Dear Ms. Johnson:
The North Carolina Division of Water Resources conducted an inspection of the Atlantic Beach Seafood Market
on February 9, 2022. This inspection was conducted to verify that the facility is operating in compliance with
the conditions and limitations specified in NPDES WW Permit No. NCG530169. A summary of the findings and
comments noted during the inspection are provided in the enclosed copy of the inspection report.
The Compliance Evaluation inspection was conducted by Division of Water Resources staff from the Wilmington
Regional Office. The following deficiency(s) was noted during the inspection:
Inspection Area Description of Deficiency
Record Keeping Annual monitoring permit requirement has not been conducted for 2021.
Remedial actions should have already been taken to correct this problem and prevent further occurrences in the
future. The Division of Water Resources may pursue enforcement action for this and any additional violations of
State law. To prevent further action, carefully review these deficiencies and address the causes of
non-compliance to prevent the recurrence of similar situations.

A compliance inspection of Atlantic Beach Seafood was conducted by Megan Faulkner on 2/9/2022.
The facility was not compliant with permit NCG530169 and a Notice of Deficiency is being issued.
The facility has been operating since March 2016. Sampling was conducted prior to hurricane
Florence, but records were lost due to flooding in the storm. Records were available for 2020 and
2022, and the owner stated that the facility has a contract to have samples taken per their permit
requirements.
The outfall pipe for discharge extends to the end of the dock and allows for safe sampling. The sinks
have screens to catch solid particles for proper disposal. No solids can be discharged to receiving
waters. Sampling has been done for 2022, and 2 out of 3 years of records were available for
evaluation by DWR. Annual records should be kept on site for a minimum of three years and
available for inspection upon request by the Division.
