the energy of the stream flow during larger events. Based on photos submitted, it may be
more prudent to work within the existing pattern and conduct bank work where needed. It is
obvious that benching and laying the banks back at the two area below would be conducive to
more stable/viable banks. Other photos the issue was much less obvious

UT McAlpine Creek Phase 1 B Responses to Comments from ACOE
On December 7, 2021, GPI submitted the Pre -Construction Notification for the stream restoration
of UT to McAlpine Creek located in Mecklenburg County, North Carolina. The following are (1)
the missing items requested as well as (2) a response to the comments about tight meanders
posed by Alan Johnson. Also included is (3) a response to NC Wildlife Resource Commission's
comments on the planting plan.
(1) Comments on initial PCN Submittals:
a. The PCN lacked or didn't clearly define the applicant for the proposed project.
Typically, consultants complete Section B(1)(d) which may help to define the applicant.

person/company who hired you) and the consultant. Without this signed authorization,
the consultant cannot act on behalf of the applicant during the permitting process.
Therefore, provide a signed Agent Authorization Form from the applicant.
Attached below is the Agent Authorization Form.
c. The PCN lacked the proposed impacts inventory. All temporary and permanent stream
and/or wetland impacts need to be listed within this section. Therefore, please
complete Section D, Proposed Impacts Inventory and revise the PCN accordingly.
The proposed stream impacts are temporary and consist of approximately 700
LF of perennial stream. This impact will only occur while the restoration project
is in the construction phase. We did not consider this as an impact because
during the initial PCN submittal because of the purpose of the project being the
enhancement of the stream to a higher ecological function. Conducting a
functional lift assessment of the existing and proposed conditions the proposed
design will offer a functional lift of over 500% to the stream section. This
enhancement is derived from creating a more stable stream corridor through
reconnecting the stream to the floodplain, increasing sinuosity, and restoring
the piedmont riffle pool sequence and enhancing vegetation along the reach; as
opposed to, the current stream profile that consist of a fairly straight, heavily
entrenched reach channel with no riffle pool sequence and multiple vertical

drops in excess of multiple feet. This enhancement will increase ecological
activity and create a more stable ecosystem and stream morphology. The
stream has an existing average bankfull width of approximately 7 FT.
(2) Comments From Alan Johnson:
a. Comments: "The meanders appear to be too tight and could cause more erosion
in the meanders due to the energy of the stream flow during larger events. Based
on photos submitted, it may be more prudent to work within the existing pattern
and conduct bank work where needed. It is obvious that benching and laying the

b. Response: Thank you for your comments, we have run hydraulic models on
the proposed design and have found that the current proposed design yields
an average shear stress and stream power that are reasonable for a stream
and watershed of this size and characteristics. These parameters also
seemed reasonable when comparing to a similar project within the
Ballantyne community we are currently working on. Our design mimicked
the stream restoration design of similar magnitude for a nearby stream
restoration project located within 1/4 mile from the UT McAlpine Phase 1 B
project. The nearby stream design was done in conjunction with expert
guidance from Dr. Greg Jennings and similar dimensionless ratios were
used to guide the design for UT to McAlpine Phase 1 B. Upon further
examination of the dimensionless ratios and stream parameters provided
within the drawings that were sent with the PCN application we noticed the
discrepancies that were hold overs from a past project that we have
corrected. We have also included a sketch (below Figure 1) of an alignment
change in an approximately 100-foot section just upstream of the proposed
bridge the proposed change will increase the radius of curvature of the bend
and better alleviate shear and erosion at a critical bend before the proposed
bridge. The proposed design increases the entrenchment ratio from an
existing 1.1 to a 2.2. This reconnection will offer a large amount of energy
dissipation into the floodplain during storm event and help mitigate the bank
failures as depicted in the existing condition photos provided in the PCN. As
previously mentioned, the opportunity to restore the riffle -pool sequence by
doing a full restoration is prudent. The existing stream lacks a riffle -pool
sequence typically seen within nearby streams, with several large vertical
drops. The modeled stream power and shear stress along with the
dimensionless ratios used allowed our design team to feel confident that for
radii chosen along with the new channel geometry and would be stable in
most storm event and not lead to bank failure.

