle facilities to prevent
malfunctions and deterioration, operator errors and discharges which may cause or lead to
the release of wastes to the environment, a threat to human health, or a nuisance. The
Permittee shall maintain an inspection log or summary including at least the date and time of
inspection, observations made, and any maintenance, repairs, or corrective actions taken by
the Permittee. This log of inspections shall be maintained by the Permittee for a period of
three years from the date of the inspection and shall be made available to the Division of
Water Quality or other permitting authority, upon request.
14. Any duly authorized officer, employee, or representative of the Division of Water Quality
may, upon presentation of credentials, enter and inspect any property, premises or place on
or related to the recycle system at any reasonable time for the purpose of determining
compliance with this permit, may inspect or copy any records that must be maintained
under the terms and conditions of this permit, and may obtain samples of groundwater,
surface water, or leachate.
15. The annual administering and compliance fee must be paid by the Permittee within thirty
(30) days after being billed by the Division. Failure to pay the fee accordingly may cause
the Division to initiate action to revoke this permit as specified by 15A NCAC 2H .0205
(c)(4).
16. Failure to abide by the conditions and limitations contained in this permit may subject the
Permittee to an enforcement action by the Division of Water Quality in accordance with
North Carolina General Statute 143-215.6(a) to 143-215.6(c).
17. The issuance of this permit does not preclude the Permittee from complying with any and
all statutes, rules, regulations, or ordinances which may be imposed by other government
agencies (local, state, and federal) which have jurisdiction.
18. A set of approved plans and specifications for the subject project must be retained by the
Permittee for the life of this project.
19. Noncompliance Notification:
The Pernnttee shall report by telephone to the Asheville Regional Office, telephone number
704/ 251-6208 as soon as possible, but in no case more than 24 hours or on the next
working day following the occurrence or first knowledge of the occurrence of any of the
following:
a. Any occurrence at the wastewater treatment facility which results in the treatment of
significant amounts of wastes which are abnormal in quantity or characteristic, such as
the dumping of the contents of a basin or tank, the known passage of a slug of
hazardous substance through the facility, or any other unusual circumstances;

b. Any process unit failure, due to known or unknown reasons, that renders the facility
incapable of adequate wastewater treatment, such as mechanical or electrical failures of
pumps, aerators, compressors, etc.;
c. Any failure of a pumping station, sewer line, or treatment facility resulting in a by-pass
directly to receiving waters without treatment of all or any portion of the influent to
such station or facility; or
d . Any time that self -monitoring information indicates that the facility is not in compliance
with its permit limitations.
Persons reporting such occurrences by telephone shall also file a written report in letter
form within five (5) days following first knowledge of the occurrence. This report must
outline the actions taken or proposed to be taken to ensure that the problem does not recur.
20. Upon classification of the facility by the Certification Commission, the Permittee shall
employ a certified wastewater treatment plant operator to be in responsible charge (ORC) of
the wastewater treatment facilities. The operator must hold a certificate of the type and
grade at least equivalent to or greater than the classification assigned to the wastewater
treatment facilities by the Certification Commission. The Permittee must also employ a
certified back-up operator of the appropriate type and grade to comply with the conditions
of Title 15A, Chapter 8A, .0202. The ORC of the facility must visit each Class I facility at
least weekly and each Class II, III, and IV facility at least daily, excluding weekends and
holidays, and must properly manage and document daily operation and maintenance of the
facility and must comply with all other conditions of Title 15A, Chapter 8A, .0202.
21. Proper records shall be maintained by the Permittee tracking all application activities.
These records shall include, but are not necessarily limited to the following information:
a. date and time make-up water added,
b . approximate volume of make-up water added,
c. date of solids removed,
d . approximate volume of solids removed,
e. disposition of removed solids,
f . date and type of maintenance or replacement of any system components, and
g . the name of person conducting above activities.
22. The Permittee, at least six (6) months prior to the expiration of this permit, shall request its
extension. Upon receipt of the request, the Commission will review the adequacy of the
facilities described therein, and if warranted, will extend the permit for such period of time
and under such conditions and limitations as it may deem appropriate.

In accordance with North Carolina General Statute § 90A-37, the Water Pollution Control
System Operators Certification Commission is required to classify all water pollution control
systems. The Rating Scale for Classification of Wastewater Treatment Facilities, found at 15A
NCAC 8C .0002, was adopted by the Commission to classify water pollution control systems.
The rating scale assigns points to each component of the treatment process. The classification of
a facility is determined by the total number of points for all components of the treatment process.
The Water Pollution Control System Operators Certification Commission hereby classifies the
subject facility as Grade 1 Wastewater Treatment Plant.
As required by 15A NCAC 8A .0202 and'.your permit, you are required to designate an Operator
in Responsible Charge (ORC) and back up operator of the appropriate type and grade for the
subject facility. Your facility requires a Wastewater Grade 1 or higher Wastewater Treatment
Plant Operator in Responsible Charge and Wastewater Grade 1 or higher back up operator.
Please complete and return the enclosed ORC designation form by May 1, 1997. Failure to.
designate a properly certified operator and back-up operator by the above date constitutes a
violation of the permit issued for this facility.

