It is the understanding' of, the Division that although Converse, Inc. is no longer in business, the
company wishes to maintain the subject NPDES General Permits at the permitted site as long as
the company owns the property. In accordance with your request, NPDES General Permits
NCG500173 and NCG050273 are reinstated, effective immediately.

please reinstates these permits. While the company is no longer doing business at this location, we feel
maintaining these permits are feasible in the event of any unforeseen situation. In fact, is there a problem
if these permits are maintained as long as Converse owns the property at this location?

Dear Mr. McMaster:
It is the understanding of; the Division that Converse, Inc. is no longer in business as of March 2001. In
accordance with this information, NPDES General Permits NCG500173 and NCG050273 are rescinded,
effectively immediately.
Please be advised that these permit rescissions are based wholly upon the company being out of business
and that the activities which would require general permit coverage at the site have ceased or been
eliminated. Division staff lias not visited the site to obtain independent verification. Operating a
treatment facility, discharging wastewater or discharging stormwater to waters of the State without a valid
NPDES Permit will subject the responsible party to a civil penalty of up to $25,000 per day.. Enforcement
action will be certain fort persons that have voluntarily relinquished permit coverage when, in fact,
continuing permit coverage was necessary. If, in retrospect, you feel the site still requires permit
coverage, you should notify this office immediately. Furthermore, if in the future you wish to again
discharge to the State's surface waters, you must first apply for and receive a new NPDES Permit.

SUBJECT: Complaint Investigation
Converse Rubber Company
Robeson County
On July 7, 1991, the. Health Department informed our office of a
complaint that 'was, received from Mr. Gerald Odom regarding some type of
contamination and/or pollution of the swamp adjacent to Converse Rubber
Company. Mr. Odom has indicated that Converse Rubber Company was responsible
for odors and debris in the swamp as a result of negligence and poor operation
of their wastewater, treatment plant.
After conducting an "on -site" investigation of the wastewater treatment
plant, the three (3) discharge outfalls covered by the NPDES permit and the
receiving waters, the following has been concluded:
1. Converse Rubber Company's wastewater treatment plant and the three
discharge (3) outfalls to the swamp are operating properly and are
producing no apparent adverse impact to the swamp.
2. The observed debris and malodorous conditions were due to the decay
of duckweed which is indigenous to that area.

found near Converse's discharge points. After investigating both
Converse's wastewater treatment facility as well as the receiving waters
of the swamp. The following facts were determined:
a. That Converse Rubber Company's wastewater treatment plant was
producing an effluent well within the requirements of their NPDES
Permits Limits (pipe .001),
b. That Converse Rubber Company's discharge pipes .002 and .003 were
also within their permits limits.
c. That the heretofore unidentified material with noxious odors found
in the swamp (receiving waters) was in fact a partial "die -off" of
duckweed, some of which were in an advanced state of decay (thus
producing an odor similar to that of raw sewage).
Mr. Odom (the complainant), after inspecting the swamp, the treatment
plant, and the outfalls, along with Converser Rubber Company's personnel
and D.T. Jones and Ricky Revels of the Department of Environment, Health
and Natural Resources - Fayetteville Regional Office, stated that he was
satisfied and agreed that the conditions found in the swamp were in no
way a result of wrong doing or negligence on the part of Converse Rubber
Company.
4. All other provisions of the NPDES Permit Limits were fully compliant.
5. The following were in attendance for the inspections of the three
outfalls, the receiving swamp, and the wastewater treatment facility:

D. POTW Connection Condition
The peiiiiittee shall properly connect to an operational publicly owned wastewater collection
system within 180 days of its availability to the site, if the facility is in noncompliance with any
terms and conditions of the NPDES permit or governing rules, regulations and laws.
E. The permittee shall not use any biocides except those approved in conjunction with the permit
application. The! permittee shall notify. the Director in writing not later than ninety (90) days prior
to instituting use;of any additional biocide used in cooling systems which may be toxic to aquatic
life other than those previously reported to the Division of Environmental Management. Such
notification shall include completion of Biocide Worksheet Form 101 and a map locating the
discharge point and receiving stream:

