Therefore, in accordance with your request, NCG500137 is rescinded, effective immediately.
If in the future your comp, pang wishes to discharge wastewater to the State's surface waters, they
must first apply for and receive a new NPDES permit. Discharge of wastewater without a valid
NPDES permit will subject the responsible party to a civil penalty of up to $25;000 per day.

Enclosed please find a copy;of the Compliance Evaluation Inspection form from the inspection conducted on
September 14, 2007. The cooperation of Norb Dickmann was greatly appreciated. The Compliance Evaluation
Inspection was conducted by Danny Strickland, Environmental Sr. Technician, of the Fayetteville Regional Office.
The facility was found to be.in'Compliance with permit NCG500137.
COMMENTS
• During my inspection I found the facility to be clean and neat in appearance: DMR's•for the months of
January and July 2007ewere reviewed and were in order at the time of inspection. The facility 'was also
notified that they must;sample for total residual chlorine since they are purchasing water form a public
water supply (General Permit Part I note 2).
As a reminder, preservation of the Waters of the State can only be achieved through consistent NPDES. Permit
compliance. Please refer to the enclosed inspection report for additional observations and comments. If .you, or your

On January 10, 2007, I, Michael. Lawyer froth the Fayetteville Regional Office of the Division of
Water Quality, conducted ai site inspection for the Energy Conversion Systems facility located at One
Morganite Drive in Dunri, Harnett County, North Carolina. A.copy of the inspection reports is enclosed
for your review. Stormwater and wastewater from the facility, drains to a municipal drainage ditch that
flows to the Black River, a Class C;Sw water located in the Cape Fear River Basin. The site visit and
file review revealed that the subject facility is covered by NPDES Stormwater General Permit-
NCG030008 and NPDES Wastewater General Permit-NCG500137.
Accordingly, the following observations were noted during the Division of Water Quality
inspection:

Semi-annual monitoring of flow, pH and temperature has been conducted per the conditions of the
general wastewater permit for non -contact cooling water discharges.
Please be advised .that violations of the NPDES General Permit are subject to a civil
penalty assessment of up to $25,000 per day for each violation. If you or your staff has any

Inspection Summary.;
•
Facility manufactures metal brushes for electrical motors using a variety of materials including carbon, graphite and
copper. Inspection conducted with the assistance of Mr. Norb Dickmanni Manager of Environmental Services. Facilitys
Stormwater Pollution Prevention Plan is detailed yet easy to follow and contains all permit required items. Analytical and
qualitative monitoring are being conducted per the conditions of the general pert -nit. Facility has one outfall, which
conveys stormwater flow from storm 'drains located throughout the facility into.a municipal drainage ditch along the
backside of the property. Exposure of materials and waste products to stormwater has been limited through the use of
shelters, breezeways and "supersacks", which are large water resistant bags used in conjunction with the facility s dust
CollectorS to contain the fine metal shavings from the manufacturing process. Secondary containment is provided around
all above -ground Storage tanks and the stormwater release valves are equipped with a lock.
After the inspection was completed, an assessment was conducted on the company's commutator facility that is located
directly across North Ash Avenue to determine if this separate facility needed coverage under a general stormwater
permit While the commutator facility has pallets stored outside as well as a secondary containment structure with a
locked stormwater release valve around a used oil tank: there appeared to be no identifiable point of discharge. Based on
the lack of S:conbentratedStormwater discharge point it was determined that the commutator facility does not require
permit coverage at this time.

Your facility is currently covered for wastewater discharge under General Permit NCG500000. This permit expires
on July 31, 2002. Division' of Water Quality (DWQ) staff is in the process of rewriting this permit with a
scheduled reissue in the summer of 2002. Once the permit is reissued, your facility would be eligible for continued
coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the DWQ for renewal of
your permit coverage. To make this renewal process easier, we are informing you in advance that your permit
coverage will be expiring. Enclosed you will find a general permit coverage renewal application form. This
will serve as your applicationfor renewal of your permit coverage. The application must be completed and
returned with the required information by February 01, 2002 in order to assure continued coverage under the
general permit. There is noireriewal fee associated with this process. Your facility will be invoiced for the annual
permit fee at a later date. '
Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger
penalties may be assessed depending on the delinquency of the request. Discharge of wastewater from your facility
without coverage under a valid wastewater NPDES permit would constitute a violation of NCGS 143-215.1 and
could result in assessmentsi of'civil penalties of up to $10,000 per day.

Attached is a Notice ;of Intent to be covered by the NPDES General Permit # NCG500000 and
the necessary $400.00 application fee. Morganite intends to discharge non -contact cooling
water to the stormwater drainage ditch located on our property, intermittently, as required as a
backup for our normal system. This non -contact cooling water would consist of city water with no
additives. Non -contact cooling water is normally sent to a cooling tower and recycled or, in some
cases, it consists of once -through city water discharged directly to the POTW. In the event of
an upset condition in' this cooling system we want to be able to switch all or part of the cooling to
once -through city water that can be discharged to the stormwater drainage ditch. Upset
conditions could include power failures where the pumps recirculating the water from the cooling
tower would not work and other infrequent mechanical pump and cooling tower failures. The
pressure of the city water would move the water through the cooling systems on the equipment
and then to the drainage ditch. It is impossible to route all of this once -through cooling water to
the POTW because our plumbing does not have the capacity to carry it all and several pieces of
equipment are not located near sewer hookups. The discharge to the drainage ditch would be
used as a backup only, though it could be used for days at a time in a major failure of a cooling
tower. A maximum of 100 gallons per minute is anticipated.
The stormwater drainage system wends its way through at least a mile of ditches before it is
discharged into waters of the United States. The local department of public works tells us that
the drainage ditches1discharge into the Black River between Dunn and Erwin but they say a map
of the ditch system is not available.

NORTH CAROLINA GENERAL STATUTE 143-215.6 (B) (2) PROVIDES THAT:
Any person who knowingly makes any false statement, representation, or certification in any
application, record, report, plan or other document files or required, to be maintained under Article 21 or
regulations of the Environmental Management Commission implementing that Article, or who falsifies,
tampers with or knowingly renders inaccurate any recording or monitoring device or method required to
be operated or maintained under Article 21 or regulations of the Environmental Management
Commission implementing that Article, shall be guilty of a misdemeanor punishable by a fine not to
exceed $10,000, or by imprisonment not to exceed six months, or by both. (18 U.S.C. Section 1001 provides
a punishment by a fine of not more than $10,000 or imprisonment not more than 5 years, or both, for a
similar offense.)
