Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts associated with the proposed development were limited through site selection, location, design, and location/orientation of the proposed lots and access routes. This permit is being resubmitted due to unfavorable geotechnical results at the location of the previously proposed bottomless crossing. Sanitary sewer tie-ins impacts are designed to be temporary, and all permanent impacts are the result of road crossings. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Construction techniques will implement approved erosion control methods to avoid/minimize to onsite/adjacent offsite receiving conveyances. At each road crossing, the maximum allowable headwalls and 3:1 slopes are proposed to tie out to existing grade and minimize impacts. The proposed culvert length and riprap apron for access at Stream H has been reduced. Additional applications of riprap will be placed above the OHWM so that no net loss of aquatic resources occur. 2. Compensatory Mitigation for Impacts to Waters of the U.S. or Waters of the State 2a. Johnson, Wojoski and Hamstead, Enclosed is a Request for Nationwide Permit 914 and 929 for the Summerlyn Village site, formerly submitted under the name Rainbow Drive, on 133 acres north of Mooresville Road, near the intersection with Rainbow Drive in Kannapolis, NC. The site is a proposed residential development and consists of eight streams and ten wetlands. A Preliminary Determination request was previously submitted and approved by the USACE on January 16, 2020. Additionally, an initial application was submitted (January 21, 2021) for proposed impacts and then updated due to modifications of one of two access crossings to a bottomless culvert. Currently, we are submitting an application for additional impacts as the proposed location for the bottomless crossing will be replaced by a traditional crossing as this location has returned unfavorable geotechnical results for situation of a bottomless arch. Please refer to the Jurisdictional Determination section and Approvals section for information on previous verifications and permits. Wetlands and Environmental Planning Group Leonard S. Rindner, PLLC. As shown on the attached exhibits, the proposed project will include permanent impacts to one wetland and two streams due to road crossings. Total permanent impacts proposed include 0.018 acres of wetland impact (Wetland E), 96 linear feet to Stream A, and 110 linear feet to Stream H. Sixty linear feet of the collective stream impacts are no -loss impacts from rip rap installed at existing bed elevations. All temporary wetland and stream impacts on site are the result of sanitary sewer installation. Total additional loss to Waters of the US (stream impact), resulting from plan reversion from a bottomless culvert back to a traditional crossing, will total 49 linear feet. No additional loss to wetlands will occur as part of this updated application. Loss of waters associated with this current application will total 146 linear feet of stream and 0.018 acres of wetlands. Overall impacts to site surface waters associated with the proposed development were limited through site selection location, design, location/orientation of proposed lots and access routes. It was not possible to minimize impacts further due to site layout and connectivity requirements per the City of Kannapolis as well as constraints from existing sewer line infrastructure and onsite stream buffers. Headwalls are proposed at each crossing, anti -seep collars at each temporary wetland crossing, and 3:1 slopes will be implemented to limit impacts to site surface waters. The riprap apron and construction access needed for each stream crossing have been maintained as previously proposed and any installations of riprap will be placed at preconstruction streambed elevations to provide stability. Additionally, impacts were minimized to the extent possible by pinching in sidewalks, implementing steeper slopes, and retaining walls at stream crossings. The applicant has demonstrated substantial avoidance and minimization efforts in which 99.9% of the 18.5 acres of onsite wetlands and 96% of the 5,207 linear feet of onsite streams will not require permanent impacts. Due to the limited wetland and stream impacts, no mitigation will be proposed as part of this project. Also enclosed is a copy of our Threatened/Endangered Species Evaluation and subsequent USFWS concurrence for the site. No listed species were identified within the project area. It can be found on the Kannapolis, NC USGS Topographic Quadrangle Maps; latitude is 35.4909 N, longitude is-80.6562 W. The topography is flat to moderately sloped. The elevation ranges from 660 to 760 ft. (Figure 1). The site is disturbed and successional old farmland and wood lots covered with old roads and a mixed pine and hardwood forest that is disturbed throughout. Maps and aerial photographs were assembled, and the site was investigated during the weeks of August 12 and 19, 2019. Rainbow Drive Kannapolis Threatened / Endangered / Protected Species Evaluation SPECIES DESCRIPTIONS: One plant species with federal protection was listed as potentially occurring in Cabarrus County: • Schweinitz's Sunflower (Helianthus schweinitzii), listed as Federally Endangered, is typically found in open habitats which historically have been maintained by wildfires and grazing bison and elk herds. Now most occurrences are limited to roadsides, woodland and field edges, and utility rights -of -way (ROW). A total of three animal species with federal protection are listed as potentially occurring in Cabarrus County: Bald Eagle (Haliaeetus leucocephalus), protected by the Bald and Golden Eagle Protection Act, typically inhabits forested areas near large bodies of open water such as lakes, marshes, seacoasts and rivers, where there are suitable fish populations and tall trees for nesting and roosting. • Carolina Heelsplitter (Lasmigona decorata), listed as Federally Endangered, is restricted to cool, clean, well -oxygenated water. Stable, silt- free stream beds are required for this species. Typically, stable areas occur where the stream banks are well -vegetated with trees and shrubs. Northern Long-eared Bat (Myotis septentrionalis), listed as Federally Threatened. During summer, northern long-eared bats roost singly or in colonies underneath bark, in cavities, or in crevices of both live and dead trees. Males and non -reproductive females may also roost in cooler places, like caves and mines. It has also been found, rarely, roosting in structures like barns and sheds. Northern long-eared bats spend winter hibernating in caves and mines, called hibernacula. RESULTS: The site is successional old farmland and wood lots covered with old roads and a mixed pine and hardwood forest that is disturbed throughout. A small power line parallels the roadside corridor along Rainbow Drive, and the roadside corridor along Mooresville Highway is undergoing major construction including a new bridge crossing at Irish Buffalo Creek. The wooded slopes have streams and drainages that flow generally southeastward into Irish Buffalo Creek. There is considerable beaver activity in the floodplains of the main unnamed tributary, and Irish Buffalo Creek, and several areas are inundated. Portions of the site in the more recently disturbed upland and timbered areas are covered with a mixed pine and hardwood forest. Rainbow Drive Kannapolis Threatened / Endangered / Protected Species Evaluation include Shortleaf Pine (Pinus echinata), Virginia Pine (P. virginiana), Loblolly Pine (P. taeda), Red Cedar (Juniperus virginiana), Winged Elm, (Ulmus alata), Red Maple (Acerrubrum), Honey Locust (Gleditsia triacanthhos), Sweetgum (Liquidambar styracif/ua), Black Cherry (Prunus serotina), Persimmon (Diospyros virginiana), Black Gum (Nyssa sylvatica), Blackberry (Rubus sp.), Russian Olive (Elaeagnus umbellate), Smooth Sumac (Rhus glabra), Groundsel (Baccharis halimifolia), Japanese Honeysuckle (Lonicera japonica), Catbrier (Smilax sp.), and Poison Ivy (Toxicodendron radicans). The steeper slopes with older growth woods approximate a Basic Oak -Hickory Forest community type, grading into Piedmont/Low Mountain Alluvial Forest in the bottomlands along the streams. The canopy is composed of White Oak (Quercus alba), Post Oak (Q. stellata), Red Oak (Q. rubra), Southern Red Oak (Q. falcata), Willow Oak (Q. phellos), Pignut Hickory (Carya glabra), Shagbark Hickory (C. ovata), Sweetgum (Liquidambar styraciflua), Tulip Poplar (Liriodendron tulipifera), Hackberry (Celtis laevigata), American Elm (Ulmus americans), and White Ash (Fraxinus americana). The floodplains also feature Sycamore (Platanus occidentalis), Green Ash (Fraxinus pensylvanica), and Cottonwood (Populus deltoides). The subcanopy is composed of Flowering Dogwood (Corpus f/orida), American Holly (Ilex opaca), Mulberry (Morus rubra), Winged Elm (Ulmus alata), Black Cherry (Prunus serotina), Eastern Red Cedar, and Black Gum (Nyssa sylvatica). Floodplain small trees include Box Elder Maple (Acernegundo) and Ironwood (Carpinus caroliniana). The shrub layer includes Black Haw (Viburnum prunifolium), and Pinxter Azalea (Rhododendron nudif/orum), Heart's-a-burtstin (Euonymus americanus), Blueberry (Vaccinium spp.), Chinese Privet (Ligustrum sinense), and Russian Olive (Elaeagnus angustifolia). Vines present are Japanese Honeysuckle, Virginia Creeper (Parthenocissus quinquefolia), Muscadine (Vitis rotundifolia), Mikania scandens (Climbing Hempvine), Catbrier, and Poison Ivy. The herb layer includes Heartleaf Ginger (Hexastylis arifolia), Christmas Fern (Polystichum acrostichoides), Ebony Spleenwort (Asplenium platyneuron), Spotted Wintergreen (Chimaphila maculata), American alumroot (Heuchera americans), Running Pine (Lycopodium flabelliforme), Downy Rattlesnake Plantain (Goodyera pubescens), and Japanese Stilt Grass (Microstegium vimineum). The assemblage of plants growing in the transitional and more open disturbed areas and roadsides includes Sericea Lespedeza (Lespedeza cuneata), Goldenrod (Solidago sp.), Blackberry, Broomsedge (Andropogon virginicus), Splitbeard (A. ternarius), Groundsel (Senicio sp.), Johnson Grass, Rabbit Tobacco (Gnapthalium obtusifolium), Beggars Ticks (Desmodium sp.), Thoroughwort (Eupatorium sp.), and St. John's Wort (Hypericum punctatum). WEPG Wetlands and Environmental Planning Group Rainbow Drive Kannapolis Threatened / Endangered / Protected