Mr. Brame, Mr. Hopper, Ms. Homewood, I hope this email finds each of you doing well. I response to your comments and questions: - I designed lots 22 and 23 two dimensionally, and although I knew that there would be some fill slope associated with pad construction, I did not realize how far it would extend until after Mr. Stimpson had created the 3 dimensional civil design portion. Once I realize that there would be wetland impact, I had Mr. Brame submit application for impact. I will re -design, moving the pad on 22 to the north and east to get the fill slope out of the wetland. I will likely not be able to move the proposed pad on 23 far enough, so I will simply have to eliminate that lot to avoid impact. I provide no defense that the subdivision is infeasible with the loss of one lot, and willingly make that concession. - The creek crossing location was chosen based on several factors (location of the terminus of the road we plan to extend, horizontal and vertical criteria for public roads, etc.), but was also very strongly dictated by wishing to cross as close to perpendicular as possible (which mitigates impact) AND the location of the buried Colonial pipelines. Their depth is a limiting factor, and the proposed location of our creek crossing is designed to miss an angle (bend) in their lines and shallow placement. They have approved the current road location, and that has been an arduous (and expensive) task. I really see no ability to change the location of my proposed crossing, but am both willing and desirous to effectuate a design and construction which mitigates impact. Arnold Road). We have reviewed and need additional information to ensure the application is complete. 1. The USACE shares the same concern for lots 22 and 23. Please provide a copy of your response to NCDWR for our review and consideration. 2. Mitigation for wetland impacts for the USACE begins at 0.1 acre. Because what is proposed is within 1/1000 of that threshold, please provide assurances this will be achieved through detailed impact exhibits. Justification for the need for this impact is also requested. Please note, an as -built survey may be required after construction is complete. 3. Please provide more justification for the placement of the stream crossing proposed. More armoring is proposed on the upstream side of this crossing than downstream. Please elaborate on the concerns the designers are attempting to address. Note that additional questions may be asked once more detail is provided. Also please consider a different fill pattern for rip -rap on engineering exhibits, as what was used obscures the resources below. The statement that the wetland needs to be filled to accommodate lots 22 and 23 is insufficient to support that the project has minimized impacts to the maximum practical. Please provide avoidance of these wetland impacts or provide additional justification for why the subdivision is infeasible with the removal, or resizing of these 2 lots out of the total 72 lots. 2. The wetland impacts listed for this project are 0.099.