Acting pursuant to North Carolina General Statute (G.S.) 143-
215.6A, I, Kerr T. Stevens, Director of the Division of Water Quality
(DWQ), make the following:
I. FINDINGS OF FACT:
A. James Lindsey is the owner and developer of land located at
1406 Soco Road, Maggie Valley, Haywood County, N.C., presently
known as Mountain Retreat RV Park.
B. On June 8, 1999, DWQ staff inspected the Mountain Retreat RV
Park and observed that a sewer system had been built.
C. A search of DWQ records showed that a permit had not been
issued as of the date of the inspection for the above cited
construction.
D. The costs to the State of the enforcement procedures in this
matter totaled $226.96.
Based upon the above Findings of Fact, I make the following:
II. CONCLUSIONS OF LAW:
A. James Lindsey a "person" within the meaning of G.S. 143-
215.E pursuant to G.S. 143-212(4).
B. The sewer system cited in finding of Fact C above falls
within the definition of same at G.S. 143-213(15)
C. A permit is required for the construction of a sewer
system pursuant to G.S. 143-215.1(a)(2).
D. James Lindsey may be assessed civil penalties pursuant to
G.S. 143-215.6A(a)(2) which provides that a civil penalty
of not more than ten thousand dollars per violation may
be assessed against a person who is required but fails to
apply for or to secure a permit required by G.S. 143-
215.1.
E. The State's enforcement costs in this matter may be
assessed against Jim Lindsey pursuant to G.S. 143-
215.3 (a) (9) and G.S. 143B-282.1 (b) (8) .
F. The Director, Division of Water Quality, pursuant to
delegation authorized by G.S. 143-215.6A(h), has the
authority to assess civil penalties in this matter.
Based upon the above Findings of Fact and Conclusions of Law,
I make the following:
III. DECISION:
Mountain Retreat RV Park is hereby assessed a civil penalty
of:

(2) The duration and gravity of the violation;
(3) The effect on ground or surface water quantity or quality or
on air quality;
(4) The cost of rectifying the damage;
(5) The amount of money saved by non-compliance;
(6) Whether the violation was committed willfully or
intentionally;
(7) The prior record of the violator in complying or failing to
comply with programs over which the Environmental Management
Commission has regulatory authority; and
(8) The cost to the State of the enforcement procedures.

Please find enclosed your check submitted with the above referenced permit application. Based on our records a
total of $1,800 in Annual fees is past due on this permit. Also, the permit expired on August 31, 2001. These
past due fees must be paid before the permit renewal/ownership change can be processed. The annual fee due
January 1, 2005 cannot be applied until billed and the back due fees are brought up-to-date. Peryouur
conversation today with Mr. Bennie Goetze, Jr. of our staff, you indicated that the facility was not used last year
and you did not foresee its use this year. If you wish to have this permit rescinded, please submit a written
request to the address below. To reactivate the facility after the permit is rescinded will require the issuance of a
new permit. The issuance of a new permit will require the submittal of a permit application with fee and
appropriate design plans, specifications and calculations and other information as required by the application
instructions.
Please be advised that construction and/or operation of wastewater collection, treatment, and/or disposal facilities
without a valid permit is a violation of North Carolina General Statute §143-215.1 and may subject the
owner/operator to appropriate enforcement actions in accordance with North Carolina General Statute § 143-
215.6A-6C. Civil penalties of up to $25,000 per day per violation may be assessed for failure to secure a permit
required by North Carolina General Statute § 143-215.1.

I know this is probably an exercise in futility, but I was just sent two invoices for facilities that have not paid
their fees and the permit has been expired for some time. Do you have any current information on these
facilities.
The first is Biggers Arthur J - Jacobs Ruby (WQ0014294). Interestingly I found an internet post at

Cherokee Gem Mine has recently re -opened after being closed for several years. This is great news for anyone

"This place was a great idea that was never kept up with and became a dump! It is now closed and all tracks etc
are gone. It became a real estate office. Yeah, we don't have enough realtors, lawyers or banks in Haywood
County (HA!) lets get rid of another amusement area, which are very few to begin with, and put up another of
these businesses!"
Both have been expired for many years (2002, and 2001 respectively). If they are still in operation we should
try to get the permit updated.

The subject permit has been revoked for failure to pay annual permit fees. Because these fees
were not paid the action was taken to revoke the subject permit, pursuant to Title 15A North
Carolina Administrative Code 2T.0110 and North Carolina General Statutes 143-215.1(b). North
Carolina General Statutes 1A. Rules of Civil Procedure provides that a party that cannot with due
diligence be served by personal delivery, registered or certified mail, or by a designated delivery
service authorized pursuant to 26 U.S.C. § 7502(0(2) may be served by publication. Service of
process by publication shall consist of publishing a notice of service of process by publication once a
week for three successive weeks in a newspaper that is qualified for legal advertising in accordance
with G.S.1-597 and G.S. 1-598 and circulated in the area where the party to be served is believed by
the serving party to be located, or if there is no reliable information concerning the location of the
party then in a newspaper circulated in the county where the action is pending.
The owner could not be contacted and the revocation was by public notice. A notice was run in
the Asheville Citizen Times on March 17, 2013, March 24, 2013, and March 31, 2013 with no
response received by the Division. These facilities have been closed and the permit owner could
not be located.
