Dear Mr. Morse:
In accordance with your request for a re-evaluation of the effluent limitation and monitoring for
mercury as in the current NPDES discharge permit, staff has reviewed the data submitted in the March 5,
2002 letter. A statistical analysis of the data was performed to determine the potential for exceedance of
the instream water quality standard for mercury. The results indicated that there was no potential for the
standard to be violated based on the data. Therefore, the NPDES Unit is recommending that the effluent
limitation and monitoring requirement for mercury be removed from the Valdese permit. Mercury data
will still be collected through the facility's pretreatment program and will be evaluated upon permit
renewal in 2005.
The Town of Valdese should be aware that mercury continues to be a water quality concern
throughout North Carolina. Holders of NPDES permits have worked with the state to reduce potential
risks from this pollutant, including tasks associated with collecting and reporting more accurate data.
The most commonly used laboratory analysis (EPA Method 245.1) has a detection limit of 0.2 ug/L
while the current water quality standard is an order of magnitude lower at 0.012 ug/L. A more recently
approved analytical test (EPA Method 1631) should produce a detection limit below the level of the
standard. This will allow the Division to assess potential water quality impacts from discharges more
accurately. Therefore, beginning on or before September 1, 2003, you will be required to begin using
EPA Method 1631 when analyzing for mercury.
Accordingly, we are forwarding herewith these modifications to the subject permit. Please find
enclosed the amended effluent pages for outfall 001, which should be inserted into your permit. The old
pages should be discarded. This permit is issued pursuant to the requirements of North Carolina General
Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S.
Environmental Protection Agency.

If any parts, measurement frequencies or sampling requirements contained in this permit are
unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty
(30) days following receipt of this letter. This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, North Carolina 27699-6714. Unless such
a demand is made, this permit shall be final and binding.
Please take notice that this permit is not transferable. Part II, E.4. addresses the requirements to
be followed in case of change in ownership or control of this discharge.

In late 2000, the Town of Valdese received a draft permit for the Lake Rhodhiss Wastewater
Facility. In that permit, it was recommended that mercury be monitored weekly with a 0.25 rrg / 1
limit, which we felt was excessive because of low historical occurrences in our discharge. Upon
mediation with Jacquelyn Nowell, we agreed with a monitoring frequency of twice per month for a
period of 1 year. And if during that timeframe, our effluent showed no signs of mercury, we could
submit a request to the NPDES Unit asking for the removal of this characteristic from our permit and
sampling routine.
At this point in time, we formally request the removal of mercury monitoring from the permit.
Analytical results for the past 12 months are enclosed for your review and show that each instance
yielded a non -detect (ND). If there are concerns regarding the removal, we ask for another
mediation period or that contact is made with Alan Abee (Plant Superintendent) and/or Chris
Bortnick (Lab Director) for this facility. We thank you for your attention in this matter.