SPECIAL CONDITIONS
a. The Permittee shall submit a photographic monitoring report to the Corps project manager responsible
for Mecklenburg County within 30 days of the completion of work authorized by this verification and
for three (3) consecutive years following the completion of the stream restoration and enhancement
activities. The collected data shall be submitted no later than December 31st annually for those three (3)
years.
b. Please be advised that if additional impacts to waters of the U.S., either on this property or on/adjacent
to this property and associated with this project/activity, are proposed at a later date, those impacts will
be combined with the current impacts to waters of the U.S. and will be reviewed cumulatively.
Generally, compensatory mitigation will be required if individual or cumulative (i.e., past and present)
losses or degradation of waters of the U.S., are greater than 150 linear feet of perennial or intermittent
stream channel and/or 0.1 acre of wetland. Additionally, cumulative impacts that result in the loss or
degradation of greater than 300 linear feet of perennial or intermittent stream channel and/or 0.5 acre of
wetland, will be processed under an Individual Permit. This verification of the use of the Nationwide
Permit Program for this project does not imply that this office will necessarily approve any future
proposal to impact waters of the U.S. on this property and/or associated with this project/activity.

Information about the proposal subject to one or more of the Corps regulatory authorities is

2.0 Evaluation of the Pre -Construction Notification
2.1 Direct and indirect effects caused by the GP activity: The direct effects of the
proposed activity in waters would include the loss of jurisdictional waters (as
specified in Section 1.3) and their associated aquatic resource functions. The
proposed activity also has the potential to result in indirect effects to waters
including excess sedimentation in downstream waters, disruption and/or killing
of aquatic life in the direct vicinity of the project area, increase of downstream
flows, and blocking/restricting aquatic life passage transiting in and through the
project area. These indirect effects are expected to be minimal due to design
criteria and Best Management Practices (BMPs) required by Nationwide Permit
General and Regional Conditions. Additionally, indirect effects would be further
reduced through the implementation of BMPs required by state, local, and
Federal ordinances and regulations.
2.2 Site specific factors: The review area consists of a vegetated/forested strip of land.
The surrounding land use consists of a golf course and commercial
developments.
2.3 Coordination
2.3.1 Interagency Coordination
Was the PCN coordinated with other agencies? Yes. Agency coordination with the
USFWS is required for the Northern Long Eared Bat. However, the Corps is not required
to wait for a response from the USFWS Asheville Office in accordance with local
procedures.
2.3.2 Corps internal coordination
Was the PCN coordinated with other Corps business lines? No.
3.0 Mitigation
Provide brief description of how the activity has been designed on -site to avoid and minimize
adverse effects, both temporary and permanent, to waters of the United States to the
maximum extent practicable at the project site: The applicant provided a detailed statement
describing their efforts to avoid and minimized impacts to waters of the United States
on the project site in the preconstruction notification. Based on this information, the
Corps believes the applicant has avoid and minimized impacts to waters of the United
State to the maximum extent practicable.
Describe other mitigative actions including project modifications implemented to minimize
adverse project impacts? (see 33 CFR 320.4(r)(1)(i))
The proposed project consists entirely of restoration/enhancement activities.
3.2 Compensatory mitigation requirement
Is compensatory mitigation required for unavoidable impacts to jurisdictional aquatic resources
to reduce the individual and cumulative adverse environmental effects to a minimal level?
No.
Provide rationale: No compensatory mitigation is required because the activity consists
entirely of restoration activities.
4.0 Compliance with Other Laws, Policies and Requirements
4.1 Section 7(a)(2) of the Endangered Species Act (ESA)
4.1.1 ESA action area:
The action area includes the waters of the United States that will be directly affected by
the proposed work or structures and uplands directly affected as a result of
authorizing the work or structures.
4.1.2 Lead federal agency for Section 7 of the ESA
Has another federal agency taken steps to document compliance with Section 7 of the ESA
and completed consultation(s) as required? No.
4.1.3 Listed/proposed species and/or designated/proposed critical habitat
Are there listed or proposed species or designated critical habitat or proposed critical habitat
that may be present or in the vicinity of the Corps' action area? No. The Corps has
determined that it has fulfilled its responsibilities under Section 7(a)(2) of the ESA.

