PROJECT DESCRIPTION: The project site is located at 101 Sunward Place, adjacent to Banks Channel, in Topsail Beach, Pender County. To get to the site from Wilmington take US Hwy 17 N to NC Hwy 210. Turn right onto NC Hwy 210 and continue to NC Hwy 50. Take a right onto NC Hwy 50. Travel across the swing bridge to the stoplight. Take a right onto NC Hwy 50. Travel approximately three miles. Sunward Place is located on right side of NC Hwy 50. Take a right onto Sunward Place. There are two 4x4 post with a white chain across the driveway. The property is adjacent to Topsail Sound on the west. The property is adjacent to residential properties on the north and south sides. The current elevation of the property ranges from sea level to approximately 10' above mean sea level (MSL). The property is approximately 23,800 ft.2 in size. The highground vegetation on the property consists mainly of Wax Myrtle (Myrica cerifera) and Live Oak (Quercus virginiana). There are no coastal wetlands on site. There are areas of Submerged Aquatic Vegetation (SAV) in the vicinity. The property is bulkheaded and there is an existing pier measuring approximately 6' in width and 81' in length with a L-head measuring 15' wide and 16' long. A 13' x 13' boatlift is located on the northern side of the L- head and a floating dock measuring 8' in width and 16' in length that is located parallel to the L-head. The Town of Topsail Beach Land Use Plan classifies the upland areas of this project as Developed. The waters of the project site are classified as SA by the NC Division of Water Quality. The NC Division of Marine Fisheries has NOT designated this area of Topsail Sound as a Primary Nursery Area, and the waters adjacent to the proposed project are open to the harvesting of shellfish. PROPOSED PROJECT: The applicant is proposing to rotate the floating dock 90° to create 2 slips. The applicant is also proposing to install a two pole boat lift on the southern side of the pier approximately 65' waterward of bulkhead and (2) jet- ski lifts on the northern side of the pier. The applicant is also proposing to perform maintenance excavation of two areas around the dock. The applicant is proposing to use bucket to barge as the excavation method. The first area is located to the south of the pier and is labeled on the plans as area "A". This area measures approximately 25' in width by an average of 60' in length and would be excavated to a final depth of --4' @ normal low water (NLW). The second area is labeled as area "B" and located to the north of the pier. It measure 36' in width by an average of 70' in length and would be excavated to a final depth of -4' @ NLW. The spoil material would be transported off-site to the middle peninsula at Queens Grant, located in Topsail Beach approximately 2 miles south on NC Hwy 50. The disposal area measures 75' in width and 150' in length located in the Estuarine Shoreline Area of Environmental Concern (AEC). The disposal site would be located at least 30' from NHW. 10. ANTICIPATED IMPACTS The proposed project would fill approximately 11,250 ft.z of highground located entirely in the Estuarine Shoreline AEC. The proposed excavation would impact approximately 4,470 ft.2 of shallow bottom. The platforms and boatlifts would incorporate approximately 657 ft.Z of Estuarine Waters and Public Trust Area AEC's. At the time of the purchase, the property had one pier/dock of 99 ft, 5 inches which was in disrepair. Under general permit #47427 dated 3/2107, we were permitted to repair the pier and add a boat lift on the north side and a 8ft x 16ft floating dock on the south. side while still retaining our CAMA square foot restrictions. Under general permit #47548 dated 3/30/07, we were permitted to dredge the area for the boat lift (this was originally allowed under general permit #33422 in 2003, but was never done). What we are proposing under the major CAMA permit is: 1) Reposition the floating dock so that it is perpendicular to the pier/dock (#5 and #6 on drawing 5}. 2) Add one skiff lift (#4 on drawing 5) mounted on 2 existing pier pilings on the south side of the pier. 3) Add two personal watercraft lifts (#2 and #3 on drawing 5) mounted on existing pier pilings on the north side of the pier. 4) Dredge approximately 418 cubic yards down to the 4 foot mean low tide level. Reasons for these requests: 1) Repositioning the floating dock will give more accessibility and area for recreational activities (swimming, fishing, etc). 2) To store fishing skiff out of the water. This lift is manufactured by Tide Tamer and would be mounted out of the water on existing pier pilings. It would only come in contact with the water when launching or retrieving the vessel. 3) To store personal watercraft out of the water. These lifts are also manufactured by Tide Tamer and each would be mounted out of the water on an existing pier piling. They also would only come in contact with the water when launching or retrieving the vessels. Additionally, these lifts are able to swing over the pier to allow for safe and easy maintenance of the vessels. 4) With this property being located close to the bend of Banks Channel, it is not a natural occurrence for the buildup of sand to be located here. In the past, there was a marina called Seafood World located adjacent to this property to the south. It was a known practice for the boats there to run their motors simultaneously during the night blowing sand out of the boat basin to keep it clean. On a rising tide, this sand would have been blown to the north onto the adjacent lot, which is now at 101 Sunward Place. We would like to restore this lot to its more natural low tide water depths. We are proposing to dredge the following areas: a. Area A: located to the south of the pier/dock, approximately l 49 cubic yards (see drawing 5) b.
