Lenoir -Gunpowder Creek WWTP 030833 6/20/94 JMN Mike Waresak, consultant engineer for the Town called and wanted to know if a toxicity evaluation would have to be done prior to completion of the EA. I had written in spec letter (5/25/'94) to Lenoir that because of inconsistencies in the toxicity test that a tox evaluation may have to be done. I called Matt Mathews and asked who determines when a tox evaluation needs to be done. He said that the Regional Office is the lead group on this situation. The Town should start looking at operational changes, look at new industries that have tied on, etc. He said that a THE -phase I identification procedures are usually parts of SOCs. The Region will advise the Town that they are subject to NOVs based on failures of tox test. Matt said that 9 out of 10 times TREs originate as parts of Special Orders. Sometimes, Town start these evaluations on their own, which is good. He would think that a Town that has failed 2 of the last 3 tests, and is looking at expanding should probably do an evaluation. However, sometimes AQ TOX and the Regions differ on when TREs should be done. Called Jim Reid of ARO, asked whether the Region would be recommending a THE based on the Town's recent failures. He said that he did not think that it merited doing one right now, prior to completion of the EA. A THE could be done at a later time if Town continued to have problems. Would check with Keith Haynes, ARO toxicity person, and would call me back if they were going to recommend that it be done. Said that he would call Mike Waresak back with a response. Box 958 Lenoir, N.C. 28645-0958 FPFA iiif QE-INJ I Subject: Lenoir- Gunpowder Creek Wastewater Treatment Plant Expansion NPDES Permit No. NC0023736 Caldwell County Dear Mr. Childers: Your request for speculative effluent limits for the proposed expansion of the Lenoir - Gunpowder Creek WWTP to 2.0 MGD has been completed by the staff of the Technical Support Branch. In order to receive final permit limits, a formal application will have to be submitted to the Division's Permits and Engineering Unit. It should also be noted that an expansion of more than 0.5 MGD for an existing facility will require that an environmental document be prepared by the applicant. The N.C. Environmental Policy Act and its associated rules requires that an environmental assessment (EA) and Fonsi (Finding of No Significant Impact) be prepared before application for a permit expansion is submitted. If deemed appropriate, an environmental impact statement (EIS) might be necessary. Monica Swihart of the Water Quality Planning Branch can provide further information regarding the EA requirement. North Carolina is evaluating all NPDES dischargers for ammonia toxicity following the Environmental Protection Agency (EPA) guidance to protect the waters for an instream criteria of 1 mg/1 in the summer and 1.8 mg/1 in the winter, under 7Q10 flow conditions. An acceptable level of chlorine in your effluent is 28 µg/1 to ensure protection against acute toxicity. The process of chlorination/dechlorination or an alternate form of disinfection, such as ultraviolet radiation, should allow the facility to comply with the total residual chlorine limit. The instream waste concentration (IWC) at the expanded flow of 2.0 MGD is 52%. A chronic toxicity testing requirement with quarterly monitoring will remain a condition of the NPDES permit. The Town may have to conduct a toxicity evaluation because test results at the current toxicity limit of 38% have been inconsistent. A complete evaluation of limits and monitoring requirements for metals and other toxicants will have to be addressed at the time of formal NPDES application. Information concerning these constituents is not readily available but the Town can assume that effluent limits and/or monitoring for cadmium, chromium, nickel, cyanide, lead, copper, zinc, and silver will continue. It is recommended that instream monitoring for temperature, dissolved oxygen, fecal coliform, and conductivity be continued. In addition, instream monitoring for total phosphorus, total nitrogen, chlorophyll a, and pheophytin a, upstream of and in the pooled area of the Old Millpond should continue to assist in determining whether the Gunpowder Creek discharge is creating the potential for eutrophication in that waterbody. DEM is implementing a basinwide water quality management initiative. Our schedule for the Catawba River Basin is set for 1995. The plan will attempt to address all sources of point and nonpoint pollutants where deemed necessary to protect or restore water quality standards. In addressing interaction of sources, wasteload allocations may be affected. Those facilities that already have committed to high levels of treatment technology are least likely to be affected. This information should provide some assistance in your planning endeavors. Final NPDES effluent limitations will be determined after a formal permit application has been submitted to the Division. The plant is currently operating at over 90% of its design capacity of 1.0 mgd (average daily flow) during the wet season and the City is evaluating several treatment processes to determine the most effective process for expansion of the plant. The plant discharges into Gunpowder Creek at the location shown on the attached Location map. In order for the City to more accurately evaluate the costs and designs of the alternative treatment processes, we respectfully request that you provide us with speculative NPDES permit limits for a design capacity of 2.0 mgd.
