PROJECT DESCRIPTION The project is located at the 100 Southeast Street SE, adjacent to the Atlantic Intracoastal Waterway (AIWW), in the Town of St. James Plantation, Brunswick County. To find the project site travel south on US Highway 17 to NC Highway 133 South. Travel approximately 22 miles south on NC-133 to Dosher Cutoff SE/ NC-133.Turn onto Dosher Cutoff and then turn right at Southport -Supply Rd. SE/ NC-133. Travel approximately 3.25 miles to the entrance of St. James Plantation. Turn left into St. James Plantation and follow St. James Drive SE to its end. Take a right at the roundabout and make the first left into Waterway Park. Please note that St. James Plantation is a gated community and a site visit should be arranged with the applicant prior to your visit to guarantee access to the site The project area is located adjacent to a 9.88 acre public park. The shoreline of the park has not been stabilized. The elevation of the tract is approximately 10' above normal high water. High ground vegetation on the tract consists primarily of lawn grasses and ornamental plantings. The highground portion of the park area has a gravel parking lot, gazebo/picnic area with restrooms, and walking trails. Currently there is a fixed pier with two covered gazebos and a floating dock with kayak launch provide water access. The pier was authorized and expanded previously via three general permits, GP 31808D issued 8/26/02, GP 52098D issued 5/15/08, and GP 62622D issued 9/18/13. Marsh vegetation consists of Black Needlerush (Juncus roemerianus) Spikegrass (Distichiis spicata), Glasswort (Salicornia spp), Salt Meadow Hay (Spartina patens), and Sea Oxeye (Borrichia frutescens) above mean high water, which measures approximately 90' in width. A fringe of Salt Marsh Cordgrass (Spartina alterniflora) continues below the mean high water line and measures approximately 45' in width.. There are a series of oyster bag sills constructed near the shoreline, originally authorized under CAMA Major Permit 61-14, and expanded several times through minor modifications of the major permit. The waters of the AIWW, adjacent to the project site, are classified as SB by the North Carolina Division of Water Resources. The area is designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and is closed to the harvesting of shellfish, PROPOSED PROJECT: The applicant proposes to lengthen the existing gazebo by 50' to expand to a proposed final dimension of 70' x 13'(dripline). Currently, the access pier (6' x —213') extends in a southwesterly direction from the highground. There is an existing covered `bumpout' fixed platform (13' x 13') located just past the edge of marsh. The pier currently terminates into a fixed covered gazebo (20' x 13') oriented parallel with the shoreline. From the eastern side of the existing gazebo, a gangway provides access to a floating dock (20' x 10') and kayak launch (5' x 26'). The proposed expansion of the gazebo would maintain the existing width of the fixed covered gazebo (13') and extend the covered gazebo laterally, an additional 50' in length, to create a fixed covered gazebo with a 70' x 13' dripline after the expansion. The proposed expansion is located over open water, in water depths of approximately 23" at NLW, according to the applicant. There are no proposed changes to the existing floating structures and no slips are proposed. This project proposal was discussed in an interagency scoping meeting held virtually on 12/13/2021. 10. ANTICIPATED IMPACTS: The project would result in the incorporation and shading of approximately 650 square feet of Estuarine Waters and Public Trust Areas of Environmental Concern, The proposed expansion would not encroach into the neighboring riparian corridor setback, and be located landward of the USACE federal channel setback. Temporary increases in turbidity can be expected during construction. Box 1661 Carolina Beach, NC 28428 Dear Mr. Brink: The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for the St. James Plantation POA, for State approval for development of the subject property located at 2713 St. James Drive SE, St. James, in Brunswick County. It was received as complete on January 27, 2022 and appears to be adequate for processing at this time. The projected deadline for making a decision is April 12, 2022. An additional 75-day review period is provided by law when such time is necessary to complete the review. if you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from January 27, 2022 you may request a meeting with the Director of the Division of Coastal Management and permit staff' to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the proposed development, Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development, You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right -of way fronting your property; or at a point along the road right -Of -way where a private road would lead one into your Property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency.
