Dear Ms. Armeni,
Per the Notice of violation for Dogwood Trails Subdivision; Solids, Total -Suspended
Concentration daily maximum exceeded the daily limit of 45 which caused the monthly
average Solids, Total -Suspended Concentration limit of 30 to be exceeded. This was due
to two broken diffuser drop down pipes. The waste water plant was still operating but not
with enough air to perform to permit requirements. The two diffuser pipes have been
repaired giving the waste water plant the required air to meet the permit requirements.
Analysis following the repair have been within normal limits.

Statute (G.S.) 143-215.1 and the facility's NPDES WW Permit. Pursuant to G.S. 143-215.6A, a civil penalty of
not more than twenty-five thousand dollars ($25,000,00) may be assessed against any person who violates or
fails to act in accordance with the terms, conditions, or requirements of any permit issued pursuant to G.S.
143-215.1.
