THE TOWN OF VALDESE IS NOT REQUIRED TO MONITOR FOR MERCURY. Every month, BIMS calculates subject facility to be in violation of its monitoring requirement for mercury. Sporadically, for two years, I have entered "BIMS calculation error" in response to the erroneous mercury monitoring "violation". To date, the information in BIMS has not been updated. Your assistance in remedying this error would be appreciated. Please contact me if there are questions or a need for additional information. Box 339 Valdese, North Carolina 28690-0339 Subject: NPDES Permit Modification Permit No. NC0041696 Town of Valdese — Lake Rhodhiss WWTP Burke County Dear Mr. Morse: In accordance with your request for a re-evaluation of the effluent limitation and monitoring for mercury as in the current NPDES discharge permit, staff has reviewed the data submitted in the March 5, 2002 letter. A statistical analysis of the data was performed to determine the potential for exceedance of the instream water quality standard for mercury. The results indicated that there was no potential for the standard to be violated based on the data. Therefore, the NPDES Unit is recommending that the effluent limitation and monitoring requirement for mercury be removed from the Valdese permit. Mercury data will still be collected through the facility's pretreatment program and will be evaluated upon permit renewal in 2005. The Town of Valdese should be aware that mercury continues to be a water quality concern throughout North Carolina. Holders of NPDES permits have worked with the state to reduce potential risks from this pollutant, including tasks associated with collecting and reporting more accurate data. The most commonly used laboratory analysis (EPA Method 245.1) has a detection limit of 0.2 ug/L while the current water quality standard is an order of magnitude lower at 0.012 ug/L. A more recently approved analytical test (EPA Method 1631) should produce a detection limit below the level of the standard. This will allow the Division to assess potential water quality impacts from discharges more accurately. Therefore, beginning on or before September 1, 2003, you will be required to begin using EPA Method 1631 when analyzing for mercury. Accordingly, we are forwarding herewith these modifications to the subject permit. Please find enclosed the amended effluent pages for outfall 001, which should be inserted into your permit. The old pages should be discarded. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. 1617 Mail Service Center, Raleigh, North Carolina 27699-1617 Telephone 919-733-5083 FAX 919-733-0719 An Equal Opportunity Affirmative Action Employer 50% recycled/ 10% post -consumer paper F , . • j mit No. NC0041696 Valdese WWTp May 31, 2002 Page 2 tkvi unacceptable any t parts, measurement frequencies or sampling requirements contained P o you, you have the right to an adjudicatory hearing upon written inthispermit are (30) days following receipt of this letter. ,This request mustquest within conforming to Chapter I SOB of the North Carolina General Statutes,in the form of a written petition Administrative Hearings, 6714 Mail Service Center, Raleigh, North and filed with the office of a demand is made, this permit shall be final and binding. g ' Carolina 27699-6714.