The effluent discharge shall at no time exhibit chronic toxicity in any two consecutive toxicity tests,
using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic
Bioassay Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be go -observable inhibition of Teproduction7or
nign1ficant mo tality isg9'.,9 (defined as treatment two in the North Carolina procedure documents.
The permit holder shall perform quarterly monitoring using this procedure to establish compliance
with the. permit condition.' The first test will be performed after thirty days from issuance of this
permit during the months of March, June, September, and December. Effluent sampling for this
testing shall be performed at the NPDES permitted final effluent discharge below all treatment:
processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent
Discharge Monitoring Form (MR-1) for the month in which it was performed, using the4parameter
caie'TGP31) Additionally, DEM Form AT-1(original) is to be sent to the following address:

Test data shall be complete and accurate and include all supporting chemical/physical measurements
performed in association 'with the toxicity tests, as well as all dose/response data. Total residual
chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for
disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly
monitoring will begin immediately until such time that a single test is passed. Upon passing, this
monthly test requirement will revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina
Division of Environmental Management indicate potential impacts to the receiving stream, this
permit may be reopened and modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specifiedin the cited document, such asminimum
control organism survival and appropriate environmental controls, shall constitute an invalid test.

Dick Morgan.of,your staff to discuss operational problems with
your wastewater' treatment plant. The following observations were
made during the site visit:
1. The treatment plant is of the extended aeration variety,
with al permitted flow of .0750 MGD. The facility is
currently averaging .0285 MGD based on the data for the
last twelve months.

2. The facility hasexperienced slight problems with
BOD5 'and NH as N removal through the plant. The plant
receives botY3i process and domestic waste.
3. A review of the flow data shows that the plant is
receiving the flow in surges. You should adjust the
pumping:rates in your lift station to shave the peak
flows'and allow a more equalized flow to enter your plant.
4. Process;control tests are not being performed at the
facility. Dissolved oxygen and mixed liquor settleable
solids should be done on the aeration basins on a daily
basis. 'You should graph these results and develop trend
chart which would allow you to observe. changes in the
treatment system.

5. Diffusers in the aeration basins should be cleaned or
replaced as needed so as to provide the optimum level
of oxygen to the biomass. A dissolved oxygen meter
should be available to monitor the oxygen levels in the
basins. You should also have a settleometer on hand to
monitor the mixed liquor levels.
6. The lines which were provided for the bypassing of a
treatment unit directly to the effluent should be
removed as discussed.
7. Sludge return and sludge wasting rates should be
monitored. You should be sure that you are pumping
solids to your sludge holding basin and not water.
Return solids to the aeration basin should be as
concentrated as possible.
8. The clarifier walls should be scraped daily, as well as
the wiers washed down.
9. The chlorine residual is in excess of what should be
needed to maintain a fecal kill. This is not only
costly, but it could be toxic to the receiving stream.
You should get a chlorinator that can provide a feed
rate that is consistent with your flow.
10. During the summer months, you may want to provide a
supplemental air supply to the effluent for dissolved
oxygen enhancement.
11. The effluent appeared very clear and free of any
suspended matter. It is surprising that the system
has provided such a effective treatment due to the fact
that sd few operational and maintenance items are -
addressed on a routine basis. It is felt that the
low flows to the system have helped the situation,
and that when the plant begins to reach design capacity
that it will be very difficult to maintain compliance
with your permit if current operational practices are
continued.
12. Your concern over the operation of the facility is to be
commended. You have demonstrated a willingness to
provide the needed changes to the plant, but, you
must also provide an operator the time needed at the
plant to do the daily operational tasks.

parts of the old system can be deleted until your flows
increase.