Effect determination(s), including no effect, for all known species/habitat, and basis for
determination (s): Based on the latest version of the Natural Heritage Program's NHEO
data, there are no protected species located within or in the vicinity of the action area.
The Corps has determined the proposed activity will not directly or indirectly affect any
species subject to the ESA. In addition, on December 7, 2021, the Corps consulted the
most recent version of the USFWS database for the presence or absence of federally -
listed species within a 2-mile radius of the proposed project No federally -listed species
are within this 2-mile radius.
4.1.4 Section 7 ESA consultation \
Consultation with either the National Marine Fisheries Service and/or the U.S. Fish and Wildlife
Service was initiated and completed as required, for any determinations other than "no effect"
(see the attached "Summary" sheet for begin date, end date and closure method of the
consultation).
The USACE reviewed this project in accordance with (IAW) the NLEB Standard
Local Operating Procedures for Endangered Species (SLOPES) between the
USACE, Wilmington District, and the Asheville and Raleigh U.S. Fish and Wildlife
Service (Service) Offices, and determined that the action area for this project is
located outside of the highlighted areas/red 12-digit HUCs and activities in the
action area do not require prohibited incidental take; as such, this project meets
the criteria for the 4(d) rule and any associated take is exempted/excepted. IAW
the NLEB SLOPES, the USACE sent a Situation 1 email to the Service on
December 7, 2021, informing them about this project.
Service Concurrence: as established in the NLEB SLOPES, this project does not
require prohibited intentional take of the NLEB and it meets the criteria for the
4(d) rule; therefore any associated take is exempt and it is not necessary for the
USACE to wait 30 days for the Service to object or concur.
Based on a review of the information above, the Corps has determined that it has fulfilled its
responsibilities under Section 7(a)(2) of the ESA.
4.2 Magnuson -Stevens Fishery Conservation and Management Act, Essential Fish Habitat
(EFH) The NWPs/RGPs were coordinated with the NMFS during the permit renewal
process. NMFS coordination/EFH consultation is required if the activity affects SAV.
This activity does not affect SAV. Therefore, NMFS coordination/EFH consultation has
been completed.
4.2.1 Lead federal agency for EFH provisions of the Magnuson -Stevens Act
Has another federal agency taken steps to comply with EFH provisions of Magnuson -Stevens

Special condition 1:
a. The Permittee shall submit a photographic monitoring report to the Corps project manager
responsible for Mecklenburg County within 30 days of the completion of work authorized by
this verification and for three (3) consecutive years following the completion of the stream
restoration and enhancement activities. The collected data shall be submitted no later than
December 31 st annually for those three (3) years.
Special condition 2:
b. Please be advised that if additional impacts to waters of the U.S., either on this property or
on/adjacent to this property and associated with this project/activity, are proposed at a later
date, those impacts will be combined with the current impacts to waters of the U.S. and will be
reviewed cumulatively. Generally, compensatory mitigation will be required if individual or
cumulative (i.e., past and present) losses or degradation of waters of the U.S., are greater than
150 linear feet of perennial or intermittent stream channel and/or 0.1 acre of wetland.
Additionally, cumulative impacts that result in the loss or degradation of greater than 300 linear
feet of perennial or intermittent stream channel and/or 0.5 acre of wetland, will be processed
under an Individual Permit. This verification of the use of the Nationwide Permit Program for
