Print Name:* Jason Lorch Signature:* 4G .[ C w WILD LANDS E r+GIr+EE RING February 8, 2022 U.S. Army Corps of Engineers Regulatory Division 69 Darlington Avenue Wilmington, NC 28403 Attention: Mr. Mickey Sugg Subject: Action ID No. SAW-2017-00998 Middle Cape Fear Umbrella Mitigation Bank—Daniels Creek Mitigation Site Third Credit Release (Monitoring Year 1 Completion) Dear Mr. Sugg: This correspondence is in reference to the Daniels Creek Mitigation Site, part of the Middle Cape Fear Umbrella Mitigation Bank.The 56.144-acre site is in the Cape Fear 04 Cataloging Unit (03030004) and is in located in Harnett County near the town of Broadway, North Carolina.The purpose of this letter is to request the third release of credits for Year 1 Monitoring Complete with interim performance standards met. Monitoring Year 1 (MY1) site assessments were conducted between April and December 2021. Overall, the Site met the performance standards for MY1 and is functioning as intended. Out of 45 vegetation plots 41 are meeting the MY3 interim success criterion of 320 planted stems per acre. Herbaceous vegetation is well established, and wetland plant species have been observed in wetland areas. Cross-sections and visual assessments showed that the stream channel is performing as designed and no indicators of channel instability were observed. Multiple bankfull events were recorded on T1 R4,T4 R1, and T7. Bankfull events were not recorded on T3 R2,T8 R1, or Daniels Creek R4. Additionally, all flow gauges exceeded the performance criteria during MY1 with flow ranging from 108 to 255 consecutive days. Five out of 18 groundwater gauges exceeded the success criteria with hydroperiods of at least 23.8%(63 consecutive days). Gauges began recording data at various dates throughout the growing season, missing important early dates for hydroperiod criterion attainment. No adaptive management needs were identified during MY1. Pursuant to the Umbrella Mitigation Banking Instrument and the site-specific Daniels Creek Final Mitigation Plan, successful completion of MY1 activities and demonstration that performance standards are being met for all parcels within the bank grants ten percent (10%) of the bank site's total stream credits,ten percent (10%) of the bank site's total riparian wetland credits, and ten percent (10%) of the bank site's non-riparian wetland credits be available for sale.Therefore, we are requesting 1,202.4 stream mitigation credits, and 1.392 riparian wetland mitigation credits, and 0.039 non-riparian wetland mitigation credits be released, constituting 10%of the total stream restoration credits (12,024.00 stream credits), 10%of the total riparian wetland restoration credits (13.923 riparian wetland credits), and 10%of the total non-riparian wetland restoration credits (0.392 non-riparian wetland credits). Stream Restoration Levels include restoration (R), enhancement level 1 (El), and enhancement level 2 (E2). Wetland Restoration Levels include restoration, rehabilitation, and enhancement. Daniels Creek Mitigation Site Monitoring Year 1 Annual Report 1-6 Section 2: Monitoring Year 1 Data Assessment Annual monitoring and site visits were conducted during MY1 to assess the condition of the project.The vegetation and stream success criteria for the Site follow the approved success criteria presented in the Mitigation Plan (Wildlands, 2019). Performance criteria for vegetation, stream, and hydrologic assessment are located in Section 1.2 Table 3: Goals, Performance Criteria, and Functional Improvements. Methodology for annual monitoring is presented in the MVO Annual Report (Wildlands, 2021). Vegetative Assessment The MY1 vegetative survey was completed in November 2021. Out of the 45 vegetation plots,41 met the MY3 interim requirement of 320 planted stems per acre. Fixed vegetation plots exhibited stem densities ranging from 121 to 647 planted stems per acre,with an average stem density of 421 planted stems per acre. Random Vegetation plots exhibited stem densities ranging from 283 to 1,457 stems per acre,with an average stem density of 526 stems per acre. Herbaceous vegetation is abundant across the Site and has flourished in both density and diversity, indicating a healthy riparian habitat.The riparian habitat is helping to reduce nutrient runoff from the cattle fields outside the easement and stabilizing the stream banks. Refer to Appendix A for Vegetation Plot Photographs and the Vegetation Condition Assessment Table and Appendix B for Vegetation Plot Data. 2.2 Vegetation Areas of Concern Approximately 0.82 acres along the edge of the easement on T5 R2 and T4 R2 are dominated by coastal bermudagrass (Cynodon dactylon). Coastal bermudagrass is allelopathic which means that it excretes chemicals that can negatively influence the growth and survival of other vegetation and organisms.This species also has stoloniferous growth habits which cause it to form dense mats of vegetation that can outcompete native seedlings and even prevent other seeds from making soil contact.The bermudagrass will be chemically treated in these areas during the spring of MY2 with ring sprays. After chemical treatment a permanent seed mix will be applied to ensure adequate groundcover.There is also a 0.15- acre bare area along T4 R1 that will be seeded with a permanent seed mix. Stem density, especially in areas occupied by coastal bermudagrass, will be re-assessed during MY2. 