Vegetation data suggests that stems are establishing well and all plots met performance criteria of 260 stems/acre. An encroachment of approximately 0.17 acres was noted in the report due to the installation of underground utilities (a water line) by a tenant farmer (see attached map). The encroachment is not allowed in the conservation easement and has impacted trees and other vegetation within the footprint where buffer mitigation credits and nutrient offset credits are generated. DWR request the following from Wildlands: 1. Send a formal letter to the landowner and tenant farmer indicating the water lines are a violation of the conservation easement and must be removed outside of the conservation easement. Be sure to copy both DWR and the USACE on this correspondence. 2. Develop a remediation plan that includes the removal of unauthorized utilities within the conservation easement, seeding where bare earth is exposed and a replanting plan in areas where trees were killed or removed. Please provide confirmation of bond renewal and then DWR can proceed with the issuance of a partial (5%) credit release. The remaining 5% credit release will be issued when Items 1 & 2 are addressed. It is recommended that Wildlands scan any bonds and email to me directly in addition to mailing a hard copy. DWR does not authorize a bond reduction associated with the buffer mitigation and nutrient offset bank at this time. Thank you for your continued patience, Katie
