Good Morning Sue and Amanda, Per your comments below, Pilot Environmental returned to the site to delineate areas where new sewer lines are proposed to be installed to service existing and future facilities. A copy of the delineation report which includes maps and data forms is attached. The delineation also includes the outfall to the Watauga River. A PCN drawing showing no additional impacts associated with the proposed lines is also attached. We are unaware of additional impacts associated with future developments at this time. The applicant is aware that future impacts will be considered cumulative, should they occur. Wastewater treatment plant plans are attached showing how treated wastewater is to be discharged. That means that there will be new GC issued by DWR. The new GCs will all require "Individual 401 WQC authorizations" for any project that exceeds the thresholds (similar to the current process for projects under NWP29 and 39). Unfortunately, that means that if I am unable to issue the 401 for this project prior to 2/25, it'll have to go out to Public Notice for 30 days before I can issue it. I wanted to give you a heads up for you/your client's timeline purposes. From what I recall from our discussion, the parcels shown on the attached map is what will be currently coming on- line/using the proposed WWTP (versus the other parcels mentioned in the application which would be potential users in 3 the event those areas are developed) and are parcels that have existing businesses/development? Which leads to some additional questions: - would new sewer lines need to be constructed to service the parcels shown on the attached map? - is there any outfall proposed to the Watauga River? Please clarify how treated effluent will be discharged. Also after reviewing the application package in more detail, the delineation report (conducted by BREC but submitted by Pilot) references two jurisdictional tributaries (Uta and UTb) but I'm not clear on where these are located in relation to the plan/proposed impacts. There was no delineation map/determination map in the PCN, no wetland/upland dataforms and the delineation report also appears to cover multiple parcels not included in this project so I cannot determine the accuracy/validity of the proposed impacts. I would suggest a revised/updated Preliminary Jurisdictional Determination be completed to only include this parcel along with the necessary information specific to this site (maps, data forms, etc.). Any impact maps should be then be modified to reflect this updated determination/delineation so that we can continue our review of the application. I know Sue is on leave for the holidays and I'm getting ready to be out of the office until later next week so let's plan on circling back/having another call if needed once everyone is back in the office and can look over this email/request, thanks. This plant will become a public utility. Question 1 - This is a project with an EXISTING PERMIT permitting discharge into the Watauga River (attached). Question 2 - 5 The purpose of the WWTP is the development of approximately 30 acres controlled by Clevon Woods Associates, LLC. The approximate 30 acres refers to the new development and existing facilities (25+ acres) and also existing businesses who want to come on line (Site Plan attached). New development includes : 50 individual home sites Commercial component for retail and possible hotel. 100 seat restaurant (structure on site for this facility) Existing: Expansion of the Grandfather Winery Expansion of service for the Speedway gas station - store/deli (structure on site) Additional existing businesses want to acquire service from the sewage treatment plant. Question 3 - The property where the WWTP is going to located is only .576 acres. In checking with Watauga County, on a property less than one acre there are no local stormwater requirements for the property. Any State requirements will be addressed as necessary. (Pilot) is pleased to submit this report of the wetland delineation for the approximate 2.9-acre tract located on Aldridge Road in Banner Elk, Watauga County, North Carolina. Background Wetlands are defined by the United States Army Corps of Engineers (USACE) and the United States Environmental Protection Agency (EPA) as "those areas that are inundated or saturated by surface or groundwater at a frequency and duration sufficient to support, and under normal circumstances, do support a prevalence of vegetation typically adapted for life in saturated soil conditions." In order for an area to be classified as wetland, hydrophytic vegetation, hydric soils, and wetland hydrology indicators must be present. Section 404 of the Clean Water Act (CWA) regulates the discharge of dredge and fill materials into waters of the United States (lakes, rivers, ponds, streams, etc.), including wetlands. Waters of the United States include the territorial seas, navigable coastal and inland lakes, rivers and streams, and wetlands. The EPA and the USACE jointly administer the Section 404 program. Section 401 of the Clean Water Act grants each state the authority to approve, condition, or deny any Federal permits that could result in a discharge to State waters. Jurisdictional features include wetlands, open waters, ponds, lakes, and perennial/intermittent streams. Jurisdictional features are regulated by the USACE and North Carolina Department of Environmental Quality -Division of Water Resources (NCDEQ-DWR). Permits are required prior to impacting any jurisdictional feature. The type of permit required is specific to the type, location, and amount of impacts. Stormwater management plans and/or mitigation for proposed impacts could be a requirement of the permit approval process. PO Box 128, Kernersville, NC 27285 www.pilotenviro.com Wetland Delineation Pilot Project 7372.1 February 10, 2022 The findings and conclusions in this report are our opinions based on field conditions encountered at the time of the site visit. Changes including, but not limited to, regulations, weather, timber/vegetation removal, and usage/development of the site or nearby