We respectfully submit this application for a Fast Track Sewer System Extension Application for the Poplar Creek
W WPS Upgrade project. This project upgrades the existing Little Poplar Branch Pump Station, and replaces a 4-inch
force main with approximately 298 linear feet of 6-inch force main and 126 linear feet of 6-inch field-lok PVC encased in
126 linear feet of 12-inch diameter steel. The upgrade will reduce maintenance costs, improve pumping efficiency, and
will help with future growth in the area.
Included in this submittal are two copies (one original, one copy) of the following
documentation:
• Fast Track Application (Form: FTA 06-21)
• USGS Quad Maps
• Project Narrative
• Check No. 120201 in the amount of $480,00

THIS AGREEMENT, dated l 3 , 2000, between JOHNSTON
COUNTY, hereinafter referred to as "County", and WHM-EY HEIGHTS SANITARY
DISTRICT, hereinafter referred to as "WHSD".
WITNESSETH:
WHEREAS, WHSD desires to have the County provide operation, maintenance, and
administrative services for its existing water distribution system and its proposed wastewater
collection system; and
WHEREAS, WHSD currently purchases its bulls water supply from the County; and
WHEREAS, WHSD desires to have its wastewater received, transmitted, and treated by
the County; and
WHEREAS, County has the resources to provide operation, maintenance, and
administrative services for the WHSD water distribution system and proposed wastewater
collection system, and to receive, transmit, and treat the wastewater from WHSD.
NOW, TMURMFORE, for and in consideration of the premises and rights, powers and
duties hereinafter set forth to be performed by each, the sufficiency of which are acknowledged
by the parties, County and WHSD mutually do agree as follows:
I, WHSD will install at its own cost a wastewater collection system meeting the
County` s design and construction standards and shall allow the County's representatives to make
inspections of construction periodically.
2. WHSD will be responsible for payment of the remaining debt on its water distribution
system.
3, WHSD will pay to the County, on or before the date the County commences water and

sewer operation, maintenance, and administrative services, a water meter setting fee and a 91
wastewater capacity fee as follows:
-Water meter setting fee: $75 per existing service.
Wastewater capacity fee. $2,000 per existing service -zc
4. For any sewer customers who have individual well supplies, WHSD will install or will
have installed a meter on the well head meeting County standards and will have the customer
provide the County an access easement for purposes of making meter readings.
S. WHSD agrees that for any new service, assessment and connection fees will be
consistent with the County's rates in effect at the time.
H. County AgLee&s as Fnto
1. The County will install its service meters in each existing water service in the WHSD
systern and will deliver the existing meters to the WHSD.
2. The County will operate, maintain, And repair the existing WHSD distribution system
including all services up to and through the outlet side of meter boxes.
3. The County will cease to read the WHSD master meter for billing purposes and will
cease billing WHSD for bulk water supply.
4. The County will operate, maintain, and repair the proposed wastewater collection
system including sewer services within public rights of way and easements including up to two

wastewater pump stations.
5. The County will read water meters monthly and will bill the WHSD customers for
retail water and sewer service. The Water rates shall be the same as for the Wilson's Mills Water
District and the sewer rates shall be the County's standard retail sewer rate for areas outside the
Central Johnston County Regional Wastewater System. As of the date of this Agreement, the
user rates are:

b. The County will administer water and sewer services in accordance with its Uniform
Policy.
III. ADDITIONAL COVENANTS AND AGREEMENTS:
I. Qm=hip of Infrastructure: It is understood that the water distribution collection
infrastructure within the WHSD boundaries shall remain the property of WHSD until the bond
debt on the water system is retired. Thereafter, the water system shall be transferred to the
County for ownership. All sewer infrastructure shall be conveyed to the County for permanent
ownership one year from the date of substantial completion of construction and startup of the
system,
2. Terms. Terms of this Agreement shall be thirty (30)'years, with four (4) automatic
renewals for five (5) years each, unless a six (5) month written notification of intent to terminate
is provided by either party to the other.

boundaries of WHSD, plus any gravity sewer lines which extend outside WHSD to pump
station(s) site(s).
4. Xns ections. WHSD shall permit periodic inspections of the sewer system during
construction by County to ensure compliance with State Plumbing Code and County utility
standards and specifications.
5. Notices. Any notices required to be, given by this Agreement shall be deemed to have
been sufficiently given if mailed by certified mail (return receipt requested), postage prepaid,
addressed as follows:

6. This writing embodies the entire agreement and utiderstanding
between the County and WHSD, and there arc no other agreements or understandings, oral or
written, with reference to the subject matter hereof that are not merged herein and superseded
hereby.
7. Binding Upon Successors and,Asigns. This Agreement shall be binding upon and
shall inure to the benefit of the County and WHSD and the successors and assigns of each.
8. Amendment. This Agreement shall not be modified, amended or changed in any

respect except in writing, duly signed by the parties hereto, and each party hereby waives any
right to amend this Agreement in any other way.
9. e Date. The term of this agreement shall be effective on the date of substantial
completion and startup of the wastewater system.
IN WITNESS WHEREOF, Johnston County has caused this Agreement to be executed
by its Manager and Clerk, acting under authority of the Board of Commissioners of Johnston
County, and Whitley Heights Sanitary District has caused this Agreement to be executed by its
Chairman and Secretary.
