8. Project Summary: The applicant wishes to construct a new 30-10t subdivision with
infrastructure, a 4-slip docking facility, and a 5-slip docking facility for community use and is
applying for a permit to do so.
9. Narrative Description:
The property is located in Indian Beach at 1824 Salter Path Road, Carteret County. The parcel is a
20.5-acre tract adjacent to Bogue Sound. This site is currently undeveloped. The adjacent
properties are residential complexes. The property to the east is a condominium complex, and the
property to the west is a religious community group home facility.
The average elevation of the high ground of the parcel is + 8' above normal high water level.
Vegetation on the tract mainly consists of maritime forest, which includes Section 404 Wetlands
and coastal marsh. There is approximately 1,740' of shoreline along Bogue Sound on this tract.
The bulk of Section 404 Wetlands extend through the middle of the tract. The coastal wetlands are
present on the north side of the tract, adjacent to Bogue Sound. Immediate offshore water depths
adjacent to the tract along Bogue Sound range from about -0.5' to -3' nlw. The subaqueous
substrate is firm with shell.
This waterbody is about 2.5 miles across at this location. These waters are not classified as a
Primary Nursery Area and there is submerged aquatic vegetation present. This area is open to
shellfish harvest and is classified as Outstanding Resource Waters. There is a Federal Channel
extending through Bogue Sound, approximately 2 miles north of the project area.
10. Proposed Development:
The applicant wishes to construct a new 30-lot subdivision with infrastructure, a 4-slip docking
facility, and a 5-slip docking facility adjacent to Bogue Sound.
The upland development will consist of the construction of an 18' wide asphalt roadway within 45'
of the right-of-way to serve the subdivision. In addition, there will be three 6' wide concrete
sidewalks. The average lot size will be about 0.5 acre. This will disturb 93,166 square feet of
uplands (77,891st) and Section 404 Wetlands (15,275st). The roadway will be in a "loop"
configuration and will impact two areas of Section 404 Wetlands, on the east and west sides of the
tract. One of the sidewalks will begin at the entrance of the subdivision beside the roadway and
will be segmented by two sections of wooden boardwalk over the Section 404 Wetlands. The other
two sidewalks will connect two docking facility access piers to the roadway. Adjacent to each of
the three sidewalks, will be three gazebos. A fourth gazebo is proposed in a conservation area in
the northeast corner of the tract. Each gazebo will be 20' wide and 20' long, and sited on high
ground.
The docks will be located on conservation lots, one will be between lots 9 & 10 and the other will
be between lots 15 & 16. The western docking facility will have four slips. The pier will be 6'
wide and 250' long. There will be two finger piers and seven tie pilings. Each pier. will be 3.5'
wide and 15' long. At the terminus of the pier, there will be a 15' by 15' covered platform. The
eastern docking facility will support five more slips. The pier will be 6' wide and 290' long.

There will be three finger piers and eight tie pilings. Each pier will be 3.5' wide and 15' long. At
the terminus of the pier, there will be a 15' by 15' covered platform. These nine boat slips will be
in approximately -3.0' nlw.
10. Anticipated Impacts:
This proposal will disturb about 77,891 square feet of high ground for the creation of the roadway,
gazebos, and pedestrian walkways. The roadway will fill 15,275 square feet of Section 404
Wetlands. The docking facility will usurp 5,948 square feet of public trust waters, shade 270
square feet of coastal marsh, and shade 3,113 square feet of shallow bottom SA V habitat along
1,740' of shoreline. This will not be a hazard to navigation as there is not a Federal Channel in the
immediate vicinity. The western docking facility will have 330 square feet of platform area along
98' of shoreline and the eastern docking facility will have 383 square feet of platform area along
190' of shoreline. This proposal will result in a total of23 % of impervious surface within the 575'
Estuarine Shoreline AEC. Almost the entire tract is within the 575' Estuarine Shoreline AEC.
This calculation does not include the future home construction. The waters of Bogue Sound are
classified as Outstanding Resource Waters and are not designated as a Primary Nursery Area.
Water depths in the immediate area range from -0.5' to -3' nlw. These waters are open to the
harvest of shellfish and there are beds of submerged aquatic vegetation present.

SUBJECT: Comments and Recommendations - CAMA Major Permit - Taylor Tract, Carteret
County
The following is my assessment and consequent recommendations of the above referenced
proposal: This proposal involves the filling of 15,275 square feet of Section 404 Wetlands. This
proposal may also impact shallow bottom SA V habitat due to future prop scarring. The waters
of Bogue Sound are open to shellfish harvest. This waterbody is not a Primary Nursery Area.
This proposal will not pose a hazard to navigation. This proposal is in accordance with 15A
NCAC 07H .0208(b)(6) and 15A NCAC 07H .0209. Assuming that state and federal agencies
concur with the proposal, I recommend the project be authorized as proposed, contingent upon
the following conditions:
1) The docking facilities will display a sign showing the location of the nearest pump out
facility, including other appropriate waste disposal information, at the entrance and exit
from the main piers.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats
using the docking facility. Any sewage discharge at the docking facility shall be
considered a violation of this permit for which the permittee is responsible. This
prohibition shall be applied and enforced throughout the entire existence of the permitted
structure.
3) This permit authorizes only the docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No
other structure, whether floating or stationary, may become a permanent part of this
docking facility without permit modification. No non-water dependent uses of structures
may be conducted on, in or over public trust waters without permit modification.
4) The pier and associated structures shall have a minimum setback distance of 15 feet
between any parts of the structure and the adjacent riparian access corridors of Lots 9 &
10 and Lots 15 & 16, which is deteimined by drawing a line parallel to the channel, then