2.3 Stream Assessment Morphological surveys for MY1 were conducted in November 2021. All streams within the Site are stable and functioning as designed. All 25 cross-sections at the Site show little to no change from design in the bankfull area and width-to-depth ratio. Bank height ratios are less than 1.2. Visual assessments indicate that in-stream structures have remained stable. In-Stream vegetation has caused very minor sediment accumulation in a few of the cross sections. Once in-stream vegetation is treated sediment is expected to flush out of the system. Vegetation has become well established on the stream banks providing adequate coverage and protection. Pebble count data are no longer required per the September 29, 2021 IRT Technical Work Group Meeting.The IRT reserves the right to request pebble count data and particle distributions if deemed necessary during the monitoring period. Refer to Appendix A for the Visual Stream Morphology Stability Assessment Table and Stream Photographs and Appendix C for Stream Geomorphology Data. ,cream Areas of Concern Mechanical repairs were made on a 98-linear foot stretch of T1 R4 during October 2021 to address three unstable log sills and bank erosion that resulted from water piping around and under the logs.The angled log sills and adjoining riffles up-stream were re-built to the specifications and slopes shown in the Daniels Creek Mitigation Site Monitoring Year 1 Annual Report 2-1 original construction plans. In October 2021, stream banks were repaired and matted, and brush toe was added on the outside bend directly downstream of the first unstable log sill to increase bank protection and prevent any future bank erosion.These structures are now stable and functioning as originally intended. Visual assessments have indicated that all other stream reaches and structures were found to be stable and performing as intended during MY1. Murdannia has grown in several stream channels on the Site (Figure 1.1-1.5). A majority of the streams affected by the in-stream vegetation are the smaller tributaries with shallower channels and lower flow. Despite the presence of vegetation within the channel, no major sedimentation has been observed.The in-stream vegetation will be treated in Spring of MY2. In addition to chemical treatment, additional live stakes will be added to stream banks to help shade out in-stream vegetation. Live stakes will also increase bank stabilization and act as a source of woody debris in the streams. L. Hydrology Assessment Bankfull events were recorded on T1 R4,T4 R1, and T7. Multiple bankfull events were recorded on T1 R4 and T7. Bankfull events were not recorded on T3 R2,T8 R1, or Daniels Creek R4. The gauge on T3 R2 malfunctioned during the early portion of MY1.The gauge was repaired in February 2022 and is expected to capture bankfull events during MY2. Crest gauges were not installed until late March when construction was completed.This likely affected the number of bankfull events collected on the project streams. Streams are anticipated to meet bankfull criteria during MY2 with a full year of data available. In addition, the presence of baseflow must be documented on intermittent reaches (T1 R1,T2 R1,T5 R2, and T8 R1)for a minimum of 30 consecutive days during a normal precipitation year. All flow gauges were well above the performance criteria during MY1 with flow ranging from 108 to 255 consecutive days. Flow was also observed in these channels during visual assessments that were conducted throughout the year. Refer to Appendix D for hydrologic data. 2.6 Wetland Assessment Eighteen groundwater gauges were installed throughout the Site to monitor the hydrology in wetland re-establishment and rehabilitation areas. As stated in the Mitigation Plan,the growing season dates at this Site are March 1 to November 20, unless soil temperature or bud burst data indicate otherwise. Bud burst observations were not recorded for MY1 as groundwater gauges were not installed until well into the growing season. Soil temperature data was collected from September to December and is included in Appendix D.These dates are supported by soil temperature and bud burst observations at other sites in the region. In order to meet the success criterion, gauges must show groundwater within 12 inches of the soil surface for 13%of the growing season (35 consecutive days). Gauges began recording data at various dates throughout the growing season as they were installed, convoluting a definitive and conclusive assessment of criterion attainment for MY1 (Table 12).The balance of precipitation and evapotranspiration rates during the early spring typically favors the highest soil moisture conditions that occur within the growing season. Monitoring equipment installation could not take place until late March as construction completed. Since wetland hydrology was not observed during the early spring, we believe it would be an incorrect conclusion to assume that gauges that recorded a hydroperiod less than 13%during the observation period failed for the MY1 growing season. Gauges 13 and 15-18 did not begin recording data until late summer or fall of 2021 due to errors in data logger programming.This has been corrected for MY2. Complete datasets are expected during future monitoring years which will allow for more definitive assessment of wetland hydrology. Groundwater gauge 19 was installed in a jurisdictional wetland for informational purposes and will not be held to hydrology performance standards.This gauge recorded groundwater within the upper 12 Daniels Creek Mitigation Site Monitoring Year 1 Annual Report 2-2 inches of the soil surface for 239 consecutive days (90.2%) of the growing season.The groundwater gauge data exhibit that this wetland enhancement area is maintaining wetland hydrology throughout a large portion of the growing season. No pre-construction monitoring was conducted in this wetland. 2.7 i. nitoring Year 1 Summary Out of the 45 vegetation plots, 41 are exceeding the MY3 interim requirement of 320 planted stems per acre. Overall species diversity and density of woody and herbaceous vegetation is showing positive trends across the Site. Visual assessments and cross-sections show streams within the Site are stable and meeting project goals. Areas with coastal bermudagrass will be chemically treated with ring sprays during the spring of MY2 and seeded after treatment. Murdannia was documented across several stream channels and will be chemically treated during MY2. Bankfull events were documented on T1 R4, T4 R1, and T7 and greater than 30 days of consecutive flow was recorded on all flow gauges. Five out of eighteen groundwater gauges exceeded the success criteria with hydroperiods of at least 23.8%(63 consecutive days).The dataset for MY1 was not complete enough to accurately depict wetland hydrology, as important periods of the growing season were not captured. Results are expected to improve during MY2 when an entire year worth of data will be collected. Overall, the Site is meeting its goals and is on track to meet final success criteria.
