Burke County 201 Plan
In a letter of February 6, 1979, from Mr. Richard Whitley, Town Manager
of the Town of Valdese, to Mr. McRorie, Mr. Whitley has requested
alternate effluent limits for the proposed 7.5 MGD Valdese -Lake Rhodhiss
PCF. The existing limits are:
Qw = 7.5 MGD
BOD5 = 18 mg/1
NH3-N = 8 mg/1
D.O. _
TSS = 30 mg/1
------Phosphorous = 1.0 mg/1*
Fecal Coliform = 2001i/100ml
pH = 6-9 S.U.
*This limit is required by EPA in connection with the 201 Grant for this
facility and is not to be interpreted as a limit imposed by the State of N.C.
Mr Whitley requests that the BOD limit of 18 mg/1 be changed to BODS = 30 mg/1,
and the NH3-N limit of 8 mg/1 be changed to NH3-N = 5 mg/l. All other effluent
limits would remain the same. I have discussed this trade-off of BOD5 vs. NH3-N
with Keith Overcash in the Mooresville Regional Office and he has no objections.
Since the BODult would be the same, I recommend that his request be approved.

is accessary in this case. Upon completion of the staff review,
we will either agree to a reissued permit accommodating the
matters wnicil you nave addressed, rant the Adjudicatory Hearing,
or deny the Ac1juuicatory nearing as being inappro_rrlate. A
preliminary review of the request concerning the compliance sche-
uule indicates that the request is reasonable and should have been
reflected in the permit. The request for modification in the
effluent 1i.:ta is not at this time a clear issue and until the
ataCx nits completed its review, no indicated course of action is
projected.

Re: NPDES Permit Number 0041696 - Town of Valdese
Dear Mr. McRorie:
Per my letter of December 14, 1978, requesting an adjudicatory
hearing concerning the schedule for compliance, we also respec-
tively request a change in the effluent limits for five day BOD
and ammonia nitrogen as contained in the subject permit. We
request that the five day BOD be changed from 18 mg/1 to 30 mg/1
and ammonia nitrogen from 8 mg/1 to 5 mg/1. These limits are in
accordance with our request and application for a NPDES Permit.
Please note that we do not anticipate changing the ultimate
oxygen demand of our proposed effluent.
We trust that you will find this request in order and look
forward to your early approval.

Burke County
Please find attached copies of all recent correspondence between this
Office and the Town of Valdese concerning the subject Permit. Also attached
are copies of the two letters to Mr. McRorie requesting a modification of
the construction time schedule in the NPDES Permit for the proposed Lake
Rhodhiss PCF. The Town also requested an adjudicatory hearing in the letter
dated December 14, 1978, and they have not received a response to either
letter.
It is requested that you keep this Office informed as to the status of
this matter. If this Office needs to take any additional action, please
advise.

Dear Mr. 0vercash:
Per my recent letter to you responding to your inspection report and per
your conversation with Dave Rust of January 23, please find attached
(1) a copy of Mr. A. F. McRorie's letter transmitting the referenced
discharge permit; (2) a copy of the Schedule of Compliance; (3) a copy
of my October 30, 1978, letter to Mr. McRorie; and (4) a copy of my
December 14, 1978, letter to Mr. McRorie. Please be advised that i
have received no response from Mr. McRorie as to the official request
for an adjudicatory hearing. Be it known that per the second paragraph
of Mr. McRorie's letter transmitting the permit, the Town of Valdese
has made an official request for a hearing on the beginning construction
date, that the State has not responded, therefore, it is the position of
the Town of Valdese that the discharge permit NC-0041696 is not final nor
binding. The Town of Valdese has and will continue to expedite the
construction of the Lake Rhodhiss Plant in every possible manner.
Your assistance in resolving this matter will be appreciated.

Re: Response to December 20, 1978, Compliance Evaluation Analyses
Dear Mr. Lynch:
Per Keith Overcash's letter of December 20, 1978, please be advised that
the Town of Valdese has submitted the plans and specifications documents
for the Lake Rhodhiss Pollution Control Facility (NC0041696) to both DEM
and EPA for their review and approval as of the early part of January.
Also please be advised that on your Compliance Evaluation Inspection
Report it is indicated that construction on the Lake Rhodhiss project
shall begin by March 31, 1971. The Town of Valdese has formally requested
a revision of this date to be June 30, 1979. To date, DEM has ignored our
request for an official meeting on this matter.
As to the Industrial Monitoring and Reporting Program, we have been
monitoring the industries as required by EPA and have reports available
on same. We will, however, begin forwarding a copy of each quarterly
report to you beginning with the next quarter (April, 1979).
If I can be of further assistance, please advise.

In accordance with your application for discharge Permit received
February 18, 1978, we are forwarding herewith the subject State - NPDES
Permit. This Permit is issued pursuant to the requirements of North
Carolina General Statutes 143-215.1 and the Memorandum of Agreement
between North Carolina and the U. S. Environmental Protection Agency
dated October 19, 1975.
If any parts, requirements, or limitations contained in this Permit
are unacceptable to you, you have the right to an adjudicatory hearing
before a hearing officer upon written demand to the Director within 30
days following receipt of this Permit, identifying the specific issues
to be contended. Unless such demand is made, this Permit shall be final
and binding.
Please take notice that this Permit is not transferable. Part 11,
B.2. addresses the requirements to be followed in case of change in
ownership or control of this discharge.
This Permit does not affect the legal requirement to obtain other
Permits which may be required by the Division of Environmental Management.
If you have any questions concerning this Permit, please contact us.

B. SCHEDULE OF COMPLIANCE
1. The permittee shall achieve compliance with the effluent limitations
specified for discharges in accordance with the following schedule:
a. Begin construction on or before March 31, 1979.
b. Submit a progress report on or before December 31, 1979.
c. Submit a progress report on or before September 30, 1980.
d. Complete construction on or before March 31, 1981.
e. Attain operational level on or before June 30, 1981.
2. No later than 14 calendar days following a date identified in the above
schedule of compliance, the permittee shall submit either a report of
progress or, in the case of specific actions being required by identified
dates, a written notice of compliance or noncompliance. In the latter
case, the notice shall include the cause of noncompliance, any remedial
actions taken, and the probability of meeting the next scheduled requirement.

Per your public notice of October 10, 1978, the draft NPDES Permit for
the Town of Valdese, the Lake Rhodhiss Pollution Control Facility, please
be advised that the Town of Valdese takes no exception to any part of the
draft permit except that we would ask the >chedul a of compliance as shown
on M4 to be changed such that cons truc t on shall begin on or before June 30,
1979, instead of March 31, 1979. No other change, or amendments are
requested.
This amendment is requested to make the Ni,ES Permit schedule of compliance
to coincide with the schedule the Town of Valdese has previously established
with the Farmers Home Administration and the Enyironmental Protection Agency,
If additional information or justification of this request is desired, please
advise.
