On behalf of Cornwallis NC CPDC LLC (owner), please find attached a complete application and supplemental
information requesting written concurrence from the US Army Corps of Engineers (USACE) that the activities
associated with the proposed development of the Highway 42 Precision Tune (Project) may proceed under
Nationwide Permit (NWP) 39, General Certification 4263 (GC 4256)
Protect Purpose and Location
The Project includes the construction of a Precision Tune facility with associated parking and utilities. The +/-
2.28-acre tract is located at 3652 NC Highway 42, Clayton, Johnston County. The coordinates of 35.6373°N,
78.4412°W generally correspond to the center of the Site.
Project Detail
The proposed Project consists of the construction of an auto repair facility with associated parking and utilities.
Municipal sewer and water are available to the Site.
Access to the Site will be provided via Highway 42 to the south. Heavy equipment typically used for utility
installation projects (e.g., backhoes, bulldozers, etc.) will be utilized.
No federally threatened or endangered species are listed to occur on the Site or within1.0 mile of the Site
according to the NC Natural Heritage Program (NCNHP) Database (see attached reportdated January 17, 2022).
The Site itself is not listed as a historic property. There are nine properties located within 0.5 mile of the Site
based on a query of the North Carolina State Historic Preservation Office (NCSHPO) database. Eight properties
are designated as "Surveyed Only (SO)," and one is designated as "National Register - National Register
individual listing". Figure 4 depicts the locations of these properties in relation to the Site.
Project History
The Site is mostly cleared and graded. S&EC performed a wetland and stream delineation of the site in October
2021.
Avoidance and Minimization
This project has been designed to meet purpose and need while avoiding and minimizing impacts to onsite
natural resources to the greatest extent practicable. There are 0.035 acres of onsite wetlands, of which only
0.008 acres are proposed to be permanently impacted. There are no onsite streams. Construction fencing will
be used to define the construction corridor and prevent any accidental additional impacts, while silt fencing will
be installed to provide additional protection from runoff.

Protect Impacts
The site development impacts will result in 0.008 acre of permanent wetland impact. No other impacts are
proposed.
Mitigation
Permanent wetland impacts total 0.008 acre which is below mitigation thresholds.
