Dear Mr Thomas,
The Winston -Salem City- County Utilities Commission is planning sewer infrastructure
improvements to the west of the Winston -Salem between the towns of Clemmons and
Lewisville The project is proposed to relieve capacity issues at existing lift stations and provide
future capacity in the service area. The Clemmons #1 Lift Station (CLS) will be upgraded and a
force main constructed to the new Harper Road Lift Station (HRLS) A new force main will
connect the HRLS to the existing Muddy Creek interceptor The capacity issues are localized lift
station issues and will not change the currently permitted capacity of the Muddy Creek
Wastewater Treatment Plant Enclosed is an application for a Section 404 Nationwide Permit 12
and a Section 401 Water Quality Certification No 3884
The CLS force main will generally parallel an existing sewer line (primarily on the upslope side)
along Blanket Creek, and then parallel the stream for 1,145 feet to the new HRLS site The
HRLS force main will also parallel Blanket Creek for a short distance before running along
existing roadside rights -of -way and then along existing sewer outfall easements to the Muddy
Creek interceptor The alignments of the force mains were chosen to avoid numerous conflicts
with existing infrastructure along roadsides and reduce the length of force main required An
environmental assessment under the State Environmental Policy Act was prepared and a Finding
of No Significant Impact was issued on December 12, 2013.
The force main routes primarily run along existing sewer easements or roadside rights -of -way,
which minimizes impacts to streams and wetlands. Impacts to waters of the U S are 335 linear
feet of temporary stream impacts associated with 11 crossings (7 perennial and 4 intermittent)
Wetland impacts total 104 acres, including 0.825 acres of temporary impacts and 0 215 acres of
permanent impacts. Permanent impacts include forested wetland areas that would be cleared for
construction and remain cleared within the permanent 15 -foot maintenance corridor. In addition,
0 13 acres of permanent impact are required for the HRLS as described in the attached PCN
Alternative sites were in the floodway of Blanket Creek, contained streams or wetlands,

Note that, as requested during our field verification visit, the plans include contractor
requirements to control the release of water and sediment during the removal of the beaver dam
near Muddy Creek The impounded area will be drawn down prior to removing the dam and
erosion control BMPs will be implemented in order to prevent downstream sedimentation
The preceding information, along with the enclosed project information sheet, Pre - Construction
Notification, Vicinity map, USGS map, Impact Locations map, and wetland and stream impact
drawings are being submitted for your review of this project A copy of this application is also
being provided to the NC Division of Water Resources for their review under GC 3884

D Impact Justification and Mitigation
1 Avoidance and Minimization
1a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
A larger corridor was initially examined to determine locations of wetlands and streams, and other cons rtaints Based on that
information, the proposed corridor was chosen and balances avoidaince /minimization of stream and wetland impacts with
conflicts arising from existing infrastructure and residences For the most part, the proposed force mains are on the upstream
side of existing sewer lines and contained in the same easement Minimal new maintenance corridor will be required In areas
where the proposed force mains are not adjacent to existing sewer lines, offsets from Blanket Creek are a minimum of 20 feet
Additional offset was considered but not practical in order to minimize wetland impacts Permanent wetland impacts
associated with the proposed Harper Road Lift Station were unavoidable due to the need to avoid the floodway, minimize
impact to the local residences, and avoid wetlands and additional stream crossings associated with alternative locations at the
crossing of Harper Road and Blanket Creek Additional properties were examined as potential locations, but would involve
similar impacts and /or additional stream crossings and significant access road construction Relocation of the station further
downstream was also evaluated, but the access road to the site would have impacted most of the small wetland Shifting
upslope was not practical due to the presence of a driveway and house on the property

Sediment and erosion control measures will be implemented according to NC requirements, and approved by NCDENR prior
to implementation Jurisdictional areas not permitted to be impacted that are adjacent to construction areas will be clearly
marked with protection fencing or other similar method to avoid inadvertent encroachment Contractors will use heavy mats
to minimize disturbance to wetlands if needed during construction All wetlands will be returned to existing grade, with the
exception of the Harper Road Lift Station site Copies of the issued permits and impact areas will be provided to the prime
contractor and all subcontractors working in or near jurisdictional areas Beaver dam removal will be performed as described
m the attached plans, and will slowly draw down the impounded area to prevent sedimentation downstream

Purpose The purpose of this policy is to make clear the circumstances and process under which a
permittee can obtain a refund while simultaneously balancing customer service and responsible
business practices This policy applies to all refund requests made on or after the publication date of
this policy.
1 All refund requests must be made in writing to EEP's In -Lieu Fee Program Coordinator at

2 All refund requests are subject to fund availability. EEP does not guarantee fund availability for
any request
3 The request must either come from the entity that made the payment or from an authorized agent
Third parties requesting refunds must provide written authorization from the entity that made the
payment specifying the name and address of the authorized refund recipient
4 Refund requests related to unintended overpayments, typographical errors or incorrect invoices
should be brought the attention of the In -Lieu Fee Program Coordinator as soon as possible Such
requests are typically approved without delay
5 Payments made under EEP's incremental payment procedure are not eligible for refunds
6 Refund requests made within nine months of payment to EEP will only be considered for requests
associated with projects that have been terminated or modified where the permittee's mitigation
