Skvarla, III Secretary The Division of Water Resources received the Year 1 Monitoring Report for the above - referenced site, dated April 12, 2013. Based on review of the monitoring report, streams at the site appear to be generally stable with isolated areas of bank erosion/undercutting, and mid - channel bar formation. No significant problem areas were identified. Hopefully, the downed trees associated with the tornado damage will not negatively affect the channel stability. The construction of the sewer line after the mitigation site was constructed poses a problem. It is unclear how the sewer line was constructed after a conservation easement was in place on the project site. None of the figures provided in the report show the location of the sewer line or its effects on the restored riparian zone. Please provide information on how /why the sewer line was constructed within the conservation easement, and a site plan showing the extent of cleared /maintained land within the easement. Vegetation monitoring data show that all monitoring plots met performance standards, although only four plots are present on the site. It appears that portions of the site were not planted, and were presumably forested. However, the plan sheet appear to show that vegetation plots 1, 3 (partial) and 4 are not located within planted areas (green cross - hatching). Please clam. Easement/buffer widths appear to be narrower than standard at several locations (Sta. 22 +00 and Sta. 18 +00 to 20 +00). These areas may result in stream credit adjustment depending on the total extent of narrow buffer areas on the site. The sewer easement may affect credits as well. In addition, Table 4 lists the McKee Creek project as providing cool -water stream credits.
