Consequently, the Division of Water Resources has issued several Notices of Violation (NOVs) and Civil Penalty Assessments (CPAs) in response to non-compliance with Non - Discharge Reclaimed Water Permit No. WQ0014306. Such NOVs and CPAs are referenced in provided attachments. Please note, both past and any continued chronic WWTP facility non-compliance, whether failure to satisfy performance monitoring limits or operational conditions, may jeopardize the Division's ability to support approval of future sewer line extension projects that would direct new wastewater flow to the Eagle Creek WWTP. In addition, chronic facility non-compliance may also result in establishment of a sewer moratorium prohibiting further sewer extensions and connections while in affect. The Division welcomes dialogue related to resolution of any outstanding Eagle Creek WWTP operational performance concerns, along with any facility improvements that may be necessary to allow the plant to perform properly.
