Good afternoon, PIS see below email to access the As -built Report for Daniels Creek. This was delivered using our ftp site due its size and looks like access expires this Sunday. Also, pls take a look at their YouTube drone footage for each individual reach. In fielding an inquiry from Chris on temperature data loggers, I have asked Wildlands to develop a protocol for establishing a start of the growing season timeframe if wanting to claim a pre -March 1 date. Along with the temperature readings, this would include documenting vegetative indicators set forth in the AGCP Regional Supplement Manual: "The growing season has begun on a site when two or more different non -evergreen vascular plant species growing in the wetland or surrounding areas exhibit one or more of the following indicators of biological activity: a. Emergence of herbaceous plants from the ground. b. Appearance of new growth from vegetative crowns (e.g., in graminoids, bulbs, and corms) c. Coleoptile/cotyledon emergence from seed d. Bud burst on woody plants (i.e., some green foliage is visible between spreading scales) e. Emergence or elongation of leaves of woody plants f. The Bank's initial project site is Daniels Creek Mitigation Site located in Broadway, Harnett County, North Carolina. Additionally, please reference Mr. Jordan Jessop and my March 23, 2021 onsite inspection of the bank's construction with Mr. John Hutton of Wildlands. Based on the submitted report and the inspection, our office has confirmed that all initial construction and biological improvements have been completed and that Milestone 2 requirements have been satisfied. Additionally, our office acknowledges that the tables in the enclosed modified credit release schedules have been adjusted to reflect the results of the as -built or baseline measurements. By fulfilling Milestone 2, this letter serves to confirm the release of 15% of all credits, which total 2.097 riparian wetland credits, 0.059 non -riparian wetland credits, and 1,765.2 stream credits. To date, the cumulative release of credits total 4.177 riparian wetland credits, 0.118 non - riparian wetland credits, and 3,607.2 stream credits. The release of additional credits will be contingent on the review of the subsequent monitoring reports by the Interagency Review Team and our office. Under no circumstances shall any mitigation project be debited until the necessary DA authorization has been received for its construction or the District Engineer (DE) has otherwise provided written approval for the project in the case where no DA authorization is required for construction of the mitigation project. The DE, in consultation with the Interagency Review Team (IRT), will determine if performance standards have been satisfied sufficiently to meet the requirements of the release schedules below. In cases where some performance standards have not been met, credits may still be released depending on the specifics of the case. Monitoring may be required to restart or be extended, depending on the extent to which the site fails to meet the specified performance standard. The initial allocation can be released without prior written approval of the DE upon satisfactory completion of the following activities: a. Execution of the UMBI by the Sponsor and the USACE b. Approval of the Final Mitigation Plan c. Recordation of the conservation easement, as well as delivery of a title opinion that is acceptable to the USACE. d. Delivery of the financial assurances described in the Mitigation Plan. e. 404 permit verification for construction of the site, if required. Daniels Creek Mitigation Site Appendix 9 USACE Action ID No. SAW-2017-00998 Page 3 updated August 2021 1.2 Subsequent Credit Releases All subsequent credit releases must be approved by the DE, in consultation with the IRT, based on a determination that required performance standards have been achieved. For stream projects, a reserve of 10% of a site's total stream credits shall be released after four bankfull events have occurred in separate years, provided the channel is stable and all other performance standards are met. In the event that less than four bankfull events occur during the monitoring period, release of these reserve credits shall be at the discretion of the IRT. As projects approach milestones associated with the credit release, Wildlands will submit a request for credit release to the DE along with documentation substantiating achievement of criteria required for release to occur.
