Send all suspicious email as an attachment to report.spam@nc.gov<maiIto: report.spam@nc.gov> of Pursuant to the CAMA-Corps Programmatic Permit process, the North Carolina Division of Coastal Management (NCDCM) has forwarded to our office a copy of the CAMA permit modification request for the subject project. The attached notice requests federal agency comments on this project by July 27, 2019. The applicant proposes to construct a 23 -lot residential subdivision adjacent to Bogue Sound, located on an approximate 20.5 -acre parcel, at 1824 Salter Path Road, in Indian Beach, Carteret County, North Carolina. Coordinates in Decimal Degrees are: 34.6845 N -76.9037 W. The site is currently undeveloped, forested, and contains both coastal and non -coastal wetlands. Water depths immediately adjacent to the property are -0.5' to -3' at NLW. According to the application, SAV beds are present in these waters. Dredging is not proposed. A docking facility is also not proposed at this time. Specifically, the applicant proposes to place fill material into federally jurisdictional wetlands in order to provide access to the site. The applicant proposes to construct 5 shared driveways to access the 12 waterfront lots. Total wetland fill impacts are 0.43 acre. Culverts installed at wetland crossings will be 24" in diameter and buried 25%. The length of each culvert is 36'. The applicant proposes to provide compensatory mitigation for unavoidable fill impacts to wetlands through payment into the Bachelor's Delight Private Mitigation Bank (credit reservation letter attached). *The site was previously authorized in 2008 as a 30 -lot subdivision with a docking facility and observation platforms. The project was never constructed. Please see the attached request, plans, mitigation credit reservation letter, and location map for more detailed information concerning the proposed project. The applicant has removed from the request the proposed wetland fill on lots 11 and 12, as it was unnecessary for site access. EFH This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project will not affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The waters within the project area designated ORW by the Division of Water Resources. Waters within the project area are NOT designated as PNA by the NC Division of Marine Fisheries and are OPEN to the taking of shellfish. ESA: The Corps has reviewed the project area, examined all information provided by the applicant and consulted the latest North Carolina Natural Heritage Database. Based on available information, the Corps has determined that the project will have No Effect to listed species listed as threatened or endangered or their critical habitat formally designated pursuant to the Endangered Species Act of 1973 (ESA) within the project area. Narrative Description: CAMA Major Permit 93-09 was issued on July 1, 2009 for a 30 -lot subdivision with dock amenities. This authorization expired on December 31, 2017. The property is located in Indian Beach at 1824 Salter Path Road, Carteret County. The parcel is a 20.5 -acre tract adjacent to Bogue Sound. This site is currently undeveloped. The adjacent properties are residential complexes. The property to the east is a condominium complex, and the property to the west is a religious community group home facility. Salter Path Road borders the property on the south side. Clearing of vegetation to access the property has begun in two areas off of Salter Path Road. The average elevation of the high ground of the parcel is +12' above normal high water level. The topography varies from 30' MSL near Salter Path Road down to 2' MSL in wetland areas. Vegetation on the tract mainly consists of maritime forest, which includes Section 404 Wetlands and coastal marsh. There is approximately 1,740' of shoreline along Bogue Sound on this tract. Section 404 Wetlands extend east -west through the middle of the tract approximately 300' north of Salter Path Road. There are Coastal Wetlands present on the north side of the tract dominantly comprised of Spartina alterniflora, along the shoreline adjacent to Bogue Sound. Immediate offshore water depths adjacent to the tract along Bogue Sound range from about —0.5' to —3' nlw. The subaqueous substrate is firm with shell. This waterbody is about 2.5 miles across at this location. These waters are not classified as a Primary Nursery Area andthere is submerged aquatic vegetationpresent. This areais opento shellfishharvest and is classified as Outstanding Resource Waters. Approximately 16 acres of the tract is located within the 575' ES AEC. There is a Federal Channel extending throughBogue Sound, approximately 2 miles north of the project area. 10. Proposed Development: The applicant wishes to construct a new 23 -lot subdivision ("Roosevelt Cove") with infrastructure adjacent to Bogue Sound. This would include five shared driveway crossings traversing Section 404 Wetlands in order to access the twelve waterfront lots within the subdivision. The upland development will consist of the construction of five 20' wide (shared) asphalt driveways to serve the waterfront lots of the subdivision. The average lot size will be about 1 acre. These driveways would impact 87,120 square feet of uplands and 21,696 square feet of Section 404 Wetlands. The wetland crossings would include through -flow culverts. These five culverts for the proposed driveways would each be 36' long and 18" wide. Additionally, there are Section 404 Wetland fill impacts proposed for.Lots 11 &12 in order to connect sections of high ground. Lot 12 also would include a culvert 30' long and 18" wide. It is a reincarnation of the previously proposed and permitted Taylor Tract in 2009. The Taylor Tract was previously proposed as a 30 lot subdivision with a small docking facility and observation piers. Roosevelt Cove will be served by five shared driveways to limit access connections to NC Hwy 58 with lot 13 being served by a single driveway.