drawing a line perpendicular to the channel line that intersects with the shore at the point
where the upland property line meets the water's edge.
5) Any portion of the permitted access pier and docking facilities built over coastal wetlands
must not exceed six feet in width and must be elevated a minimum of three feet over the
wetland substrate as measured from the bottom of the decking.
6) No attempt will be made by the permittee to prevent the full and free use by the public of
all navigable waters at or adjacent to the authorized work.
7) The permittee will maintain the authorized work in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this
requirement ifhe abandons the permitted activity without having it transferred to a third
party.
8) This permit does not authorize the interference with any existing or proposed Federal
project, and the permittee will not be entitled to compensation for damage to the
authorized structure or work, or injury which may be caused from existing or future
operations undertaken by the United States in the public interest.
9) The permittee must install and maintain at his expense any signal lights or signals
prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized
facilities. At a minimum, permanent reflectors should be attached to the structure in
order to make it more visible during hours of darkness or inclement weather.
10) This permit authorizes a maximum of nine boat slips. At no time shall more than nine
vessels be moored or docked at the facility. The restriction of the number of vessels shall
apply to all marine vessel types, including but not limited to motorboats, sailing vessels
and personal watercraft.
11) In order to protect water quality, runoff from the construction must not visibly increase
the amount of suspended sediments in adjacent waters.
12) The permitted activity will be conducted in such a manner as to prevent a significant
increase in turbidity outside of the area of construction or construction-related discharge.
Increases such that the turbidity in the waterbody is 25 NTU's or less in all saltwater
classes are not considered significant.
13) A ground cover sufficient to restrain erosion shall be provided within the shorter of 15
working or 30 calendar days of completion of any phase of grading on cut or filled
slopes.
14) Appropriate sedimentation and erosion control devices, measures or structures must be
implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses
and property (e.g. silt fence, diversion swales or berms, sand fence, etc.).

15) Any development or land disturbing activity that is considered non-water dependent is
not authorized within 30 feet of the normal high water level unless specifically exempted
by Coastal Resource Commission (CRC) regulations in place at the time of such
development.
16) In order to avoid unreasonable danger to life and property, all development shall be
designed and placed so as to minimize damage due to fluctuations in ground elevation
and wave action in a 100-year storm. Cantilevered decks and walkways shall meet this
standard or shall be designed to break-away without structural damage to the main
structure.
17) Any building constructed shall comply with the North Carolina Building Code and the
local flood damage prevention ordinance as required by the National Flood Insurance
Program.

The building code or flood damage prevention ordinance may impose additional
more restrictive requirements than the Division's standards for development in
areas of environmental concern (AECs).
The permittee's contractor is advised to contact the U.S. Coast Guard at (910)
772-2220 to discuss operations and appropriate lighting, markers, etc. for all
dredge equipment.
If the permittee discovers any previously unknown historic or archaeological
remains while accomplishing the authorized work, he will immediately notify the
District Engineer, Wilmington Branch, U.S. Army Corps of Engineers at (910)
251-4511, who will initiate the required State and Federal coordination.
The permittee is advised to contact the local health department regarding
requirements for septic tank installations (as required under 15A NCAC
18A.1900 et. seq.). For information concerning septic tank and other on-site
waste disposal methods, contact the Carteret County Health Department.
This permit does not eliminate the need to obtain any additional state, federal or
local permits, approvals or authorizations that may be required.
Future development of the permittee's property may require a modification of this
permit. Contact a representative of the Division at (252) 808-2808 prior to the
commencement of any such activity for this determination. The permittee is
further advised that many non-water dependent activities are not authorized
within 30 feet of the normal high water level.
This permit does not convey any rights, either in real estate or material.
Should either adjacent property be sold prior to the initiation of construction, the
permittee shall be required to obtain a signed riparian corridor waiver from the

new property owner prior to the placement of any structures within the 15 foot
riparian corridor.

Project Description
This site is located in the Town ofIndian Beach, Carteret County, North Carolina off
Highway 58 East. This property is owned by The Estate of Lillian P, Taylor with Jack
Stancil, CPA, as the Executor. P.I.N. numbers for the project are 6324.12-96-6928 and
6334.09-06-0434. The Subdivision is located adjacent to Bogue Sound, which has an
ORW classification, in the White Oak River Basin. The scope of this project involves the
construction of a 30 lot, low density, residential subdivision which includes home sites,
roads, pedestrian boardwalks and open/common areas. Lots will be served by public
water and an off-site tertiary sewage treatment plant. This project has received
preliminary site plan approval from the Town of Indian Beach.
The land ranges in elevation 1 foot to 30 feet NA VD 88, with an average upland
elevation of approximately 8 feet. The existing project area consists of maritime forest as
well as salt marsh and 404 wetlands.
The total project area is 20.48 acres with 19.66 acres of developable area. The proposed
total impervious area for the entire site (including structures, roads, etc.) is 4.72 acres
which represents a 24% total impervious percentage. Deed restrictions and protective
covenants will be adopted limiting the impervious areas of the individual lots to the areas
shown on sheet CP2.0.
The approved (permit no. SW8 080609/dated 07.17.08) low density stormwater plan is
designed in such a way that the runoff from the streets will flow onto the roadside
shoulders throughout the project. Roads and lots are being graded to drain, where
practicable, the majority ofthe surface run-off away from the environmentally sensitive
areas.
Upland Development
The proposed plan calls for 30 single family lots. The lots range in size from 13,397 sq. ft.
to 35,931 sq.ft. with an average lot size of24,664 sq.ft. Amenities include a series of
common and conservation areas to be used by the homeowners. (4) 20'x20' gazebos will
be located in these common areas. A series of concrete walks are proposed to connect
various common areas. Two 6' pedestrian piers will extend into Bogue Sound for a
length of200' from NL W. Each of these piers has a 15'x15' viewing platform.