properties can alter the findings and opinions presented in this report. We recommend that this report only be used for preliminary planning purposes. Agency verifications, followed by a survey of jurisdictional features, are required to determine the exact extent and locations of jurisdictional features and are valid for a period of up to five years following issuance of a USACE Jurisdictional Determination (JD) and/or NCDEQ-DWR Site Determination Letter. Global Positioning System (GPS) location of jurisdictional features has been conducted by Pilot personnel in the field utilizing a Trimble handheld GPS unit capable of sub -meter accuracy. Field GPS data has been post -processed by Pilot personnel and digitally provided to the client for assistance with preliminary planning. Pilot expresses no warranties or liabilities to accuracy of GPS locations and/or provided GPS data. Scope of Services Pilot was contracted to perform a wetland delineation for the approximate 2.9-acre tract located on Aldridge Road in Banner Elk, Watauga County, North Carolina. The site is identified on the Watauga County Geographic Information System (GIS) as parcel identification number (PIN) 1878- 53-7991 and a portion of PINS 1878-53-8778, 1878-53-6902, 1878-53-2562, 1878-53-2931, 1878- 54-2186, 1878-44-7318, 1878-43-4989 and 1878-43-3817. The scope of services included a delineation of jurisdictional features (i.e. streams, wetlands, and other surface waters) on the site. Literature Review We reviewed the U.S. Geological Survey (USGS) Topographic Map, the U.S. Department of Agriculture (USDA) Soil Survey of Watauga County, the U.S. Fish and Wildlife Service (USFWS) National Wetland Inventory (NWI) Map, and the Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (FIRM). • The USGS Topographic Map (Drawing 1) depicts the Watauga River on the eastern portion of the site. A drainage swale that could contain additional surface waters or wetlands is depicted on the central portion of the site. A pond is depicted immediately northeast of the site. • The USDA Web Soil Survey of Watauga County (Drawing 2) identifies the following soil mapping units on the site: Dellwood cobbly loamy sand (DeB) and udorthents, loamy (Ud). The Dellwood series consists of moderately well drained, moderately rapidly to very rapidly permeable soils formed in dominantly coarse -textured alluvium on mountain flood plains. Udorthents occur on nearly level to gently sloping areas where original soils have been cut away or covered with a loamy fill material. The DeB soil mapping unit is identified on the Watauga County Hydric Soils List. The Ur soil mapping unit is not identified on the list. 2 Wetland Delineation Pilot Project 7372.1 February 10, 2022 Pilot also reviewed the last published USDA Soil Survey of Watauga County (Drawing 2A). The map depicts the Watauga River on the eastern portion of the site and an unnamed tributary to the Catawba River centrally on the site. • The USFWS NWI Map (Drawing 3) depicts the Watauga River on the eastern portion of the site and a pond to the northeast of the site, generally consistent with the USGS Topographic Map. • Pilot reviewed the FEMA FIRM (Drawing 4) for the site. The FEMA FIRM identifies the eastern portion of the site as designated floodway (areas that must be kept free of encroachment), Zone AE (areas within the 100-year flood zone with base flood elevations determined) and areas within the 500-year flood zone. The remainder of the site is identified as Zone X, areas outside the 100-year floodplain. Field Delineation Pilot conducted the field delineation on February 7, 2022. The site contains wooded land, a graded lot and maintained roadside easements. Aldridge Road and NC-105 bisect the site. The Watauga River and a smaller stream are located on the site. The Watauga River is an approximate 50 feet wide perennial water. The smaller stream is located centrally on the site, is approximately three to five feet wide with a moderately defined channel and evidence of an ordinary high-water mark. The stream contained moderate stream flow at the time of our site visit. Based on our observations and the stream characteristics, the stream appears to be perennial. The stream intersections with culverts and the site boundary were marked in the field with blue and white striped surveyor tape. The streams were geolocated with a Trimble handheld GPS unit and digital elevation modeling data. The stream limits are well defined and should be surveyed to determine their exact locations. Wetlands are located within the Watauga floodplain and within small drainage swales on the site. The wetlands are saturated riverine and slope/seep wetlands typical of the Blue Ridge Mountains of North Carolina. The wetlands are separated from surrounding uplands by distinct breaks in topography, vegetation, and/or soil. USACE Wetland Determination Data Forms, supporting our opinions, are included as attachments. The wetland boundaries were marked in the field with red and white striped surveyor tape and geolocated with a Trimble handheld GPS unit. The attached "Wetland Map" (Drawing 5) shows the approximate locations of the streams, wetlands, and data points, as well as our flag information. The locations and designations of features shown on Drawing 5 are subject to change during agency verification of the delineation. 3 Wetland Delineation Pilot Project 7372.1 February 10, 2022 Watershed Classification The site is located in the Watauga River Basin. The Watauga River and an unnamed tributary to the Watauga River are located on the site. The NCDEQ-DWR has classified the Watauga River as Class B; trout (Tr); high quality waters (HQW). The Watauga River and its tributary are subject to state buffer requirements. Consultation with the local planning authority is recommended to determine local buffer/stormwater setback requirements for the proposed development. Agency Verification The delineation has not been verified by the USACE. We understand that our flags will be surveyed to determine the exact extent and locations of jurisdictional features and applicable surface water buffers.
