Wynn, Mayor Town of Cofield 105 Melton Street Cofield, NC 27922 NORTH CAROLINA Environmental Quality August 10, 2021 Subject: Return of Sewer Extension Application No. WQ0042621 Village of Cofield Sanitary Sewer Rehabilitation Sewer Extension Application and Variance Request Hertford County Dear Ms. Wynn: The Division of Water Resources (Division) is returning the enclosed sewer extension application package for review for the following reason(s): In the response to the original comments (sent June 29, 2020, with a response received June 9, 2021) on the variance request package the Town of Cofield noted that the construction of an alternative design under 15A NCAC 02T.0105(n) for an equalization tank at the Town's pump station is proposed primarily to reduce the potential for recurring fee surcharges from the Town of Winton. This was due to regularly discharging flows in excess of the 40,000 gallon -per -day limit, as specified by the contractual agreement between the two Towns, through the interconnection to the Winton WWTP. Reducing the likelihood of a surcharge fee is not a valid or sufficient reason for approving an alternative design, as readily available options exist to avoid the necessity of the proposed alternative design. As such, we are denying the request for the requested variance as received originally on December 2, 2019, which necessitates the return of the associated sewer extension application received on June 9, 2021. Please be advised that construction and/or operation of wastewater collection system extension without a valid permit is a violation of North Carolina General Statute 143-215.1 and may subject the Applicant to appropriate enforcement actions in accordance with North Carolina General Statute 143-215.6. Civil penalties of up to $25,000 per day per violation may be assessed for failure to secure a permit required by North Carolina General Statute 143-215.1.