Species Evaluation Threatened & Endangered/Protected Species Results • All potential habitats for Schweinitz's Sunflower along the roadsides, and woods edges were examined, and the species was not found. No suitable nesting habitat exists on the site for Bald Eagles, and there were no sightings nor were any nesting sites observed. • The on -site streams do not have the habitat characteristics required to support populations of the Carolina Heelsplitter. Based on existing documentation, Carolina Heelsplitter populations have not been previously identified within this basin. No individuals were observed during the survey nor would any be expected on -site. • Comparing this site location to the USFWS Asheville office's website (http://www.fws.gov/asheville/htmis/project review/NLEB in WNC.html) it appears that the site meets the "exempt" criteria which requires no further action under section 7 of the Endangered Species Act for the Northern Long-eared Bat. RECOMMENDATIONS: Based on the site investigation and the review of available data, WEPG did not identify any protected species occurring on the subject property. This discovery led (in part) to the purchase of the site by the State of North Carolina Plant Conservation Program, now called Redlair Preserve. This population has become a Recovery Site for the species. • Participated in numerous Piedmont Prairie restoration projects in Mecklenburg, Union, Cabarrus and Gaston Counties, North Carolina. We submit the following comments in accordance with the provisions of the Fish and Wildlife Coordination Act, as amended (16 U.S.C. 661-667e); the National Environmental Policy Act (42 U.S.C. §4321 et seq.); and section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531-1543) (Act). Project Description According to the information provided, the proposed project would entail the construction of a residential development on approximately 133 acres in Kannapolis, North Carolina. Onsite habitats include successional farmland, mixed pine/hardwood forest, maintained utility rights of way, and roadways. The U.S. Army Corps of Engineers has permitted project -mediated impacts to waters of the U.S. (SAW-2019-01393). We understand that the proposed project will also require authorization from the Federal Emergency Management Agency. Federally Listed Endangered and Threatened Species According to Service records, suitable summer roosting habitat may be present in the action area (50CFR 402.02) for the federally threatened northern long-eared bat (*otis septentrionalis). However, the final 4(d) rule, (effective as of February 16, 2016) exempts incidental take of northern long-eared bat associated with activities that occur greater than 0.25 miles from a known hibernation site, and greater than 150 feet from a known, occupied maternity roost during the pup season (June 1 — July 31). Based on the information provided, the project would occur at a location where any incidental take that may result from associated activities is exempt under the 4(d) rule for this species. Based on the information provided, suitable habitat may also occur onsite for the federally endangered Schweinitz's sunflower (Helianthus schweinitzii). However, targeted botanical surveys conducted during the appropriate survey window did not detect evidence for this species at that time. We believe that suitable habitat is not present onsite for any other federally protected species. Therefore, we have no concerns for project -mediated impacts to the species above or any other federally protected species, and we require no further action at this time. Please be aware that obligations under section 7 of the Endangered Species Act must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered, (2) this action is subsequently modified in a manner that was not considered in this review, or (3) a new species is listed or critical habitat is determined that may be affected by the identified action. There are 11 recorded archeological sites located within 1.6 kilometers (1.0 mile) of the study tract, the closest of which is 31 CA127. This prehistoric site is located north of Mooresville Road about 35 m south of the project area. This site has an unknown NRHP eligibility status. Historic Resources: The HPOWeb database indicates no NRHP-listed historic properties, State Study List sites, or properties that have been determined eligible for the NRHP located within 1.2 km of the project area. There are 13 surveyed -only historic resources located within 180 m of the study tract, all of which are noted in the HPOWeb record as "ineligible" for the NRHP. Five of these ineligible historic resources are situated within 50 m of the project area and one (CA 1520) may have been located at the southern end of the western project access corridor to Mooresville Road. A quick review of GoogleEarth 2019 aerial photography indicates that Resource CA 1520 and the neighboring structure to the east (CA 1517) (not in the project area) have been razed/destroyed. Stormwater discharge structures at this site shall be constructed in a manner such that the potential receiving streams (of the discharge) will not be impacted due to sediment accumulations, scouring or erosion of the stream banks.
